The Mayor and Borough Council of the Borough of Woodbury Heights is hereby authorized to appoint a nonresident of the position of Municipal Clerk for the Borough of Woodbury Heights.
It is hereby found, determined and declared as follows:
A. 
N.J.S.A. 40A:9-133 allows for the appointment of a Municipal Clerk by the Mayor and Borough Council.
B. 
N.J.S.A. 40:87-15[1] requires that the Municipal Clerk be a resident of the borough.

C. 
N.J.S.A. 40:87-15[2] allows for an exemption from the residency requirement which shall be made by the adoption of a municipal ordinance to that effect.

D. 
The Borough of Woodbury Heights advertised in the Gloucester County Times, the official newspaper of the Borough of Woodbury Heights for the calendar year 1987, for the position of Municipal Clerk. This advertisement appeared in the official newspaper from February 27, 1987, through March 3, 1987.
E. 
Resumes were received by the Personnel Director and reviewed in committee.
F. 
It appears from the review of the resumes received by the Personnel Director and reviewed by his committee that the applicant most suited for the position of Municipal Clerk for the Borough of Woodbury Heights is a nonresident. It is therefore recommended that this Article be created to enable the appointment to be made of a nonresident of the Borough of Woodbury Heights.
