There is hereby established a Board of Health, an official agency
of the Borough of Tenafly which shall consist of seven members, each
of whom shall be residents and legal voters of the Borough. Whenever
practicable, one or more members of the Board shall be qualified in
the fields of medicine, nursing, engineering, education and law.

All members of the Board of Health shall be appointed by the
Mayor, which appointment shall then be confirmed by the Borough Council.

Every member shall be appointed for a term of four years and
the terms of the respective members shall be arranged so that no more
than two such terms expire in any one year, each term commencing as
of January 1. No member shall be reappointed if he shall have served
two consecutive four-year terms until four years have elapsed after
such service.

Should a vacancy occur for any reason whatsoever, the position
vacated shall be filled for the unexpired term only by the Mayor with
the confirmation of the Borough Council as in the case of original
appointments.

The Board of Health shall meet and organize annually on January
1 or as soon thereafter as may be feasible and practical.

The Board of Health shall have the power to adopt, alter and
amend rules and regulations and Ordinances for its government for
the guidance and direction of its officers and employees. The Board
of Health shall further have all general and specific powers delegated
to it and prescribed by the Statutes of the State of New Jersey and
Ordinances of the Borough and shall regulate matters concerning public
health, nuisances and other fields as may be provided for in Title
26 and Title 24 of the New Jersey Statutes Annotated as amended. Its
powers shall also include but shall not be limited to the specific
powers enumerated in N.J.S.A. 26:3-31; the Board of Health shall further
have the authority to conduct investigations and to issue licenses
or permits and to collect fees therefor when applicable according
to law.

The Board of Health shall make provision for the appointment
of the Health Officer and a Registered Environmental Health Specialist
annually within the limits of such funds as may be made available
by the Mayor and Borough Council for such purpose in the annual budget.

Pursuant to N.J.S.A. 40:56A.1 et seq., there is hereby established
in and for the Borough of Tenafly, an Environmental Commission to
be known as the "Tenafly Environmental Commission."

The Environmental Commission shall consist of seven members
to be appointed by the Mayor of the Borough, provided that all members
must be residents of the Borough of Tenafly; at all times one member
of such Commission shall be a member of the Planning Board of the
Borough and one member shall be a Council Member of the Borough. Should
such member's term on the Planning Board or Borough Council terminate,
then a replacement from those bodies shall be designated to fill the
unexpired term on the Commission in order to insure such representation.
The Mayor shall designate from the Commission one member to serve
as Chairman of the Environmental Commission, whose duty it shall be
to preside at all meetings. No member may receive any compensation,
although expenses may be provided for upon approval by the Mayor and
Borough Council.
There shall be two alternate members of the Environmental Commission
to be appointed by the Mayor. The Mayor shall designate the alternate
members as "Alternate No. 1" and "Alternate No. 2." An alternate member
may participate in discussions of the proceedings, but may not vote
except in the absence or disqualification of a regular member. A vote
shall not be delayed in order that a regular member may vote instead
of an alternate member. In the event that a choice must be made as
to which alternate member is to vote, Alternate No. 1 shall vote first.

The membership of the Environmental Commission shall be for
three years or until the appointment and qualification of their successors.
Any member may be removed for cause by the Mayor or by the Borough
Council provided that written charges are served upon the member and
a hearing held thereon, at which time such members shall be entitled
to be heard in person or by the Borough Council. Should a vacancy
occur other than by expiration of term, the vacancy shall be filled
for the unexpired term. All appointments shall commence the first
day of January of the year in which the appointment is made.
The terms of the alternate members shall be for two years, except
that the terms of the alternate members first appointed shall be two
years for Alternate No. 1 and one year for Alternate No. 2, so that
the terms of not more than one alternate member shall expire in any
one year. A vacancy occurring otherwise than by the expiration of
a term shall be filled by the Mayor for the unexpired term only.

The Environmental Commission shall have power as follows:
a. To study and make recommendations concerning open space preservation.
b. To study and make recommendations concerning the water resources
management.
c. To study and make recommendations concerning air pollution control.
d. To study and make recommendations concerning solid waste management.
e. To study and make recommendations concerning noise control.
f. To study and make recommendations concerning soil and landscape protection.
g. To study and make recommendations concerning environmental appearances.
h. To study and make recommendations concerning marine resources as
well as protection of flora and fauna.
i. To conduct research into the use or potential use of open land areas
of the Borough.
j. To coordinate the activities of other unofficial bodies or organizations
concerned with the use of open space.
k. To advertise, prepare, print and distribute books, maps, charts,
and pamphlets, which in its judgment it deems necessary to effectuate
the purposes and powers as herein set forth.
l. To promote, in general, an environmental, ecological conservation
and natural resources program for the Borough.
m. In addition to the aforesaid, upon designation by the Mayor and Borough
Council, the Environmental Commission may act as liaison between other
Environmental Commissions or governing bodies of other municipalities
along with Federal agencies on a County, State or Federal level.

The Environmental Commission shall create and maintain an index
of all open areas in the Borough for the publicly or privately owned
areas in order to obtain information on the proper present and future
use of such areas, and may recommend to the Borough Planning Board
programs concerning such open space for inclusion in the Master Plan
of the Borough and for prospective development and use of such areas.

When designated by the Mayor and Borough Council, the Environmental
Commission may manage for environmental and conservation purposes
such lands which are owned in whole or in part by the Borough by virtue
of direct acquisition, condemnation, or donation.

If authorized and approved by the Mayor and Borough Council,
the Environmental Commission may acquire property, both real and personal,
in the name of the municipality by gift, purchase, grant, bequest,
devise or lease for any of its purposes and shall administer the same
for such purposes subject to the terms of the conveyance or gift.
Such an acquisition may be to acquire the fee or any lesser interest,
development right, easement (including conservation easement), covenant
or other contractual right (including a conveyance on conditions or
with limitations or reversions), as may be necessary to acquire, maintain,
improve, protect, limit the future use of, or otherwise conserve and
properly utilize open spaces and other land and water areas in the
Borough.

The Environmental Commission shall convene no less than four
times a year and may convene more often at the determination of the
members of the Commission. Minutes shall be kept of all meetings and
records maintained by the Commission of all of its activities. The
Commission shall report periodically as required by the Mayor and
Borough Council to the Mayor and Council; but in any event the Commission
shall make an Annual Report to the Mayor and Borough Council indicating
its accomplishments or activities for the preceding year and its plans
or projects for the following year. Included in the reports shall
be an accounting for any expenditures made during the period of the
report.

In furtherance of subsection
2-56.2, the Chairman of the Environmental Commission shall organize the Commission within 30 days of its creation, and the Commission shall choose by majority vote a person designated to act in the absence of the Chairman. The Commission is also authorized to adopt bylaws governing its procedural operation, which bylaws shall not become effective without the approval of the Mayor and Borough Council. Similarly, should the Commission be designated by the Mayor and Borough Council to manage certain lands as set forth, such managing shall not necessarily be exclusive but may be jointly with the Mayor and Borough Council or with other bodies or agencies of joint use as may be determined necessary by the Mayor and Borough Council. In conjunction with the management, the Commission may recommend rules and regulations for the use of the properties and the conduct of all persons using same, which rules shall be subject to the approval of the Mayor and Borough Council or any joint agencies charged with the final responsibility for management of the lands.

The Environmental Commission shall have no powers to raise funds
of its own other than the receipt of gifts of real or personal property
as hereinabove provided with the exception that the Mayor and Borough
Council may authorize private fund-raising activities if deemed necessary.
The Mayor and Borough Council may annually determine and appropriate
sufficient sums for the care, custody, policing or maintenance of
lands controlled in whole or in part by such Commission, which funds
shall be raised by taxation as part of the Municipal Budget. In addition,
the Mayor and Borough Council may appropriate annually a sum for the
expenses incurred by the Environmental Commission.

The Commission may appoint or employ a secretary or clerk and
other personnel as may be necessary for the operation of the Commission
and for custodial, supervisory, or other care of lands within the
jurisdiction of the Commission, provided that the expenditure of such
funds must be within the limits of the total appropriation of funds
made by the Borough Council on behalf of such Commission; provided
further, however, that any salaries, as opposed to expenses, shall
be fixed and determined by the Mayor and Borough Council and shall
be included in the general Salary Ordinance of the Borough.

There is hereby created in and for the Borough of Tenafly an
Historic Preservation Commission.

a. The Historic Preservation Commission shall consist of five regular
members and may have not more than two alternate members. There shall
be one member each of Class A and B, and three members of Class C.
Class qualifications shall be as follows:
1. Class A: A person who is knowledgeable in building design and construction
or architectural history and who may reside outside the Borough.
2. Class B: A person who is knowledgeable or with a demonstrated interest
in local history and who may reside outside the Borough.
3. Class C: Citizens of the Borough who shall hold no other municipal
office, position or employment, except for membership on the Planning
Board or Board of Adjustment.
b. Alternate members shall meet the qualifications of Class C members.
c. A student liaison may be appointed for the term of one year to expire
on December 31st.

a. The Mayor shall appoint all members of the Commission and shall designate
at the time of appointment the regular members by class and the alternate
members, if any, as "Alternate No. 1" and "Alternate No. 2."
b. The terms of the members first appointed shall be so determined that
to the greatest practicable extent, the expiration of the terms shall
be distributed, in the case of regular members, evenly over the first
four years after their appointment, and in the case of alternate members,
evenly over the first two years after their appointment, provided
that the initial term of no regular member shall exceed four years,
and that the initial term of no alternate member shall exceed two
years. Thereafter, the term of a regular member shall be four years
and the term of an alternate member shall be two years.
c. A vacancy occurring otherwise than by expiration of a term shall
be filled for the unexpired term only. Notwithstanding any other provision
herein, the term of any member common to the Historic Preservation
Commission and the Planning Board shall be for the term of membership
on the Planning Board and the term of any member common to the Historic
Preservation Commission and the Board of Adjustment shall be for the
term of membership on the Board of Adjustment.

The Historic Preservation Commission shall annually elect a
Chairman and Vice Chairman from its members, and select a Secretary,
who may or may not be a member of the Historic Preservation Commission
or a municipal employee.

The Commission shall create rules and procedures for transaction
of its business subject to the following regulations:
a. A quorum for the transaction of business shall consist of three of
the Commission's members, including the Chairman or, in his absence,
the Vice Chairman.
b. The Secretary shall keep minutes and records of all meetings and
proceedings, including voting records, attendance, resolutions, findings,
determinations and decisions. All such material shall be public record.
c. All meetings shall comply with the Open Public Meetings Act (N.J.S.A.
10:47 et seq.).
d. Alternate members may participate in discussions of the proceedings
but may not vote, except in the absence or disqualification of a regular
member. A vote shall not be delayed in order that a regular member
may vote instead of an alternate member. In the event that a choice
must be made as to which alternate member is to vote, alternate No.
1 shall vote.
e. No member of the Historic Preservation Commission shall be permitted
to act on any matter in which he has, either directly or indirectly,
any personal or financial interest.
f. A member of the Historic Preservation Commission may (after public
hearing if he requests it) be removed by the Borough Council for cause.

The Commission members shall serve without compensation, but
shall be reimbursed for expenses incurred in the performance of official
business.

The Historic Preservation Commission may employ, contract for
and fix the compensation of experts and other staff and services as
it shall deem necessary. The Commission shall obtain its legal counsel
from the Borough Attorney at the rate of compensation determined by
the Borough Council. Expenditures pursuant to this subsection shall
not exceed, exclusive of gifts or grants, the amount appropriated
by the Borough Council for the Commission's use.

The Historic Preservation Commission shall have the responsibility
to:
a. Prepare a survey of historic sites of the Borough, pursuant to criteria
identified in the survey report.
b. Make recommendations to the Planning Board on the historic preservation
plan element of the Master Plan and on the implications for preservation
of historic sites of any other Master Plan elements.
c. Advise the Planning Board on the inclusion of historic sites in the
recommended capital improvement program.
d. Advise the Planning Board and Board of Adjustment on applications for development pursuant to subsection
2-57.9.
e. Provide written reports, pursuant to subsection
2-57.10 on the application of the Zoning Ordinance provisions concerning historic preservation.
f. Carry out such other advisory educational and informational functions
as will promote historic preservation in the Borough.

The Planning Board and Board of Adjustment shall submit to the
Historic Preservation Commission a copy of every application submitted
to either Board for development in historic zoning districts or on
historic sites designated on the Zoning or Official Map or in any
component element of the Master Plan. The Historic Preservation Commission
shall provide its advice, which shall be conveyed through one of its
designated members or staff, to testify orally at the hearing on the
application, and to explain any written reports which may have been
submitted.

All applications for issuance of permits pertaining to historic
sites or property in historic districts shall be referred to the Historic
Preservation Commission for a written report on the application of
the Zoning Ordinance provisions concerning historic preservation to
any of those aspects of the proposed change, which aspects were not
determined by approval of an application for development by a municipal
agency pursuant to the Municipal Land Use Law N.J.S.A. 40:55D-1 et
seq. The Historic Preservation Commission shall report to the Administrative
Officer within 45 days of his referral of an application to the Historic
Preservation Commission. If within the forty-five day period the Historic
Preservation Commission recommends to the Administrative Officer against
the issuance of a permit to be issued, the Administrative Officer
shall deny issuance of the permit or include the conditions in the
permit, as the case may be. Failure to report within the forty-five
day period shall be deemed to constitute a report in favor of issuance
of the permit and without the recommendation of conditions to the
permit.

The Mayor shall, at the annual meeting held pursuant to N.J.S.A.
40A:60-3a., in each year hereafter, appoint two Council members, who,
together with the Mayor, shall be known as the Board of Police Commissioners
(also known as the Police Commission). If the Mayor elects not to
serve on the Board of Police Commissioners, then the Mayor shall appoint
three Council members. The Mayor shall appoint one of the Members
of the Board of Police Commissioners to be President of the Board.
The members of the Board of Police Commissioners shall serve without
compensation or remuneration of any kind. The Board of Police Commissioners
shall act as a liaison between the Police Department and the Mayor
and Council and may meet from time to time to consider public safety
issues affecting the community. The Board shall also perform such
other duties as may be imposed upon it from time to time by this or
any other ordinance of the Borough of Tenafly.

Appointments and promotions within the Police Department shall be made in accordance with the provisions of Section
2-8, Administrator, i.e., appointments up to and including the rank of Sergeant shall be made by the Borough Administrator and the Chief of Police; appointments and promotions to ranks above Sergeant (excluding Chief) shall be made by the Borough Administrator, Chief of Police and the Board of Police Commissioners. The Board of Police Commissioners shall recommend appointment of the Chief of Police to the Mayor and Council for approval.

There is hereby formed an Access for All Committee to consider,
deal with and provide advice and counsel to the Mayor and Council
of the Borough of Tenafly as to the concerns of the disabled persons,
barrier-free facilities, employment practices and the like and general
and specific compliance with the requirements of the Americans with
Disabilities Act and any appropriate legislation dealing with the
subject matter hereof.

The Access for All Committee will be composed of the following
classes of persons:
a. Composition. The Committee shall be comprised of at least seven and
no more than nine voting members, a majority of whom shall be persons
with disabilities, or parents of a child with a disability, or a resident
family member who is the caregiver of a person with a disability.
The balance of the Committee shall be nonvoting members composed of
the following Borough Departments or representatives: Liaison to the
Mayor and Council, Construction Official, Recreation, DPW, School
District, a student representative, and a member of the Business Community.
b. Appointments. The specific appointments to the aforesaid Committee
shall be made by the Mayor and Council for three-year terms.
c. Organization. The Committee as constituted shall meet at least quarterly,
shall by a majority vote select a Chairman to serve for a one-year
period, such selection to be made each year and shall act pursuant
to bylaws to be created by the Committee and adopted by a majority
vote thereof within 90 days from the formation of the Committee.
d. Record of Meetings to Be Kept. The record of proceedings of Committee
meetings shall be kept, and such record as well as any recommendations
or advice of the Committee to the Mayor and Council, shall be provided
no later than 60 days after each meeting.

The Mayor shall, as the annual meeting held pursuant to N.J.S.A.
40A:60-3a., appoint three Council members, one of whom shall be the
Council liaison to the Fire Department, to serve as the Fire Committee.
The members of the Fire Committee shall serve without compensation
or remuneration of any kind.

The Fire Committee shall perform the duties as set forth in the miscellaneous references thereto in Chapter
2, Article
III, subsections
2-47.10 through
2-47.15. The Fire Committee shall also perform such other duties as may be imposed upon it from time to time by this or any other ordinance of the Borough of Tenafly.
