As used in this Chapter, the following terms shall have the
meanings indicated:
BUSINESS, TRADE, AND OCCUPATION
Shall be construed to mean all manner of businesses, trades,
and avocations whatsoever transacted, conducted, and carried on for
gain, profit or as a means of livelihood in the City of Merriam Woods.
PEDDLER
Any person, firm, partnership, or corporation, soliciting,
selling, or offering for sale any article, chattel, or thing for profit
by calling from residence to residence, or selling from wagon or truck
within the City limits, who has not a regular licensed place of business
in the City of Merriam Woods, or is not a resident of said City.

A. It shall be the duty of every person or persons, firm, or copartnership,
and every corporation transacting, conducting, and carrying on any
business, trade, or avocation whatsoever for gain, profit, or as a
means of livelihood within the corporate limits of Merriam Woods,
Missouri, to apply to and secure a license from the City Clerk or
another authorized representative of the City authorized to receive
such monies and issue such license, before he/she, she, they, or it
shall transact, conduct and/or carry on such business, trade, or avocations
within the corporate limits of Merriam Woods.
B. Peddlers are also required to apply to and secure a license from
the City Clerk or another authorized representative of the City authorized
to receive such monies and issue such license, before he/she commences
operations.

There is hereby levied a license fee for all businesses, trades,
occupations, and avocations as hereinafter set out and which are transacted,
conducted, and carried on within the corporate limits of Merriam Woods,
Missouri; and every person or persons, firm, copartnership, or corporation
transacting, conducting, and carrying on any of the businesses, trade,
occupations, or avocations hereinafter mentioned are hereby required
to pay an annual license fee of fifty dollars ($50.00) to the City
of Merriam Woods for each business operating within Merriam Woods'
corporate limits. The fee levied upon peddlers shall be five dollars
($5.00) per day, not to exceed thirty dollars ($30.00) per year. Said
fee shall be paid when the application is submitted.

A. Application for business license shall be made to the City Clerk
during regular business hours on a form provided by the City. Application
forms must include all information requested and will require the
attached documents listed below. Any application which is incomplete
or is missing attached documents shall be rejected.

Retail Business. All businesses subject to the collection and
remittance of sales tax and/or employment withholding tax under the
supervision of the Missouri Department of Revenue shall submit proof
of sales tax registration at the time of application for business
license. A statement of no tax due from the Missouri Department of
Revenue dated no more than ninety (90) days prior to the application
shall be submitted with the application.

Construction-Related Business. All businesses subject to workers'
compensation insurance coverage as required by State Statute must
submit proof of workers' compensation insurance coverage at the time
of application for business license.

The term for each business or peddler's license shall be for
twelve (12) months, starting on January 1st of each year.

No license issued under the provisions of this Chapter shall
be transferred to another person or persons, firm, copartnership,
or corporation.

The City Clerk is hereby directed to maintain an accurate record
of all licenses issued under the provisions of this Chapter and shall
record to whom each license is issued, for what type of business,
for what time period, and the amount of license fee collected.

Any person violating this Chapter shall be deemed to be guilty of an ordinance violation and shall be subject to a fine as set forth in Section
100.220 of this Code.
