A. 
The owner, occupant or tenant of every property fronting upon or alongside any of the streets or alleys in the Borough is hereby required to remove or cause to be removed from all of the sidewalks in front of or alongside such property:
(1) 
All snow and ice thereon fallen or formed, within 24 hours after the same shall have ceased to fall or to be formed, provided no such snow or ice shall be placed beyond three feet of the curb and in no case in the cartway or traveled portion of the street.
(2) 
Any and all obstructions thereon, immediately after notice from the Police Department to remove the same, except for such obstructions placed thereon in connection with lawful work of construction, reconstruction or repair of such sidewalk, or specifically authorized by any other ordinance of the Borough, under a valid permit from the Borough, if a permit be required in order to place or maintain such obstruction.
B. 
Provided. The owner of a property shall be responsible for conforming to the requirements of this section where such property is occupied by such owner, or is vacant or unoccupied, or is a multiple-business or multiple-dwelling property, designed for occupancy by more than one tenant or occupier; the tenant or occupier thereof shall be responsible therefor where such property is occupied by such tenant or occupant only.
In any case where the owner, occupant or tenant, as aforesaid, shall fail, neglect or refuse to comply with any of the provisions of the first section of this article within the time limit, or following the notice prescribed therein, the Police Department, or any other person designated by the Borough Council for the purpose, may proceed immediately to clear all snow and/or ice, or to remove all obstructions, as the case may be, from the sidewalk of such delinquent, and the Borough is hereby authorized to collect the expenses of such clearance or removal, with any additional amount allowed by law, from such owner, occupant or tenant, as the case may be, which may be in addition to any fine or penalty imposed under § 328-11 of this chapter.
Any owner, occupant or tenant who shall fail to remove any snow or ice or other obstruction from any sidewalk as required by § 328-9 of this article shall, upon conviction thereof, be sentenced to pay a fine of not more than $300, and costs of prosecution, or, in default of payment of such fine and costs, to undergo imprisonment for not more than 30 days, provided such fine and costs of prosecution may be in addition to any expenses and additional amounts authorized by law, imposed as provided in § 328-10 of this chapter.
