A. It shall be unlawful to change the grade of any property in Merriam
Woods without first obtaining a building permit for such change. Any
grade change which will require more than a twelve-inch change to
the existing grade anywhere on the property will require a grading
plan be approved as part of the building permit application. The grading
plan will include topographical renderings of the affected property,
all neighboring properties, and the right-of-way showing the current
grade and the finished grade and will include specifications for materials,
compaction, and testing as required by the International Building
Code.
B. No grading plan which directs stormwater runoff onto a neighboring
property or onto a road surface will be approved.

Only those materials permitted in the International Building
Code as adopted by the Board of Aldermen will be acceptable for use
as backfill or compacted fill material. Materials other than those
specifically permitted in the code must be certified by a qualified
inspector approved by the City Code Inspector as part of a grading
plan.

Applicants may appeal the denial of a building permit due to
an unapproved grading plan by applying for relief from the Board of
Adjustment.

Failure to comply with the requirements of this Article shall be deemed an ordinance violation and upon conviction thereof, such person shall be punished as set forth in Section
100.220 of this Code.
