No person shall engage in the business of collecting, hauling, transporting or disposing of household or commercial waste, garbage, trash, refuse or other rubbish in the Township of Greenwich without first obtaining a license therefor and otherwise complying with the terms of this section.

Application for such license shall be made annually in writing to the Township Clerk by the person desiring to engage in such business and shall contain the name and address of the applicant, description of each vehicle to be used by licensee, name and address of all persons who will operate each such vehicle.

A license fee for each year, or part thereof, of $10.00 for each vehicle shall be paid to the Township Clerk with each application, which fees shall be paid over to the Township Treasurer, provided the Township Committee may by resolution change the amount of such annual license fee.

A "Collection License" shall be issued to each qualified applicant by the Township Clerk upon payment of the required fee and the applicant shall also receive a copy of said license for each vehicle engaged in such business. All licenses shall expire on December 31 of the year for which they are issued and a copy of the license shall be kept at all times in each vehicle engaged in said business while operating in the Township and shall be exhibited upon request to any member of the Township Committee, the issuing officer, any police officer, health officer or other authorized Township Official.

Licenses issued hereunder shall not be transferable to a new applicant and shall be valid only for the vehicles listed in the application when operated by the applicant or the person or persons named in the application, provided the applicant may without additional fee have the license voided by the Township Clerk for any vehicle or operator, and validated for use with a substituted vehicle or operator.

No vehicle shall be used by any licensee unless the same is capable of being closed or covered to prevent refuse from falling or being blown from said vehicle. All vehicles shall be kept closed or covered when in use and shall be regularly washed and cleaned and kept free of dirt and offensive odors.

It shall be unlawful for any person, whether engaging in business or acting for his own use to transport on any public street in the Township of Greenwich any waste, trash, refuse or other rubbish in any open cart or vehicle without adequate covering and to prevent the contents from falling or being blown from the conveyance, or to thus transport any garbage except in containers with fly-tight lids or covers. Any vehicle so used shall be subject to inspection at all times by any of the officers designated in subsection 10-1.4 hereof.

Whenever complaint shall be made to the Township Committee alleging a violation of any of the terms of this section by a licensee, or a designated operator of a licensee, the Township Committee may require said licensee to show cause why such license shall not be revoked after public hearing on five days' written notice to the licensee served personally or by certified mail. The Township Committee may initiate such proceedings on its own motion without prior complaint. After such hearing, if the Township Committee shall find that any of the terms of this section have been violated by the licensee, or a designated operator of the licensee, then the license may be revoked. Whenever a license has been revoked, as provided herein, such license shall not be renewed during a period of 12 months next following the date of such revocation, and thereafter said license shall not be renewed in the name of the licensee, and no new license shall be issued to any other person using the same equipment without prior approval of the Township Committee.

It shall be unlawful for any person, other than a resident of the Township of Greenwich, or a licensee or designated operator of a licensee, to have or transport any waste, garbage, trash, refuse or other rubbish on any public street in the Township of Greenwich.

It shall be unlawful for any person to deposit or dispose of any waste, garbage, trash, refuse or other rubbish at any place or location in the Township except on the public dump or sanitary landfill operated or maintained by the Township of Greenwich, or by said Township jointly with any other municipality. Such public dump or sanitary landfill is operated and maintained by the Township of Greenwich only for the use of the residents of the Township of Greenwich and residents of any other municipality which may jointly operate and maintain the same, and it shall be unlawful for any person to deposit there any such waste collected elsewhere.

In the event the Township of Greenwich shall operate or maintain a public dump or sanitary landfill jointly with any other municipality, which municipality has by ordinance provided for the licensing of persons engaged in the business of collecting trash and other refuse within said municipality, then all licenses granted by said municipality for this purpose shall be recognized as valid and effective in the Township of Greenwich and any holder of such license shall be exempt from making an application and obtaining a "Collection License" under the terms of this section and shall also be exempt from payment of any license fee to the Township of Greenwich, provided any such exempt licensee shall be subject to all of the other terms and provisions of this section.

It shall be unlawful for any person to enter upon the public dump or sanitary landfill operated or maintained by the Township of Greenwich and engage in sorting, picking or removing any waste material of any kind.

The Township Committee may by resolution fix the hours for use of the public dump or sanitary landfill and adopt rules and regulations pertaining to the same, in accordance with the laws of the State of New Jersey. Such rules and regulations shall be posted at the site of the dump or sanitary landfill and thereafter any violation of the same shall constitute a violation of the section and be subject to the penalties therefor.

The Township Committee may by resolution, from time to time in its discretion, employ and fix the compensation of employees necessary to supervise the operation and maintenance of said dump or sanitary landfill and to enforce the rules and regulations affecting the same and otherwise enforcing the provisions of this section.

Any person who shall violate any of the provisions of this section, or any of the rules and regulations adopted and posted according to the terms hereof, or fails to comply with any order made hereunder, or who shall interfere with or hinder any public officer in the execution and fulfillment of his duties under this section, shall upon conviction be subject to the penalty stated in Chapter 1, Section 1-5, General Penalty.

In the event any part or subsection of this section shall be declared invalid by the decision of any Court, such decision shall not affect the remaining portions of this section which shall remain in full force and effect.

The licensing provisions of this section shall not be construed to apply to the business of cleaning cesspools commonly known as the scavenger business.

The annual fee for an amateur hobby kennel shall be the sum of $50.00.
