Statewide Basic Requirements established by the New Jersey Department of Environmental Protection with regard to Municipal Stormwater Regulation Programs require that municipalities adopt certain Ordinances respecting pet waste, litter, improper waste disposal, wildlife feeding, yard waste and illicit connections; and The Borough deems it in the public interest and safety that pets be prohibited from entry upon or within public property owned, leased or maintained by the Borough; It is the intent of the Mayor and Council to amend the Borough Code to establish requirements for the proper disposal of pets solid waste in the Borough of Woodbury Heights, as set forth in guidelines provided by the New Jersey Department of Environmental Protection so as to protect the public health, safety and welfare and to prescribe penalties for violations thereof.
For the purpose of this Article, the following terms, phrases, words and their derivations shall have the meanings stated herein unless their use in the text of this Article clearly demonstrates a different meaning. When not inconsistent with the context, words used in the present tense include the future tense, words used in the plural number include the singular number and words used in the singular number include the plural number. The word "shall" is always mandatory and not merely directory.
IMMEDIATE
The pet solid waste is removed at once, without delay.
OWNER/KEEPER
Any person who possesses, maintains, houses or harbors any pet or otherwise has custody of any pet, whether or not as the owner of such pet.
PERSON
Any individual, corporation, company, partnership, firm, association, or political subdivision of this state subject to municipal jurisdiction.
PET
A domesticated animal (other than a disability assistance animal) kept for amusement, companionship or any other lawful purpose.
PET SOLID WASTE
Waste matter expelled from the bowels of the pet; excrement.
PROPER DISPOSAL
Placement in a designated waste receptacle, or other suitable container, and discarded in a refuse container which is regularly emptied by the municipality or some other refuse collector; or disposal into a system designed to convey domestic sewage for proper treatment and disposal.
PUBLIC PROPERTY
Any park, recreation area or any other property owned or leased by the Borough of Woodbury Heights including, but not limited to, all public easements and rights-of-way.
All pet owners and keepers are required to immediately and properly dispose of their pet's solid waste deposited on any public property.
Any owner or keeper who requires the use of a disability assistance animal shall be exempt from the provisions of this chapter while such animal is being used for that purpose.
No owner or keeper shall permit, bring or cause entry of any pet onto or within any public park or recreation area owned or leased by the borough of Woodbury Heights.
The provisions of this Article shall be enforced by the Police Department or the Woodbury Heights Board of Health.
Any person, firm or corporation violating or failing to comply with any of the provisions of this Article shall, upon conviction thereof, be subject to a fine of not more than $500 or imprisonment for a term not to exceed 90 days or both. Each day or instance of any violation committed shall constitute a separate offense and shall be punishable as such.
