Whenever any words and phrases are used in this chapter, the meanings respectively ascribed to them in Subtitle 1 of Title 39 of the Revised Statutes of New Jersey shall be deemed to apply to such words and phrases used herein.

Whenever certain hours are named in this chapter, they shall mean either Eastern standard time or Eastern daylight saving time as may be in current use in the Township.

The provisions of this chapter imposing a time limit on parking shall not relieve any person of the duty to observe other more restrictive provisions prohibiting or limiting the stopping, standing or parking of vehicles as set forth in N.J.S.A. 39:4-138 and any other New Jersey statute or as hereinafter provided.

a. 
Upon the declaration of an emergency, there shall be no parking upon streets or sections of streets where temporary EMERGENCY-NO PARKING signs are displayed. The Chief of Police, the ranking police officer or the Mayor or member of the Township Committee is authorized to declare an emergency and to direct the posting of EMERGENCY-NO PARKING signs when weather conditions, accidents, fires and public celebration, etc., dictate or require the avoidance of hazards or other conditions which interfere with the free flow of traffic. Notification the EMERGENCY-NO PARKING signs are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs.
b. 
Any unoccupied vehicle parked or standing in violation of this section shall be deemed a nuisance and a menace to the safe and proper regulation of traffic and any police officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of removal and storage which may result from such removal before regaining possession of the vehicle.
c. 
The effectiveness of this subsection is contingent upon the signs being erected as required by law.

No person shall park a vehicle at any time upon any of the streets or parts thereof described in Schedule I attached to and made a part of this chapter.

No person shall park a vehicle between the hours specified in Schedule II of any day upon any of the streets or parts of streets described in Schedule II attached to and made a part of this chapter.

No person shall stop or stand a vehicle between the hours specified in Schedule III of any day (except Sundays and public holidays) upon any of the streets or parts of streets described in Schedule III attached to and made a part of this chapter.

No person shall stop or stand a truck, tractor, trailer or semitrailer having a registered gross weight in excess of four tons at any time upon any of the streets or parts of streets described in Schedule IIIA.

No person shall park a vehicle for longer than the time limit shown in Schedule IV at any time between the hours listed in Schedule IV of any day (except Sundays and public holidays) upon any of the streets or parts of streets described in Schedule IV attached to and made a part of this chapter.

a. 
Parking on municipal property, including but not limited to the Municipal Parking Lot located at the Greenwich Township Municipal Building at 321 Greenwich Street, Stewartsville, New Jersey, 08886 shall be regulated by this subsection.
b. 
Definitions. The following definitions shall apply to this subsection:
FIRE EMERGENCY
Any response to a call for assistance for fire, rescue or other emergency as dispatched by police or county dispatcher. A fire emergency shall not include a drill or meeting. A fire emergency shall begin upon receipt of a call or dispatch for assistance and shall end within 1/2 hour of return to the Municipal Building.
MUNICIPAL OFFICIAL
The Mayor, the members of the Township Committee, the Township Clerk and any other person employed by the Township or department of the Township which is designated as a municipal official by sign or posting.
PARKING SPACE
That area demarcated by painted lines on the surface of the Municipal Parking Lot or other municipal property.
c. 
Areas reserved for municipal officials. It shall be unlawful for any person, other than a municipal official, to park a vehicle or place any obstruction at any time within any parking space within the Municipal Parking Lot reserved for use by such municipal official. Each parking space reserved for a municipal official shall be demarcated by a sign or other posting, indicating the position of the municipal official.
d. 
Parking in areas other than those reserved for municipal officials. It shall be unlawful for any person to park a vehicle or place any obstruction at any time upon the roadways of the Municipal Parking Lot and any other parking lot which is owned by Greenwich Township, except in designated areas, within spaces between the painted lines.
e. 
Extended parking. It shall be unlawful for any person to park any vehicle or to place an obstruction on any municipal property, including but not limited to the Municipal Parking Lot, for a period longer than 12 continuous hours, without authorization by the Township Committee or person designated by the Township Committee to grant such authorization. If the vehicle is parked on municipal property without authorization for a period of 12 or more continuous hours, the Township is authorized to tow and store the vehicle at the owner's expense, at the rate normally charged by the towing and storage service.
f. 
Exceptions. Members of the Stewartsville Fire Department while on duty at a fire emergency and Township employees who are conducting Township business or working in their capacity as a Township employee shall be exempt from the requirements of this subsection.
g. 
Penalties. The penalty for violation(s) of this subsection shall be as provided by § 7-13 of the General Ordinances of the Township of Greenwich.

a. 
No person shall park a vehicle in a parking area designated as handicapped parking unless said vehicle bears a placard displayed thereon or, in lieu thereof, license plates established for use by handicapped persons, pursuant to the provisions of N.J.S.A. 39:4-204 through 39:4-207. Such placard or license plates shall be such as have been issued by the Director of the Division of Motor Vehicles by the State of New Jersey or the national wheelchair symbol on an out-of-state vehicle, and such vehicle shall have a proper special privilege identification card and certificate issued by the proper authorities of said jurisdiction.
b. 
Any person violating the provisions of this subsection shall, upon conviction thereof, be punished by a fine of $100 for the first offense and, for subsequent offenses, a fine of at least $100 and a period of community service up to 90 days, or any combination thereof, plus court costs.

a. 
Prohibited areas. It shall be unlawful for any person to park or leave standing any vehicle or place any obstruction at any time within any area within public or private property designated by the owner thereof or by the Township of Greenwich by striping, lettering or by sign as a fire zone or fire lane within the Township of Greenwich.
b. 
Penalties. The penalty for violation of this subsection shall be as provided by § 7-13 of the General Ordinances of the Township of Greenwich.

a. 
Parking prohibited. No person shall park any vehicle or allow any vehicle to stand on any street or alley or any part of any street or alley within the Township of Greenwich at any time whenever snow has fallen and accumulation of snow is such that it covers the surface of the street and until the snow has stopped falling and the street or alley has been plowed from curb to curb. Any unoccupied vehicle parked or standing in violation shall be deemed a nuisance and a menace to the safe and proper regulation of traffic, and any police officer or code enforcement officer may provide for the removal of such vehicle.

b. 
In the event that a vehicle is not removed from the streets of the Township of Greenwich as provided in this section, the Township shall be empowered to tow said vehicle from the streets and impound said vehicle. The vehicle owner shall be responsible for all fees and charges incurred as a result of towing said vehicle.

c.

Trucks with a registered weight of four tons or more are hereby excluded from the streets or parts of streets described in Schedule V, except for the pickup and delivery of goods or materials or the use of services provided by commercial businesses.

The streets or parts of streets described in Schedule XVII attached to and made a part of this chapter shall have the speed limits designated in such schedule. Regulatory and warning signs shall be erected and maintained to effect the above designated speed limits as authorized by the Department of Transportation.

Any vehicle parked illegally in violation of any of the provisions of this chapter may be impounded by any police official charged with the enforcement of the motor vehicle laws, and the vehicle may be towed or transported to any place designated by the Township Committee. Any person desiring to redeem such impounded vehicle shall first pay the service, towing and storage charge therefor. Whenever such vehicle is impounded by the law enforcement officials and shall remain unclaimed by any person, persons, partnership, firm or corporation having the right to possession of such vehicle for a period of 30 days, the vehicle shall be sold under the direction of the Chief of Police at public auction to the highest bidder, after notice of such auction has been given for not less than one week, by one publication in a newspaper circulating in the Township of Greenwich, County of Warren and State of New Jersey.

a. 
Subtitle 1, Title 39 of the Revised Statutes of New Jersey shall be and are made applicable to the private parking areas, streets, driveways or other roadways within Block 26, Lots 2 and 33, otherwise known as "Greenwich Center Phases I and II;" and
b. 
The Police Department of the Township of Greenwich and all other law enforcement agencies be and the same are hereby empowered to enforce the provisions of Subtitle 1 of Title 39 of the Revised Statutes of New Jersey within and throughout the private parking areas, streets, driveways or other roadways within Block 26, Lots 2 and 33, otherwise known as "Greenwich Center Phases I and II."
Various traffic regulations are made applicable to the semi-public roads, streets, driveways and parking lots at Greenwich School, located in the Township of Greenwich, County of Warren.
The following regulations shall be enforceable at the Greenwich School located at 101 Wyndham Farm Boulevard, Stewartsville, Greenwich Township, New Jersey:

The purpose of this standard operating procedure is to create requirements for the repossession of vehicles on behalf of holders of liens on the vehicles.
As used in this section, the following terms shall have the meanings indicated:
NOTICE
A written notification identifying:
a. 
The make and the model of the vehicle to be repossessed.
b. 
The vehicle identification number to be repossessed.
c. 
Name of the vehicle owner/borrower from whom the vehicle will be recovered.
d. 
Address or location of the vehicle to be repossessed.
e. 
The approximate date and time of the repossession of the vehicle.
PRIVATE TOWING COMPANY
A company retained by a holder(s) of lien(s) on a vehicle for the recovery of a vehicle possessed by an owner/borrower.
a. 
Prior to any repossession activity, any private towing company operating within the Township of Greenwich must provide notice to the Greenwich Township Police Department. The private towing company shall also provide the Greenwich Township Police Department with proof of its right to repossess the vehicle.
b. 
If the private towing company is operating within the Township of Greenwich and does not provide notice to the Greenwich Township Police Department prior to any repossession activity, a CAD will be created that will contain the name of the private towing company as well as all pertinent information. The private towing company will receive a letter advising of this section, and a second violation of this section will result in a complaint being signed with a fine that will be determined by the Municipal Judge.
c. 
Any person and/or private towing company convicted of violating this section shall be subject to a fine of not less than $500 and not more than $1,000 or imprisonment for a period not exceeding 90 days, or both.

The Township Committee of the Township of Greenwich hereby finds and declares that problems of traffic control occur when traffic must be moved through or around road or street construction, maintenance operations and utility work, above or below ground, which requires blocking the roadway and obstructing the normal flow of traffic, and that such obstructions are or can become dangerous when not properly controlled. In order to better promote the public health, safety, peace and welfare, it is necessary to establish controls and regulations directed to the safe and expeditious movement of traffic through construction and maintenance zones and to provide safety for the work forces performing these operations.
The Township of Greenwich in the County of Warren does hereby adopt the current Manual on Uniform Traffic Control Devices, hereafter known as "MUTCD," except as hereby supplemented and amended as it controls and regulates whenever construction, maintenance operations or utility work obstructs the normal flow of traffic. Any person, contractor or utility who fails to comply with the provisions of MUTCD while performing such work is in violation of this section.
It shall be the responsibility of the person, contractor, or in the case of a public utility as required under the public utility agreement, wishing to conduct work on, under or above the roadway, to contact the Township of Greenwich Police Department to arrange a preconstruction meeting in order to submit plans for the safe movement of traffic during such period of construction of work. Any person, contractor or utility who fails to comply with this section prior to the start of such work or whose plans are not approved by the Township of Greenwich Police Department is in violation of this section.
The person, contractor or utility shall provide the Township of Greenwich Police Department with at least two emergency contact phone numbers to be called in case of emergency problems at the construction or maintenance site prior to the start of any work. If, for any reason, the emergency contacts cannot be reached or if the emergency contact person does not respond to a call from the Police Department to correct the hazardous condition, the Township may respond to correct such hazardous conditions. The reasonable fees for such emergency services by the Township shall be charged to the person, contractor or utility responsible for such conditions.
Township, state and county contractors shall be permitted to work on public roads between the hours of 7:00 a.m. and 7:00 p.m. on weekdays, and between the hours of 8:00 a.m. and 4:00 p.m. on Saturdays. No work shall be permitted outside these hours or at any time on Sunday unless it is deemed to be an emergency. Township, state and county contractors may be restricted to off-peak working hours (e.g., 8:00 a.m. to 3:00 p.m., or 8:00 p.m. to 5:00 a.m.) if it is determined by the Traffic Safety Officer of the Greenwich Police Department and/or his/her designee that the work will substantially delay traffic on those roads if performed during the peak-hour periods. For all other contractors, there shall be no construction, maintenance operations or utility work on any roadway in the Township before the hour of 8:00 a.m. or after 4:00 p.m. This time limit may be adjusted to permit work prior to 8:00 a.m. or after 4:00 p.m. by the Traffic Safety Officer of the Greenwich Police Department and/or his/her designee. If it is determined by the Traffic Safety Officer of the Greenwich Police Department and/or his/her designee that the construction or maintenance operations prior to 8:00 a.m. or after 4:00 p.m. would substantially delay traffic or cause a safety or health hazard, the work shall then be permitted only between 8:00 a.m. and 4:00 p.m.
Road closings and/or traffic detours shall not be permitted unless approved by the Township of Greenwich Police Department 10 days in advance of the start of work, unless in an emergency.
Traffic directors shall be posted at all construction or maintenance sites when determined by the Township of Greenwich Police Department that the same are necessary to provide for the safety and expeditious movement of traffic. It shall also be determined by the Township of Greenwich Police Department when the traffic director shall be a police officer or a flagman.
The Township of Greenwich Police Department, as well as the Department of Public Works Superintendent, shall have the authority to stop work, including the removal of equipment, vehicles, stored material within the street right-of-way, backfilling of open excavations and/or other related work, in order to abate any nuisance and/or safety hazard or any violations of this section.
a. 
Any person, firm or corporation violating the provisions of this section shall, upon conviction thereof, be subject to one or more of the following: a fine of not more than $1,250, imprisonment for not more than 90 days, or a period of community service not exceeding 90 days, in the discretion of the Judge of the Municipal Court.
b. 
A separate offense shall be deemed committed on each day during or on which a violation occurs or continues.

The purpose of this chapter is to prohibit motorized vehicle traffic on Township property to prevent disturbance and endangerment to the community and its residents and to establish penalties for violations thereof.
As used in this section, the following terms shall have the meanings indicated:
MOTORIZED VEHICLE
Any vehicle with two or more wheels or tracks that is capable of being operated on or off of regularly improved and maintained roads, including, but not limited to, motorcycles, all-terrain vehicles, mopeds, and dirt bikes.
Any person who operates any vehicle on Township property in violation of this chapter shall be subject to:
a. 
For a first offense, a fine of not less than $250 nor more than $500.
b. 
For a second offense, a fine of not less than $500 nor more than $1,000.
c. 
For a third or subsequent offense, a fine of not less than $1,000.

As used in this section, the following terms shall have the meaning indicated:
ENGINE BRAKING
The use or operation of any mechanical exhaust device designed to aid in the braking, decompression or deceleration of any motor vehicle which results in excessive, loud, unusual, explosive noise from such vehicle.
a. 
It shall be unlawful for the operator of any motor vehicle to use or operate or cause to be used or operated, at any time on any road within the Township, any mechanical exhaust or decompression system which results in the practice of engine braking.
a. 
The specific prohibition set forth in § 7-15 shall not apply to engine braking where necessary for the protection of persons and/or property which cannot reasonably be avoided by the application of an alternative braking system.
a. 
The Township is authorized to post signs at reasonable locations within the Township indicating the prohibition of engine braking unless specifically informed not to do so on county or state roadways.

Unless another penalty is expressly provided by New Jersey statute or this chapter, every person convicted of a violation of a provision of this chapter or any supplement thereto shall be liable for a fine of not more than $2,000 or imprisonment for a term not to exceed 90 days or a period of community service not exceeding 90 days, or all three.

All former traffic ordinances of the Township covered in this traffic chapter are hereby repealed except that this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this chapter.
