The existing Land Development and Subdivision Ordinance,[1] along with the existing Zoning Ordinance 2005-H[2] are in full force and effect, with this chapter as additional regulations running to mobile home parks as hereinafter set forth.

All mobile parks operated within Brady Township, Butler County, Pennsylvania, shall hold an annual permit issued by the Brady Township Board of Supervisors through the approved or designated officers of the same to issue the annual permit for each mobile home park in Brady Township.
The Board of Supervisors shall set by resolution the annual permit fee which shall be based on the Board of Supervisors determination on the cost of managing the same on an ongoing basis for the health, welfare and safety of residents.
The annual mobile home park permit shall require the park owner/operator to complete an annual application, as approved by the Township Board of Supervisors by resolution, of which shall include, but not be limited to, the owner of the mobile home park an "as built" drawing with all lots labeled and numbered, a list of all mobile homes owned by the owner/operator and specifically the location on each lot by lot number, and a binder of general commercial liability insurance listing Brady Township as an additional insured with a binder of insurance of at least $1,000,000 per occurrence.
The mobile home park owner/operator shall further provide for each lot by lot number in the mobile home park, the owner of said lot, the adult tenants of the same, by name, address and contact information, listing the number of people that reside at each mobile home, with all adults by name and address and any minors just by the number of children residing thereat. The provision shall be updated every 30 days based on any change of occupants for the mobile home located on a mobile park lot, as to keep the municipality updated of parties residing in the municipality for health, welfare and safety purposes, and primarily for emergency management purposes to know parties and their location.
The mobile home park owner/operator shall designate the specific contact person for Brady Township to be in contact with at any and all times, keeping that name, address and contact information updated within 48 hours of a time of change.
A. 
The mobile home park owner/operator shall have the valid annual permit posted in their operating office available for public review verifying that a Brady Township permit for operations of the mobile home park is currently in place. The mobile home park owner/operator shall apply 30 days prior to the expiration of the current permit to have a new permit issued with the same issued on an annual basis under the terms and conditions of this chapter.
B. 
This chapter shall incorporate the Brady Township Land Development and Subdivision Ordinance, along with the Brady Township Zoning Ordinance 2005-H.[1]

Brady Township, through its designated officers or code enforcement, shall undertake an annual inspection of all mobile home parks after the annual permit has been issued based on payment of the same, with that payment partially used for cost of verification of compliance with all Brady Township ordinances, specifically the Mobile Home Park Ordinance, along with the updates thereto. This annual inspection shall be scheduled with the owner/operator and undertaken in compliance with all Brady Township ordinances and updates thereto.
Any mobile home park owner/operator, person, firm or corporation, of which is in violation of any provision of this chapter shall be subject to a summary violation with a fine of up to $600 per violation, with each day being a separate violation as a term and condition of this chapter. The same shall be enforced by citation by the designated officer in proceeding through the Magisterial District Judge or any other court of appropriate jurisdiction for enforcement of the same.
Should any section, clause, provision or portion of this chapter be declared by a court of competent jurisdiction to be invalid or unconstitutional, such decision shall not affect or impair the validity of any other section, clause, provision or portion of this chapter. It is hereby declared to be the intent of the Supervisors of Brady Township that this chapter would have been adopted by Brady Township had such invalid or unconstitutional provision not been included herein, and the remaining portions of this chapter shall remain in effect as though the portion declared invalid or unconstitutional had never been a part hereof.
