A public golf course shall be established in the Township to
be known as SCOTCH HILLS COUNTRY CLUB on lands shown on the 1964-Tax
Map as Block 173, Lot No. 1 and consisting of 28.95 acres.
The Board of recreation Commissioners shall have general supervision
and control over the maintenance, operation and regulation of such
public golf course and all forms of recreation, playground and public
entertainment activities carried on in connection therewith.
Personnel, equipment and all other resources of the recreation
commission and the golf course may be used interchangeably.
The Township council shall annually appropriate such sums of
money which shall be raised by taxation to develop, maintain and operate
the public golf course and all forms of recreation, playground and
public entertaining activities carried on in connection therewith.

Fees, rents, other charges, and the number of nonresident memberships
will be established from time to time by ordinance of the Township
Council. This subsection approves a range of rates to be set from
year to year by the recreation commission. The range in fees is as
follows:
a. Early registration and regular registration: At the discretion of
the recreation commission, an early and regular registration may be
implemented and ratified by the Township Council. The time period
from January 1st—March 15th shall be considered early registration
as set forth by the commission. Those individuals registering early
may receive a financial discount.
Those registering after March 15th, or after any other deadline
set by the commission, will be charged the regular rate. The range
of rates as set forth by the Township Council is as follows:

5. Scotch Hills Clubhouse. Residents will have priority booking privileges
for the first three months of the year. After the third month, the
facility will be able to be booked by nonresidents. Social functions
must terminate at the time fixed by the recreation commission by regulation
adopted by the commission. Special police may be hired at the discretion
of the recreation commission.

6. Park Picnic Rentals. The Scotch Plains Recreation Commission welcomes
all residents to utilize the Township's many parks for their personal
enjoyment. Scotch Plains parks are open to residents daily from 8:00
a.m. to dusk. Our parks are available for rental to individuals and
organizations for private parties or picnics. Picnics are defined
as formal gatherings of family and/or friends for the purpose of holding
an event, such as a birthday party, family reunion, or similar type
gathering. In these instances, the recreation department will issue
an exclusive rights permit to the responsible adult holding the event.
Such permits provide the permit holder with exclusive rights to the
area agreed upon in the permit. Fees for these permits are below.

7. Field Rentals.

(a)
The Scotch Plains Recreation Department supports many organizations
needs for athletic fields. Field permits issued by the recreation
department afford the permit holder exclusive use of facilities at
the time and place noted. Field allocations are provided primarily
through the allied associations. The field needs of the allied associations
are our first priority. Upon satisfying the needs of the allied associations,
Scotch Plains athletic fields are available for rental to associations
and individuals for their respective athletic endeavors. Field rental
fees are described below.
(b)
Permit issuance and exemption. All permits and special permission
for exemptions from any rules and regulations as set forth herein
shall be issued by the Director. All permits and special permissions
shall be either printed or written and be signed by the Director.
The field needs of the allied associations are given priority field
access and scheduling. Upon satisfying the needs of those associations,
Township fields are available for rental to individuals and organizations
for their respective endeavors.

Application. A person seeking issuance of a permit hereunder
shall file an application with the Recreation Department. The application
shall state:
(i) The name and address of the applicant;
(ii) The name and address of the person, persons, corporation
or association sponsoring the activity, if any;
(iii) The day and hours for which the permit is desired;
(iv) The Township property or portion thereof for which
such permit is desired;
(v) An estimate of the anticipated attendance;
(vi) Any other information which the Director shall
find reasonably necessary to give a fair determination as to whether
a permit should issue hereunder.
(2)
Standards for issuance. The Director shall issue a permit hereunder
when he/she finds:
(i) That the proposed activity or use of the Township
property will not unreasonably interfere with or detract from the
general public enjoyment of the Township property;
(ii) That the proposed activity or use will not unreasonably
interfere with or detract from the promotion of public health, welfare,
safety and recreation;
(iii) That the proposed activity or use is not reasonably
anticipated to incite violence, crime or disorderly conduct;
(iv) That the proposed activity will not entail unusual,
extraordinary or burdensome expense or police operation by the Township;
(v) That the facilities desired have not been reserved
for other use at the day and hour required in the application.
(3)
Field rental fees. Applicants are required to pay the below
fees set forth before the issuance of any permits. Failure to do so
will result in revocation of requested permit.

Appeal. Within five days after receipt of an application the Director shall apprise an applicant in writing of his reasons for refusing a permit. Any person aggrieved by the refusal of a permit by the Director of the Department of Parks and Recreation shall have the right to appeal in writing within five days to the Municipal Manager who shall consider the application under the standards set forth in Subsection
a7(b)(2) hereof and sustain or overrule the Director's decision within 10 days. The decision of the Municipal Manager shall be final.
(5)
Effect of permit. A permittee shall be bound by all Township
rules and regulations and all applicable ordinances fully as though
the same were inserted in said permits.
(6)
Liability of permittee. The person or persons to whom a permit
is issued shall be liable for any loss, damage or injury sustained
by any person whatever by reason of the negligence of the person or
persons to whom such permit shall have been issued. The Township of
Scotch Plains shall not be liable in such instances.
(7)
Revocation. The Director shall have the authority to revoke
a permit upon a finding of violation of any rule or ordinance, or
upon good cause known.
(8)
Violations. Groups or individuals who are found to be utilizing
Township fields, parks or facilities in an organized manner while
not having obtained an official field use permit shall be subject
the following:
(i) Violation 1: Written warning.
(iii) Violation 3+: $350 fine per offense.

10. Programs and Activities. Scotch Plains Recreation offers a variety
of programs and activities. For residents of Scotch Plains and Fanwood,
registration fees to be charged for such programs and activities shall
be in the range of $0 to $700. For nonresidents of Scotch Plains and
Fanwood, a fee will be added to the regular registration fee as outlined
below.

11. Advertising Fees. Scotch Plains Recreation welcomes local organizations
to advertise in a limited capacity. All advertising, including type
and location, must be approved by the Scotch Plains Recreation Department
before being placed. Fees for advertising on Scotch Plains recreation
facilities are outlined below.

a. For purposes of determining eligibility, all taxpaying property owners,
any person either having a residence or a residence under contract
or an apartment under lease to be occupied in the current year, or
any person not living in Scotch Plains but owning a business building
or a residential dwelling, shall be considered to be a resident. Misrepresentation
by any applicant in seeking to secure a participation privilege will
result in loss of moneys tendered in payment of the participation
privilege and termination of all rights as a participation privilege
holder.
b. Playing conditions and privileges are subject to change, as authorized
by the Board of recreation Commissioners.
The rules and regulations for the supervision, regulation and
control of the public golf course for the protection of property are
as follows:
a. Membership.
1. Each privilege holder shall receive a participation card with his
name and number. Card must be presented each time a privilege holder
registers to play. Participation cards are not transferable.
2. No persons other than members who shall have registered on blanks
furnished by the Board of recreation Commissioners and presented participation
cards, police, employees or other representatives of the Board of
recreation Commissioners in performance of their duties, shall enter
upon the Scotch Hills Country Club and Golf Course.
3. No person shall damage any part of the golf links or any other property
or equipment of any description thereon. Failure to replace divots
shall be considered a violation of this section.
4. Persons using the golf links shall obey the directions of all representatives
of the Board of recreation Commissioners on said links while in the
performance of their duties.
b. Rules of play.
1. U.S. Golf Association rules govern the play, with the exception of
the local rules found on the score cards.
c. Starting regulations.
1. The course will be open for play, season and weather permitting,
as scheduled by the recreation commission.
d. Conduct on the course.
1. Players shall refrain from using profanity and abusive language on
the golf course or in the clubhouse.
2. Swinging of clubs on the lawn, walks or tees while waiting to play
is a dangerous practice and is prohibited.
3. Only players of the match teeing off shall be permitted on the starting
tee.
4. Spectators will not be permitted to accompany players, except for
special tournaments or exhibitions as designated by the management.
The Board of recreation Commissioners will form a committee
made up of privilege holders, to estab1lish handicaps and recommendations
on greens, promote and organize tournaments, and increase the pleasures
to be enjoyed at the golf course.
Any person violating any rules shall, upon conviction, be liable to the penalty established in Chapter
3, section
3-1.
This chapter is adopted pursuant to R.S. 40:61-22.9 to 22.14
and amendments and supplements thereto.
No person shall maintain, conduct or operate, engage in or carry
on the business of maintaining, conducting or operating any miniature,
obstacle or Tom Thumb course, or place on which miniature, obstacle
or Tom Thumb golf shall be played, for gain, hire or otherwise, in
the Township without a license.
A license fee of $75 shall be paid for each such license, upon
the issuance thereof, and such license, when granted, shall expire
on September 1 next following the date when the license was issued.
Such license may be issued by the Township Clerk, upon the payment
to him of such license fee, but only after special resolution of the
Township council granting the same, upon written application by the
person asking therefor, setting forth the location and description
of the premises upon which the business is to be conducted, and the
full name and address of each person or corporation interested therein,
as owner of the golf course to be licensed; and no license shall be
issued or good to any person other than the actual proprietor of the
premises and business licensed, but in case of sale or transfer of
the business, such license may also be transferred, upon consent thereto
by the Township council, upon the payment of a transfer fee of $5.
Any license granted hereunder may be revoked by the Township
council, or the municipal judge, upon proof that the golf course so
licensed is frequented by boisterous or disorderly persons, or that
any gambling, gaming, disorderly conduct or other improper practices
are permitted or carried on therein.
Any person violating any of the provisions of this section shall upon conviction, be liable to the penalty established in Chapter
3, section
3-1.
The parks and playgrounds are formally open daily to the public
from 8:00 a.m. until dusk. For lighted recreational facilities, all
lights shall be turned off no later than 10:00 p.m. Under no circumstances,
shall any person be present in a park, playground or recreational
facility during the hours that the park, playground and recreational
facility are closed to the public.
