As used in this Chapter, the following terms shall have the
meanings indicated:
MANUFACTURED HOME and MOBILE HOME
A structure, transportable in one (1) or more sections, which
in the traveling mode is eight (8) body feet or more in width or forty
(40) body feet or more in length, or when erected on site, is three
hundred twenty (320) square feet or more, and which is built on a
permanent chassis and designed to be used as a dwelling with or without
a permanent foundation when connected to the required utilities, and
includes the plumbing, heating, air-conditioning and electrical systems
contained therein; except that such term shall include any structure
that meets all of the requirements of this definition except the size
requirements and with respect to which the manufacturer voluntarily
files a certification required by the Secretary of HUD and complies
with the standards established under Title 42 of the United States
Code. For mobile homes built prior to June 15, 1976, a label certifying
compliance to the Standard for Mobile Homes, NFPA 501, in effect at
the time of manufacture is required. For the purposes of these provisions,
a mobile home shall be considered a manufactured home.
ON-SITE DEMOLITION
The removal of a manufactured home or mobile home or the
removal of any structure from any property in small sections or pieces
created by the disassembly or destruction of the manufactured home,
mobile home, or structure, typically using an approved container for
the transportation of debris.
STRUCTURE
That which is built or constructed, including, but not limited
to, residences, garages, sheds and outbuildings, porches, decks, carports,
and manufactured or mobile homes.
STRUCTURE REMOVAL
The transportation of any manufactured home, mobile home,
or structure which is substantially whole or intact, whether with
a truck or trailer or when pulled by any type of motor vehicle or
heavy equipment.

Before any person, partnership, or corporation shall engage
in the business of the on-site demolition or structure removal of
residences or other structures, such person, partnership, or corporation
shall obtain a business license from the City Clerk.

No business license shall be issued until the applicant has
provided proof of liability insurance coverage and workers' compensation
insurance coverage or proof of exemption from such insurance requirements
and all fees due the City have been paid.

A. Prior to the demolition or removal of any structure, the property
owner shall apply for and obtain a permit issued by the City for demolition.
Such permit shall contain:
1.
The property owner's name, mailing address, and phone number.
2.
The legal description and 911 address of the affected property.
3.
A description of all structures to be demolished or removed
from the property.
4.
Any requirements for cleanup relating to the demolition or removal.
5.
The location of the disposal site for associated debris.
6.
A date of permit expiration no more than sixty (60) days from
the permit issuance date.
B. There shall be no fee for said permit, but the permit holder shall
sign the demolition permit and acknowledge the terms and conditions
set out therein.
C. In the event that the manufactured or mobile home or structure is
to be removed by reason of foreclosure or repossession, the mortgage
holder or his/her representative shall be eligible to apply for and
obtain a demolition permit, provided that copies of all court orders
authorizing the removal of the manufactured or mobile home or structure
shall be submitted with the permit application.

Prior to the issuance of a demolition permit, the applicant
shall post a cash bond with the City Clerk, guaranteeing faithful
performance of all City ordinances and of all requirements, pertaining
to the demolition of structures. The cash bond amount for on-site
demolition shall be five hundred dollars ($500.00) and the cash bond
amount for structure removal shall be five thousand dollars ($5,000.00).

After the demolition or removal of structures and the associated
cleanup is complete, the permit holder must notify the City in writing
to request an inspection. The cash bond shall be ordered released
only after the demolition and cleanup have received an approval from
the inspector and the demolition has been deemed complete.

All utilities, including electricity, propane, water, sewer,
telephone, and cable or satellite television, shall be disconnected
prior to the demolition or removal of any structure.

The demolition or removal of structures shall not create a nuisance
as defined by City ordinances.

Failure to comply with any of the requirements of this Chapter shall be deemed an ordinance violation and, upon conviction thereof, such person shall be punished as set forth in Section
100.220 of this Code. Penalties for violation also include forfeiture of any or all of the cash bond posted.
