A. 
Where the Planning Commission and Board of Supervisors find that extraordinary hardships may result from strict compliance with any requirement of this Subdivision and Land Development Ordinance or that equal or better specifications may be available for public improvements, they may vary the requirements so that substantial justice may be done and the public interest secured; provided that such modification will not have the effect of nullifying the interest and purpose of this chapter.
B. 
In no case shall any provision of Chapter 350, Zoning, be considered for modification under the terms of this article. Relief from any requirement of Chapter 350, Zoning, can be obtained only through granting of a variance by the Zoning Hearing Board in their sole discretion.
A. 
In granting modifications, the Planning Commission may recommend and the Board of Supervisors may require such conditions, as will, in its judgment, secure substantially the objectives of the standard or requirements so varied or modified. The granting of administrative relief and modifications by the Planning Commission shall be conditional and subject to the final approval of the Board of Supervisors.
B. 
In approving such modification, the Board of Supervisors may attach any reasonable conditions which may be necessary to assure adequate public improvements and protect the public safety.
A. 
All requests for a modification shall be in writing and shall be a part of the application for final approval of a subdivision or land development. The request shall state the facts of unreasonableness or hardship or the equal or better specifications available, the provision or provisions of this chapter involved, and the minimum modification necessary.
B. 
The Board of Supervisors may refer the request to the Planning Commission for advisory comments prior to action and shall keep a written record of action taken. The request shall be referred to the Township Engineer for an opinion, particularly when the request is for a modification to the design standards or specifications for public improvements.
C. 
The recommendations of the Planning Commission and Township Engineer shall be entered into the record of the Board of Supervisors' meeting at which the modification is considered.
D. 
The reasons relied upon by the Board of Supervisors in approving or disapproving the request also shall be entered into the minutes of the meeting and any resolution or ordinance adopted governing an application which contains a request for a modification shall include specific reference to the modification and the reasons for approval or disapproval.
E. 
If approved, the final plat shall contain a notation indicating the substance of the modification granted and the date of approval by the Board of Supervisors.
