A certain document, one (1) copy of which is on file in the office of the City Clerk of Merriam Woods, Missouri, being marked and designated as the International Building Code, 2003 Edition, including Appendix Chapters I and J, as published by the International Code Council, be and is hereby adopted as the Building Code for Merriam Woods, Missouri, for regulating and governing the conditions and maintenance of all property, buildings, and structures; by providing the standards for supplied utilities and facilities and other physical things and conditions essential to ensure that structures are safe, sanitary, and fit for occupation and use; and the condemnation of buildings and structures unfit for human occupancy and use and the demolition of such structures in the City of Merriam Woods; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said Building Code on file in the office of the City are hereby referred to, adopted, and made a part hereof as if fully set out in this Article, with the additions, insertions, deletions, and changes, if any, prescribed in Section 500.020 of this Article.

A. 
The following Sections are hereby revised:
1. 
Section 101.1, insert "Merriam Woods, Missouri."
2. 
Section 1612.3, insert "Merriam Woods, Missouri."
3. 
Section 1612.3, insert "4-1-2004."
A. 
For any violation of the code adopted hereby, the violator, upon conviction, shall be punished by a fine not exceeding five hundred dollars ($500.00) or by imprisonment in the City or County Jail not exceeding ninety (90) days, or by both such fine and imprisonment. Every day any violation shall continue shall constitute a separate offense.
B. 
Whenever any act is prohibited by the code adopted hereby, by an amendment thereof, or by any rule or regulation adopted there under, such prohibition shall extend to and include the causing, securing, aiding, or abetting of another person to do said act. Whenever any act is prohibited by the code adopted hereby, an attempt to do the act is likewise prohibited.

If any Section, Subsection, sentence, clause or phrase of this Article is, for any reason, held to be unconstitutional, such decision shall not affect the validity of the remaining portions of this Article. The Board of Aldermen hereby declares that it would have passed this Article, and each Section, Subsection, sentence, clause or phrase thereof, irrespective of the fact that any one (1) or more Sections, Subsections, sentences, clauses or phrases be declared unconstitutional.
