There is hereby created the office of Municipal Clerk in the Borough of Brielle.

The Municipal Clerk shall be appointed by the Governing Body of the Borough. The term of office of Municipal Clerk shall be for three years from January 1 in the year in which he or she was appointed.

a. 
General. The Municipal Clerk shall attend all meetings of the Council, keep a correct record of all its proceedings and make such record available in a timely manner, certify all records and municipal documents, have the power and authority to take and administer oaths and affirmations in Borough matters, and perform all the functions of municipal clerks as specified by law. The Clerk shall assist the Governing Body in the preparation of the annual budget and make recommendations thereon. After adoption of the annual budget, the Clerk shall see to it that the same is properly administered and implemented. In addition, he shall perform such other duties as the Council may require. In addition to the foregoing, the Clerk shall be responsible for the day-to-day functions of all municipal services and functions. All department heads are responsible to the Municipal Clerk who shall be responsible to report as to the status of the functioning of such department to the Governing Body. The Clerk shall be responsible for the providing of efficient delivery of all municipal services and of all municipal duties except for the Police Department. The Clerk shall supervise, integrate and coordinate the functions of all departments. The Clerk shall further integrate and coordinate the functions of the boards, independent agencies, agencies, and employees of the Borough except for the Police Department. The Clerk shall be responsible to assure that the organizational chart adopted by resolution annually by the Governing Body is implemented. The Clerk shall further implement such policies and directives as are adopted by the Governing Body. Notwithstanding the foregoing, the Clerk shall not have the power to hire, discharge or promote personnel, but shall have the power to make recommendation as to same to the Governing Body. The Clerk shall provide by December 1 of every year an annual performance review of all employees. Such reviews may be prepared by the department heads reporting to the Clerk and shall be made a part of each employee's personal file. He shall coordinate the purchasing of supplies, services, materials and equipment. He shall cause to have certified the receipt of the same and attend to the submission of proper vouchers for payment and review of all disbursements in connection therewith.
b. 
Records. In addition to recording ordinances and resolutions of a permanent character, the Clerk shall have custody of and shall safely keep all records, books and documents of the borough, except those committed by ordinance to any other office or transferred thereto by the Governing Body. He shall, upon request and upon the payment of the fees prescribed therefor by resolution of the Council for the use of the Borough, furnish a certified copy of such paper in his custody, under the corporate seal of the Borough. c. 
Filing of Rules, Regulations. All rules or general regulations made by any department, officer, agency or authority of the Borough shall be filed with the Clerk. The Clerk shall maintain a current compilation of all such rules and regulations, which shall be available for public inspection in his office during business hours.
d. 
Custodian of Borough Seal. The Clerk shall be the custodian of the Borough seal. The Clerk shall cause the corporate seal of the Borough to be affixed to instruments and writing when authorized by ordinance or resolution of the Council or when necessary to exemplify any document on record in his office or to certify any act or paper which, from the records in his office, shall appear to have been a public act of the Borough or a public document. He shall not affix the Seal or cause it to be affixed to any other instrument or writing or other paper, unless required by State Statute or ordinance of the Borough.
e. 
Duties Regarding Sureties, Bonds, Leases; Reports Required. The Clerk, subject to the supervision of the Mayor and Council shall:

Be the depository and custodian of all official surety bonds furnished by or on account of any officer or employee, all insurance policies upon or with respect to risks insured for the benefit of the Borough or to protect it against any claim, demand or liability whatsoever, and all formal contracts for work, labor services, supplies, equipment and materials to which the Borough may be a party. 2. 
Be the depository for and have custody of all performance bonds running to the Borough as obligee, or any other form of security given by any contractor, subdivision developer or other persons on account of work done or to be done in or for the Borough.
3. 
Have custody of all leases or property owned by the Borough.
4. 
Report to the Council, at such time as may be required, on the coverage, premium and expiration date of each surety bond and insurance contract and the terms of leases and their expiration dates.
f. 
Additional Duties. The Clerk shall also:
1. 
Administer the provisions of the Borough ordinances with reference to the licensing of occupations and activities for which licenses are required by law or ordinance to be obtained from the Clerk.
2. 
Keep a calendar of all matters pending before the Council and shall prepare the required agendas.
3. 
Administer the provisions as the "Administrative Official" of N.J.S.A. 40:55D-1 et seq. and as designated therein.
4. 
Act as the issuing authority to approve the granting of raffle and gaming licenses as provided by Law.

The Borough hereby waives the requirement that the Municipal Clerk reside in Brielle.

a. 
Office Created. There is hereby created the office of Deputy Municipal Clerk in the Borough of Brielle.
b. 
Duties. The person appointed to the office of Deputy Municipal Clerk in the Borough shall do and perform all of the duties assigned to him by the Municipal Clerk of this Borough and the Borough Council in relation to such office, and shall have all the powers and perform all the duties of the Municipal Clerk at such times and for such specific periods when the Municipal Clerk is absent.
c. 
Appointment; Term of Office. The Deputy Municipal Clerk shall be appointed by the Mayor and confirmed by the Council for a one year term commencing January 1.
