Whenever any words and phrases are used in this chapter, the
meaning respectively ascribed to them in Subtitle 1 of Title 39 of
the Revised Statutes of New Jersey shall be deemed to apply to such
words and phrases used herein.

Whenever certain hours are named in this chapter, they shall
mean either Eastern Standard Time or Eastern Daylight Savings Time
as may be in current use in the Borough.

The provisions of this chapter imposing a time limit on parking
shall not relieve any person of the duty to observe other more restrictive
provisions prohibiting or limiting the stopping, standing or parking
of vehicles as set forth in N.J.S.A. 3:4-138, any other New Jersey
Statute or as hereinafter provided.

a. Upon the declaration of an emergency, there shall be no parking upon
streets or sections of streets where temporary EMERGENCY - NO PARKING
signs are displayed. The Chief of Police or, in his absence, the ranking
Police Officer is authorized to declare an emergency and to direct
the posting of EMERGENCY - NO PARKING signs when weather conditions,
accidents, fires and public celebration dictate or require the avoidance
of hazards or other conditions which interfere with the free flow
of traffic. Notification that the EMERGENCY - NO PARKING signs are
being or will be posted shall be given to the operator or owner of
any vehicle which has been parked prior to the posting of the signs.
b. Any unoccupied vehicle parked or standing in violation of this section
shall be deemed a nuisance and a menace to the safe and proper regulation
of traffic and any Police Officer may provide for the removal of such
vehicle. The owner shall pay the reasonable costs of removal and storage
which may result from such removal before regaining possession of
the vehicle.
c. The effectiveness of this subsection is contingent upon the signs
being erected as required by law.

No person shall park a vehicle at any time upon any of the streets or parts thereof described in Schedule I which can be found in Chapter
7A.

No person shall park a vehicle between the hours specified in Schedule II on any day upon any of the streets or parts of streets described in Schedule II which can be found in Chapter
7A.

No person shall stop or stand a vehicle between the hours specified in Schedule III on any day upon any of the streets or parts of streets described in Schedule III which can be found in Chapter
7A.

No person shall park a vehicle for longer than the time limit shown in Schedule IV at any time between the hours listed in Schedule IV on any day (except Sundays and public holidays) upon any streets or parts of streets described in Schedule IV which can be found in Chapter
7A

No person shall park any commercial vehicle, motor drawn vehicle,
bus or omnibus having a rated maximum gross vehicle weight (GVW) in
excess of 10,000 pounds at any time upon any of the streets within
the Borough with the exception of vehicles engaged in construction
at an active construction site and vehicles making pickups or deliveries
at locations within the Borough. Vehicles engaged in construction
at an active construction site that cannot be stored or parked on-site
overnight are prohibited from being parked overnight on Borough streets
unless permission for same is obtained in writing from the Chief of
Police.

No person shall park a vehicle at any time upon any of the streets or parts thereof described in Schedule XX, which can be found in Chapter
7A, without a parking permit issued by the Chief of Police of the Borough of Spring Lake Heights.

a. Whenever snow has fallen and the accumulation is such that it covers
the street or highway, an emergency shall exist and no vehicles shall
be parked on the streets or highways referenced below, or portions
thereof indicated.
The above parking prohibitions shall remain in effect after
the snow has ceased, until the streets have been plowed sufficiently,
and to the extent that parking will not interfere with the normal
flow of traffic.
b. Any unoccupied vehicle parked or standing in violation of this section
shall be deemed a nuisance and a menace to the safe and proper regulation
of traffic and any Police Officer may provide for the removal of such
vehicle. The owner shall pay the reasonable costs of the removal and
storage which may result from such removal before regaining possession
of the vehicle.

All vehicles over four tons registered gross weight are hereby excluded from the streets or parts of streets described in Schedule V except for the pickup and delivery of materials on such streets, Schedule V which can be found in Chapter
7A.

7A are hereby designated as one-way streets in the direction indicated.

Pursuant to the provisions of N.J.S.A. 39:4-140, the streets or parts of streets described in Schedule VII which can be found in Chapter
7A are hereby designated as Through Streets. STOP signs shall be installed on the near right side of each street intersecting the Through Street except where YIELD signs having sides 36 inches in length are provided for in the designations.

7A are hereby designated as Stop Intersections. STOP signs shall be installed as provided therein.

Mid-Block Crosswalks are hereby established and shall be maintained upon the following described streets or parts of streets in the dimensions and at the locations designated in Schedule XXI which can be found in Chapter

No person shall park in the area situated on the premises described in Schedule XVIII which can be found in Chapter
7A, unless they have been issued special vehicle identification cards by the New Jersey Motor Vehicle Commission, when using a motor vehicle for which a special vehicle identification card has been issued by the Commission.

Unless another penalty is expressly provided by N.J.S.A. 39:4-203,
every person convicted of a violation of a provision of this chapter
or any supplement thereto shall be liable to a penalty of not more
than $50 or imprisonment for a term not exceeding 15 days or both.
All former traffic regulations of the Borough of Spring Lake
Heights covered in this Traffic Chapter are hereby repealed except
that this repeal shall not affect or prevent the prosecution or punishment
of any person for any act done or committed in violation of any regulation
hereby repealed prior to the taking effect of this chapter.

In accordance with the provisions of N.J.S.A. 39:4-197, the
following Municipal property shall have the movement of traffic controlled
by the type of regulation indicated. No person shall operate or park
a vehicle in violation of the regulations indicated.
a. General Regulations.
1. General Parking.
(a)
All vehicles must park in designated areas and between the lines
provided.
2. Overnight Parking; Parking Prohibited During Certain Hours.
(a)
No person shall park a vehicle between the hours of 12:00 a.m.
and 6:00 a.m. on any municipal or public property including but not
limited to the parking areas at the Community Center, Ocean Road Park,
and Allaire Road Park.
(b)
In the event that a vehicle becomes disabled and cannot be immediately
removed to comply with the provisions of paragraph (a) above, the
owner shall contact the Spring Lake Heights Police Department of placement
of the vehicle on Borough owned property and provide the make, model,
year and license plate number of such vehicle. Notification to the
Police Department shall be required at the time the vehicle is placed
on Borough property. Disabled vehicles shall be removed within 24
hours.
(c)
Any vehicle parked in violation of this subsection shall be
deemed a nuisance and any Police Officer may provide for the removal
of such vehicle. The owner shall bear the reasonable costs of removal
and storage which may result from such removal before regaining possession
of the vehicle.
3. Tow-Away Zones. Any vehicle parked or standing so as to obstruct
or impede a normal flow of traffic, block entrances or exit ways,
loading zones, any grassy area pedestrian walkway, or which presents
a safety or traffic hazard may be removed by towing the vehicle at
the owner's or operator's expense.

a. Pursuant to the provisions of N.J.S.A. 39:5A-1, the entire parking
lot and ingress and egress roads owned by the Spring Lake Heights
Board of Education located in Block 54, Lot 1 are hereby made subject
to the Spring Lake Heights Police Department's enforcement of traffic
laws and regulations as per Title 39 and in that regard the following
regulations are adopted:
1. There shall be no parking in the Spring Lake Heights School parking
lot during normal school hours or during other school functions except
in designated spaces.
2. The speed limit for the Spring Lake Heights School parking lot and
both ingress and egress roads is hereby established at 10 miles per
hour.
3. Left hand turns from the Spring Lake Heights School parking lot onto
Brighton Avenue shall be prohibited from 8:00 a.m. to 4:00 p.m. during
school days.

Pursuant to N.J.S.A. 39:4-8, the locations described in Schedule XIX which can be found in Chapter
7A are hereby designated as In-Street Signed Pedestrian Crossings, and appropriate in-street flexible pedestrian signs shall be installed therein in accordance with the current draft "Guidelines for Yield to Pedestrian Signs (Supplemental Pedestrian Crossing Channeling Devices)" as promulgated by the New Jersey Department of Transportation.
In accordance with the provisions of N.J.S.A. 39:4-197.6, the
following on-street locations are designated as handicapped parking
spaces in front of private residences occupied by handicapped persons.
Such spaces are for use by persons who have been issued special identification
cards or plates or placards by the Motor Vehicle Commission, or a
temporary placard issued by the Chief of Police. No other person shall
be permitted in these spaces.
