[Chapter 7, Traffic, was readopted in its entirety, consistent
with P.L. 2008, Chapter 110 by Ordinance No. 2322, adopted February 3, 2011.]

Whenever any words and phrases are used in this chapter, the
meaning respectively ascribed to them in Subtitle 1 of Title 39 of
the Revised Statutes of New Jersey shall be deemed to apply to such
words and phrases used herein.

Whenever certain hours are named in this chapter, they shall
mean either Eastern Standard Time or Eastern Daylight Savings Time
as may be in current use.

a.
The
Chief of Police or, in his/her absence, disability or inability to
act, the ranking member of the Police Department, is hereby authorized
to provide by regulation for the closing of any street or portion
thereof to motor vehicle traffic on any day or days during specified
hours on any day or days whenever he/she finds that such closing is
necessary for the preservation of the public safety, health or welfare.
b.
Any regulations promulgated by the Chief of Police and in accordance with Subsection a above, shall provide for the posting of proper warning signs of such closing on any street or portion thereof during the time the same is closed in pursuance thereof.
c.
Any
violation of this regulation promulgated thereunder shall be punished
by a fine not to exceed fifty ($50) dollars.
d.
Any
regulation adopted that mandates the closing of any street for a period
greater than forty-eight (48) consecutive hours shall not become effective
unless and until it has been submitted to and approved by the Commissioner
of the Department of Transportation.

Any vehicle parked in violation of this chapter shall be deemed
a nuisance and a menace to the safe and proper regulation of traffic,
and any Police Officer may provide for the removal of that vehicle.
The owner shall bear the reasonable costs of removal and storage which
may result from such removal before regaining possession of the vehicle.

Unless another penalty is expressly provided by New Jersey Statute
or in this chapter, every person convicted of a violation of a provision
of this chapter or any supplement thereto shall be liable to a penalty
of not more than fifty ($50) dollars or imprisonment for a term not
exceeding fifteen (15) days or both.

If any part or parts of this chapter are, for any reason, held
to be invalid, such decision shall not affect the validity of the
remaining portions of this chapter.

All former traffic ordinances of the Borough of Roselle Park
are hereby repealed, and all ordinances or parts of ordinances in
conflict with or inconsistent with the provisions of this chapter
are hereby repealed, except that this repeal shall not affect or prevent
the prosecution or punishment of any person for any act done or committed
in violation of any ordinance hereby repealed prior to the taking
effect of this chapter.

The Governing Body hereby finds and declares that problems of
traffic control occur and traffic must be moved through or around
street construction, maintenance operations, and utility work, above
and below ground which requires blocking the roadway and obstructing
the normal flow of traffic; and that such obstructions are or can
become dangerous when not properly controlled. In order to better
promote the public health, safety, peace and welfare, it is necessary
to establish controls and regulations directed to the safety and expeditious
movement of traffic through construction and maintenance zones and
to provide safety for the work force performing these operations.
The Borough of Roselle Park, in the County of Union, State of
New Jersey, does hereby adopt the current Manual on Uniform Traffic
Control Devices hereafter known as M.U.T.C.D., except as hereby supplemented
and amended, as it controls and regulates whenever construction maintenance
operations of utility work obstructs the normal flow of traffic. Any
person, contractor, or utility, who fails to comply with the provisions
of M.U.T.C.D. while performing such work is in violation of this section.

It shall be the responsibility of the person, contractor, or
in the case of a public utility as required under a public utility
agreement, wishing to conduct work on, under or above the roadway
to contact the Police Department in order to arrange a pre-construction
meeting in order to submit plans for the safe movement of traffic
during such period of construction work. Any person, contractor or
utility who fails to comply with this section prior to the start of
such work or whose plans are not approved by the Police Department
is in violation of this section.

The person, contractor, or utility shall provide the Police
Department with at least two (2) emergency contact phone numbers to
be called in case of emergency problems at the construction or maintenance
site prior to the start of any work. If for any reason emergency contact
cannot be reached, or if the emergency contact person does not respond
to the call from the Police Department to correct a hazardous condition,
the Borough may respond to correct such hazardous condition. The reasonable
fees for such emergency service by the Borough shall be charged to
the person, contractor, or utility for such condition.

There shall be no construction, maintenance operations, or utility
work on any roadway in the Borough before the hour of 9:00 a.m. or
after 4:00 p.m. This time limit may be adjusted to permit work prior
to 9:00 a.m. or after 4:00 p.m. by the Officer in charge of the Police
Department. If it is determined by the Officer in charge that the
construction or maintenance operations prior to 9:00 a.m. or after
4:00 p.m. would substantially delay traffic or cause a safety or health
hazard, the work shall then be permitted only between 9:00 a.m. and
4:00 p.m.

Road closing and/or traffic detours shall not be permitted unless
approved by the Police Department.

Traffic directors shall be posted at all construction or maintenance
sites when determined by the Police Department that same is necessary
to provide for the safety and expeditious movement of traffic.

The Police Department shall have the authority to stop work,
including the removal of equipment and vehicles, stored material within
the street right-of-way, back filling of open excavations and/or other
related work, in order to abate any nuisance and/or safety hazard
or for any violation of this section.

It is to be expressly understood that no materials, vehicle
or equipment are to be placed in the roadway or sidewalk until all
construction, signs, lights, devices and pavement markings are installed.

Any person, contractor or utility who commits a violation of
this section shall, upon conviction thereof for a first offense, pay
a fine of not less than one hundred ($100) dollars nor more than five
hundred ($500) dollars and/or be imprisoned in the county jail for
a term not exceeding ninety (90) days. For a second offense, the person,
contractor or utility shall, upon conviction thereof, pay a fine of
not less than two hundred and fifty ($250) dollars and/or be imprisoned
in the County Jail for a term not exceeding ninety (90) days.
A separate offense shall be deemed committed on each day during
or on which a violation occurs or continues.

The provisions of this chapter imposing a time limit on parking
shall not relieve any person of the duty to observe other more restrictive
provisions prohibiting or limiting the stopping or standing or parking
of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey
Statute or as hereinafter provided.
a.
Upon
the declaration of an emergency, there shall be no parking upon streets
or sections of streets where temporary EMERGENCY NO PARKING signs
are displayed. The Chief of Police or, in his/her absence, the ranking
Police Officer is authorized to declare an emergency and to direct
the posting of EMERGENCY NO PARKING signs when weather conditions,
accidents, road construction, fire or public celebrations dictate
or require avoidance of hazards or other conditions which interfere
with the free flow of traffic. Notification that EMERGENCY NO PARKING
signs are being or will be posted shall be given to the operator or
owner of any vehicle which has been parked prior to the posting of
the signs.
b.
The
effectiveness of this subsection is contingent upon the signs being
erected as required by law.
c.
Any

shall be deemed a nuisance and a menace to the safe and proper regulation
of traffic and any Police Officer may provide for the removal of such
vehicle. The owner shall pay the reasonable costs of the removal and

Whenever snow has fallen and the accumulation is such that it covers
the street or highway, an emergency shall exist and no vehicles shall
be parked on the following streets or highways or portions thereof
listed below.
The parking prohibitions listed below shall remain in effect
after the snow has ceased, until the streets have been plowed significantly,
and to the extent that parking will not interfere with the normal
flow of traffic.
b.
Any unoccupied vehicle parked or standing in violation of this section
shall be deemed a nuisance and a menace to the safe and proper regulation
of traffic and any Police Officer may provide for the removal of such
vehicle. The owner shall pay the reasonable costs of the removal and

Section 6 of Ordinance No. 1376 is hereby amended to add all streets
within the following described area:
BEGINNING at a point of intersection of the center line of East
Sumner Avenue and the easterly sideline of Walnut Street; thence southerly
along the easterly sideline of Walnut Street to the southerly sideline
of Grant Avenue; thence westerly along the southerly sideline of Grant
Avenue to the southerly sideline of Clay Avenue; thence westerly along
the southerly sideline of Clay Avenue to its intersection with the
westerly sideline of Laurel Avenue extended; thence northerly along
the westerly sideline of Laurel Avenue extended and Laurel Avenue
to the center line of Colfax Avenue and the Kenilworth-Roselle Park
boundary; thence easterly along the Kenilworth-Roselle Park boundary
following its various courses including the center line of Sumner
Avenue to a point in the Union-Roselle Park boundary; thence easterly
still along the center line of Sumner Avenue and Union-Roselle Park
boundary to the point of BEGINNING.
b.
The parking of any vehicle is prohibited whether with or without
a permit, in areas designated for street sweeping purposes and will
be subject to a tow during the following periods:
1.
North and east sides of streets — Wednesday— 9:00 a.m.
to 12 Noon.
2.
South and west sides of streets — Thursday — 9:00 a.m.
to 12 Noon.
3.
Except a portion of Roselle Avenue from Colfax Avenue northerly 400
feet on both the east and west side of the street wherein the no parking
restriction shall apply from 3:00 p.m. to 4:00 p.m., Monday through
Friday.
4.
Exclude West Grant Avenue, between West Clay Avenue and Locust Street.
d.
The following exceptions shall be made to paragraphs a and b above:
1.
The permit parking ordinance shall not apply in areas defined in § 7-14, Parking Prohibited at All Times on Certain Streets.
2.
The permit parking ordinance shall not apply in areas defined in
§ 9-11, No Stopping or Standing.
3.
Exclude the north side of West Clay Avenue from a point 20 feet west
of the intersection of the sideline of West Clay Avenue with westerly
sideline of Hawthorne Street to a point 1,100 feet therefrom.
4.
Exclude a portion of Chestnut Street between Grant Avenue and Clay
Avenue which shall revert back to permit parking, Monday through Friday,
between 8:00 a.m. and 9:00 a.m. on the east side, and between 10:00
a.m. and 11:00 a.m. on the west side of the street.
No person shall park a vehicle at the time or day indicated.

a.
Overnight Parking Prohibited. It shall be unlawful for the owner
or operator of an unoccupied truck (including without limitation vans
and pick-up trucks), truck tractor, trailer, semi-trailer, commuter
van, school buses included Type I and Type II buses, omnibus vehicles
(including taxis), used for commercial purposes, as defined by N.J.
Motor Vehicle and Traffic Regulations 39:1-1, or motorized homes (a
vehicle equipped with sleeping, kitchen, or bathroom facilities) to
park such unoccupied vehicles on any street in the Borough of Roselle
Park between the hours of 11:00 p.m. and 6:00 a.m. prevailing time.
It shall be unlawful for the owner or operator of an unoccupied
truck tractor, trailer or semi-trailer to park such vehicle on any
residential street at any time except for purposes of pickup, delivery,
providing a service or complying with interstate commerce regulations.
Any unoccupied vehicle or any unoccupied trailer or semi-trailer named in Subsection 7-16.1a parked or standing in violation of this subsection shall be deemed a nuisance and a menace to the safe and proper regulation of traffic; and any Borough of Roselle Park Police Officer may provide for the removal of such vehicle, trailer or semi-trailer. The owner shall pay the reasonable costs of the removal and storage which may result from such removal before regaining possession of the vehicle, trailer or semi-trailer.
b.
Restricted Parking; Parking Time Limited. A time limit of two (2)
hours shall apply to all unoccupied trucks over four (4) tons parked
on any Borough street between the hours of 6:00 a.m. and 10:00 p.m.
c.
Penalties. Vehicles parked in violation of this section shall be towed, at the owner's expense, in addition to penalties as set forth in § 7-4.
d.
In addition to Subsection b above, vehicles that weigh in excess of twelve thousand (12,000) pounds or measure twenty-two (22) feet or more in length, if parked unoccupied (as stated in 7-16.1) in the Borough in a residential zone between 10:00 p.m. and 6:00 a.m. must be either garaged, covered and/or not substantially visible to the general public from the front of the property. These vehicles may be parked and visible if permission has been granted to the owner of the equipment or vehicle if utilized for construction pursuant to a contract with the Borough. The vehicles, subject to this section, may not be parked in the front yard.

No person shall park a vehicle on streets or parts of streets
as described within the following sections unless an appropriate and
current parking permit as issued by the Borough of Roselle Park is
displayed on said vehicle for those streets or parts of streets as
described or listed within the following sections.

b.
Issuance of Permits.
1.
Issuing authority. The Borough Clerk shall issue permits for preferential
parking. Applicants for such permits shall be qualified by the requirement
that they present one proof of residency for dwelling units which
front or side in areas designated as preferential parking zones, together
with a copy of a valid vehicle registration bearing the name of the
applicant. The number of permits issued to a qualified applicant who
resides in a dwelling unit, or dwelling unit complex up to and including
four dwelling units shall only be limited to the number of vehicle
registrations provided by the qualified applicant. The number of permits
issued to a qualified applicant who resides in a larger dwelling unit
complex, with five or more dwelling units, shall be limited to one
permit per dwelling unit. Multiday and daily visitor passes may be
issued to qualified applicants, for the fee set forth below. Multiday
visitor passes shall be limited to one pass per dwelling unit. There
shall be no limit on the number of daily visitor passes issued to
qualified applicants.
2.
Fees. There will be no cost for the permit issued. The fee for multiday
visitor passes shall be $10 per pass. The fee for daily visitor passes
shall be $5 per pass.
3.
Duration of Permits. Permits issued pursuant to this subsection shall
remain effective for the term July 1 through June 30, or fraction
thereof, or as long as the applicant continues to reside in the qualified
dwelling unit for such permit, or until the preferential parking zone
for which such permit was issued is eliminated, whichever period of
time is less. Multiday visitor passes shall remain effective concurrently
with, and otherwise restricted in the same manner as the permits to
which an underlying dwelling unit is tied. Daily visitor passes shall
remain effective only for the calendar day for which it is applied.
Renewals for any permits shall be applied for and issued during the
month preceding the period for which a renewal is sought. Each renewal
shall be subject to the same conditions and restrictions as any new
application.
4.
Condition of Permits. Each permit issued shall be subject to all
the conditions and restrictions set forth in this chapter and of the
preferential parking zone for which it was issued, including conditions
or restrictions which may be altered or amended from time to time.
The issuance of such permit shall not be construed to be a permit
for or approval of any violation of any provisions of this Code or
any other law or regulation.
c.
Prohibitions.
1.
No vehicle shall be parked or stopped adjacent to any curb in a preferential
parking zone in violation of any posted or noticed prohibition or
restriction, unless such vehicle shall have permanently displayed
on or by the left lower corner of the rear window thereof a permit
indicating an exemption from such restrictions or prohibitions; or,
shall have a mulitday visitor pass hung from the rearview mirror at
the front of the vehicle; or shall have a daily visitor pass displayed
as a placard on interior of the windshield of the vehicle.
2.
It shall be unlawful for any person to sell, rent, transfer or lease,
or cause to be sold, rented, transferred or leased any preferential
parking permit or visitor pass. Upon conviction for a violation of
this subsection, all preferential permits issued to, or for the benefit
of, the dwelling unit for which the sold, rented, transferred or leased
permit was authorized shall be void and shall be returned to the Borough
Clerk's office.
3.
It shall be unlawful for any person to buy any preferential parking
permit or visitor pass except as otherwise provided for in this chapter.
d.
Penalty for Violation. The penalty for violation of this subsection
shall be a fine not exceeding one thousand ($1,000) dollars or imprisonment
for a period of ninety (90) days, or both, and revocation of the parking
permit privilege.[1]

Pursuant to the provisions of N.J.S.A. 39:4-197.6, the governing body may, by ordinance, designate restrictive parking zones for persons who have a mobility disability as defined in Subsection b of this subsection and who meet the other criteria set forth herein. These zones shall be established in front or near to the residence occupied by the handicapped person provided that such parking is not otherwise prohibited and does not interfere with the normal flow of traffic. A restrictive parking zone so designated shall be reserved for the exclusive use of the person and vehicle for whom such zone is established pursuant to this subsection. No other person shall be permitted to park in these zones.
The following on-street locations have been found to meet the
procedural and review requirements of the forgoing subsection and
are designated as handicapped parking spaces within the Borough of
Roselle Park pursuant to N.J.S.A. 39:4-197.6:

b.
Requirements, Generally. The general requirements for local consideration
and approval of a restricted parking zone for handicapped parking
pursuant to this subsection shall be as follows:
1.
The applicant shall be in possession of a valid windshield placard
or wheelchair symbol license plates issued by the New Jersey Motor
Vehicle Commission for a vehicle owned by the handicapped person,
or by another occupant of the residence who is a member of the immediate
family of the handicapped person.
2.
A "mobility disability" is defined as a condition wherein a person
has lost the use of one or more lower limbs as a consequence of paralysis,
amputation, or other permanent disability or who is permanently disabled
so as to be unable to ambulate without the aid of an assisting device
or whose ambulating is otherwise severely limited.
3.
Absent rare and truly extenuating circumstances as determined by
the Governing Body, at the recommendation of the Chief of Police,
or the their designee, no restrictive parking zone will be established
for a person who does not transport his or herself as permitted under
this subsection unless documentation is provided showing that the
nondisabled driver resides in the same household as the disabled person.
Documentation must be provided to the Chief of Police, or their designee,
detailing the extent of the disability. No restrictive parking zone
under this section will be established unless the applicant's disability
is such that it would preclude the disabled person from waiting on
the sidewalk until a nondisabled driver arrives with the car. A person
whose disability otherwise qualifies under this section and who is
under the age of 16 years will be presumed to be unable to wait alone
on the sidewalk.
4.
No restrictive parking zone may be established for any individual
who has a functional driveway, garage, carport, or any other type
of off-street parking within 100 feet of the perimeter of his or her
residence.
5.
In multifamily residences containing a driveway, carport or garage
not owned by the disabled driver, but owned by a family member, it
shall be presumed the disabled driver has access to such driveway,
carport or garage and said status shall preclude the disabled driver
from being granted a restrictive parking zone.
6.
Applicants must occupy their residence on a full-time basis.
7.
Only one restrictive parking zone will be granted per household.
Related parties living in separate units in a multifamily residence
are to be considered as being part of one household for the purpose
of this subsection.
8.
All restrictive parking zones shall be subject to annual reviews,
and shall remain in effect until an improvement in an individual's
physical condition rendering the restricted parking zone unnecessary,
the death of the individual, or the revocation of a restricted parking
zone for just cause as recommended to the Governing Body by the Chief
of Police, or their designee.
c.
Application Procedure. The application procedure for a restricted
parking zone for handicapped parking pursuant to this subsection shall
be as follows:
1.
All applicants shall file a completed application on a form furnished
by the Police Department and submitted to the Chief of Police, of
the Chief's designee, for review.
2.
The application shall be accompanied by a medical evaluation form
completed by a physician with a plenary license to practice medicine
and surgery and shall include a certification by the physician that
the applicant has a mobility disability as described in this subsection.
3.
The Police Chief, or the Chief's designee, shall verify the extent
of the disability of the applicant or resident of the applicant's
household by reviewing the physician's certification submitted with
the application and may request an independent evaluation that shall
be conducted by the Borough's physician at the Borough's cost.
4.
The Police Chief, or the Chief's designee, shall ascertain whether
all the credentials of the applicant and the location of the proposed
parking zone are consistent with applicable state statutes and Borough
codes.
5.
The Police Chief, or the Chief's designee, shall ascertain whether
or not the applicant or any member of the applicant's household, has
a functional driveway, garage, carport, or any other type of off-street
parking within 100 feet of the residence. If the applicant or member
of the applicant's household has such parking available, the application
shall be denied.
6.
Upon determining that the applicant meets all of the qualifications
set forth in this subsection, the Chief of Police shall recommend
to the Governing Body that the applicant be granted a restricted parking
zone. The Governing Body may, by ordinance, designate the location
of the restricted parking zone.
7.
By July 1 of each year, application must be made for renewal of each
restricted parking zone granted in accordance with this subsection.
Renewal shall be made via written application on a form to be mailed
to all individuals approved for a restricted parking zone by the Police
Department no later than May 1 of each year. The application for renewal
must be accompanied by a certification completed by the applicant's
personal physician that the mobility disability of the applicant,
or the qualifying household member, as previously outlined, still
exists to the extent that such a restricted parking zone continues
to be required. In addition, the applicant or qualifying household
member may be required to be evaluated by Borough's physician. The
Borough reserves the right to revoke, remove or rescind a restrictive
parking zone if it is determined that an applicant's condition has
improved to the extent that it renders the restricted parking zone
unnecessary, or upon death of the applicant or for other just cause
as recommended by the Chief of Police or their designee.
8.
Upon receipt of the application and physician certification for renewal
in every second year, a personal visit to the applicant's household
and parking site shall be made by the Chief of Police, or the Chief's
designee, to verify that the findings required by this subsection
still exist.
9.
The Chief of Police, or the Chief's designee, shall notify a new
applicant of the decision to recommend the approval of a restricted
parking zone pursuant to this subsection for action by the Governing
Body, or of a decision to deny the applicant, within 60 days of the
initial receipt of the completed application by the Department. Notification
of the renewal or denial of an existing zone shall be made by September
1 of each year. Any and all denials shall set forth the reasons for
the negative decision(s).
d.
Notification Requirements. All individuals approved for a restricted
parking zone shall notify the Police Department within 30 days of
any change in the individual's name, address, telephone number, vehicle
ownership, or of an improvement in the applicant's physical condition.
Failure to do so will be deemed a violation of this section and may
result in revocation of the zone. Members of the household or the
executor/executrix for individuals who have an approved zone who have
died shall be required to likewise notify Police Department within
30 days after the date of death. Failure to do so shall be considered
a violation of this subsection.
e.
Violations and Penalties. In addition to the violations outlined in Subsection d of this subsection, any deviations from this section or misuse of restricted parking zones shall be subject to enforcement actions and penalties whereas violators shall be liable for a penalty of not less than $100 nor more than $500 for a first offense and not less than $500 nor more than $1,000 or imprisonment for a term not exceeding 15 days, or both, for each subsequent offense.

In any space on public or private property appropriately marked
for vehicles for the physically handicapped pursuant to N.J.S.A. 39:4-197.5,
N.J.S.A. 52:27D-119 et seq., or any other applicable law unless the
vehicle is authorized by law to be parked therein and a handicapped
person is either the driver or a passenger in that vehicle. State,
county, or municipal law enforcement officers or parking enforcement
officers shall enforce the parking restrictions on spaces appropriately
marked for vehicles for the physically handicapped on both public
and private property.

The cost of procurement and installation of the signs and pavement markings shall be the responsibility of the owner of said property. The owner shall, subsequent to initial procurement and installation, maintain such signs and pavement markings in good condition at no cost or expense to the Borough of Roselle Park. In accordance with the provisions of N.J.S.A. 39:4-197, the
following Municipal property shall have the movement of traffic controlled
by the type of regulation indicated. No person shall operate, or park
a vehicle in violation of the regulations indicated.
No person shall park a vehicle at any time except in a designated
area and between the painted white lines and all vehicles shall be
properly identified.
a.
Parking Meters, Fees and Holidays.
1.
Upon parking a vehicle in a designated parking space, the operator
shall immediately deposit or cause to be deposited in the parking
meter or the parking lot computerized metering system the fee required
for the desired time for the space occupied by their vehicle.
2.
The fee for all parking meters (individual and computerized) on all
public streets and municipal parking lots shall be $0.25 for each
thirty-minute period of time.

(a)
Senior citizens with a senior citizen parking permit shall not
be required to pay any parking meter fees for parking in Municipal
Parking Lot Number 1 and Municipal Parking Lot Number 2.
(b)
Business owners within the B-2 Central Business Zone District
with a business parking permit shall not be required to pay any parking
meter fees for parking in Municipal Parking Lot Number 1.
3.
There shall be no parking meter fees charged on any public street
or municipal parking lot on Sundays or any of the following holidays:
b.
Parking During Snow Emergencies.
1.
Vehicles may be parked in any municipal parking lot, except for Municipal Parking Lot Number 4E and those directly adjacent to Roselle Park Fire Department buildings, during snow emergencies as defined in § 7-10. Any vehicle parked in any municipal parking lot shall be removed within 24 hours from the end of the snowfall. Parking meters shall remain in effect, as applicable, during snow emergencies unless otherwise suspended by emergency order.
c.
Municipal Parking Lot Number 1.
1.
The location of Municipal Parking Lot Number 1 shall be understood
as the off-street municipal parking area on the easterly side of Chestnut
Street (County Road 627) and bounded to the north by Charles Street
and to the south by Williams Street.
2.
The hours for parking meter enforcement in Municipal Parking Lot
Number 1 shall be between the hours of 8:00 a.m. and 6:00 p.m. Monday
through Saturday. There shall be no meter enforcement on Sundays or
holidays as established by this subsection.
3.
Overnight parking in Municipal Parking Lot Number 1 shall be permitted
for non-commercial vehicles between the hours of 6:00 p.m. and 8:00
a.m. without any parking meter fees. Commercial, omnibus, and livery
vehicles, inclusive of all trailers associated therewith, shall be
expressly prohibited from parking in Municipal Parking Lot Number
1 between the hours of 6:00 p.m. and 8:00 a.m.
4.
Preferential parking accommodations shall be established and exist
for the owners of businesses within the B-2 Central Business Zone
District, as defined and depicted on the municipal Zoning Map, in
Municipal Parking Lot Number 1. Regulations for these preferential
parking accommodations shall be as follows:

(a)
Eligibility. Owners of business establishments within the B-2
Central Business Zone District shall be eligible for preferential
parking accommodations in Municipal Parking Lot Number 1.
(b)
Permits. Preferential parking accommodations for business owners
in Municipal Parking Lot Number 1 shall be formalized through the
issuance of business parking permits by the Borough Clerk.
(1)
Eligible applicants for business parking permits shall be required
to present proof of business operations, such as a current utility
bill, within the B-2 Central Business Zone District within the Borough
of Roselle Park. The number of permits issued to a qualified applicant
shall be limited to one per business establishment. Permit renewals
shall be subject to the same conditions and restrictions as any new
application.
(2)
There shall be no fee(s) charged for the application or issuance
of business parking permits.
(3)
Initial business parking permits shall be issued for a term
extending through June 30, 2023. Thereafter, permits shall be issued
from July 1 through June 30 annually.
(c)
Prohibitions. It shall be unlawful for any person to sell, rent,
transfer or lease, or cause to be sold, rented, transferred or leased,
for any value or consideration or no value or consideration, any preferential
parking permit referenced in this paragraph. It shall be likewise
unlawful for any person to buy or otherwise acquire for value, or
otherwise use, any preferential parking permit except as provided
for in the Municipal Code. Upon conviction for a violation of the
foregoing all preferential permits issued to a business owner shall
be void and shall be returned to the Borough Clerk's office.
(d)
Penalty for Violation. The penalty for a violation of regulations
pertaining to business owner parking permits within this paragraph
shall be a fine not exceeding $1,000 or imprisonment for a period
of 90 days, or both, and revocation of the parking permit privilege.
5.
Preferential parking accommodations shall be established and exist
for senior citizens in Municipal Parking Lot Number 1. Regulations
for these preferential parking accommodations shall be as follows:

issued to a qualified applicant shall only be limited to the number
of vehicle registrations provided. Permit renewals shall be subject
to the same conditions and restrictions as any new application.
(2)
There shall be no fee(s) charged for the application or issuance
of senior citizen parking permits.
(3)
Permits shall be issued from July 1 through June 30 annually.
(c)
Prohibitions. It shall be unlawful for any person to sell, rent,
transfer or lease, or cause to be sold, rented, transferred or leased,
for any value or consideration or no value or consideration, any preferential
parking permit. It shall be likewise unlawful for any person to buy
or otherwise acquire for value, or otherwise use, any preferential
parking permit except as provided for in the Municipal Code. Upon
conviction for a violation of the foregoing, all preferential permits
issued to a senior citizen shall be void and shall be returned to

(d)

pertaining to senior citizen parking permits within this subsection
shall be a fine not exceeding $1,000 or imprisonment for a period
of 90 days, or both, and revocation of the parking permit privilege.
d.
Municipal Parking Lot Number 2.
1.
The location of Municipal Parking Lot Number 2 shall be understood
as the off-street municipal parking area nearest to the southeastern
corner of the intersection of Grant Avenue and Chestnut Street.
2.
The hours for parking meter enforcement in Municipal Parking Lot
Number 2 shall be between the hours of 8:00 a.m. and 6:00 p.m. Monday
through Saturday. There shall be no meter enforcement on Sundays or
holidays as established by this section.
3.
Overnight parking in Municipal Parking Lot Number 2 shall be permitted
for non-commercial vehicles between the hours of 6:00 p.m. and 8:00
a.m. without any parking meter costs. Commercial, omnibus, and livery
vehicles, inclusive of all trailers associated therewith, shall be
expressly prohibited from parking in Municipal Parking Lot Number
2 between the hours of 6:00 p.m. and 8:00 a.m.
4.
Preferential parking accommodations shall be established and exist
for senior citizens in Municipal Parking Lot Number 2. Regulations
for these preferential parking accommodations shall be as follows:
(a)

Permits. Preferential parking accommodations for senior citizens

the Borough of Roselle Park together with a copy of a valid vehicle

to the same conditions and restrictions as any new application.
(2)
There shall be no fee(s) charged for the application or issuance
of senior citizen parking permits.
(3)
Until July 31, 2021, senior citizen parking permits shall be
issued for a term extending from August 1 through July 31 annually.
Permits issued on August 1, 2021, shall be issued for a term extending
from August 1, 2021, through June 30, 2022. Thereafter, permits shall
be issued from July 1 through June 30 annually.
(c)
Prohibitions. It shall be unlawful for any person to sell, rent,
transfer or lease, or cause to be sold, rented, transferred or leased,
for any value or consideration or no value or consideration any preferential
parking permit. It shall be likewise unlawful for any person to buy
or otherwise acquire for value, or otherwise use any preferential
parking permit, except as provided for in the Municipal Code. Upon
conviction for a violation of the foregoing all preferential permits
issued to a senior citizen shall be void and shall be returned to
the Borough Clerk's office.
(d)
Penalty for Violation. The penalty for a violation of regulations
pertaining to senior citizen parking permits within this subsection
shall be a fine not exceeding $1,000 or imprisonment for a period
of 90 days, or both, and revocation of the parking permit privilege.
5.
Parking restrictions shall be established for the conduct of the
Roselle Park Farmers' Market in Municipal Parking Lot Number 2 as
follows:
(a)
"No Parking" Locations. The general public may not park in parking
spots 1 through 24 on Wednesdays from July 1 through October 31. This
restriction shall explicitly exclude Borough vehicles, Borough employees,
and vendors associated with the conduct of the Roselle Park Farmers'
Market.
(b)
Public Parking for Farmers' Market. With the exception of parking
spots 1 through 24, the general public may park their vehicles in
all other parking spots in Municipal Parking Lot Number 2 on Wednesdays
from July 1 through October 31 to visit the Roselle Park Farmers'
Market. Parking for reasons other than visiting the Roselle Park Farmers'
Market shall be prohibited on Wednesdays from July 1 through October
31.
(1)
Individuals with senior citizen parking permits shall be exempt
from certain restrictions of Subsection a5(b) above. Specifically,
other than parking spots 1 through 24, an individual with a senior
citizen parking permit may park in any spot for any reason on Wednesdays
from July 1 through October 31.
e.
Municipal Parking Lot Number 3.
1.
The location of Municipal Parking Lot Number 3 shall be understood
as the off-street municipal parking area on the southerly side West
Webster Avenue approximately 550 linear feet to 900 linear feet west
of Locust Street (County Road 619).
2.
Vehicles may not be parked in Municipal Parking Lot Number 3 for
more than eight hours; nor may vehicles be parked in Municipal Parking
Lot Number 3 between the hours of 11:00 p.m. and 5:00 a.m.
f.
Municipal Parking Lot Number 4E.
1.
The location of Municipal Parking Lot Number 4E shall be understood
as the off-street parking area adjacent to the eastern side of the
Municipal Complex located at 110 East Westfield Avenue (State Route
28).
2.
No person shall park any vehicle in Municipal Lot Number 4E unless
they are doing business with the Borough of Roselle Park, are an employee
of the Borough of Roselle Park, or are otherwise authorized by the
Borough of Roselle Park to park at that location. Likewise, no member
of the general public shall park any vehicle in an area designed specifically
for use by Borough employees.
3.
Overnight parking in Municipal Parking Lot Number 4E shall be prohibited
except for employees of the Borough of Roselle Park.
g.
Municipal Parking Lot Number 4W.
1.
The location of Municipal Parking Lot Number 4W shall be understood
as the off-street parking area adjacent to the western side of the
Municipal Complex located at 110 East Westfield Avenue (State Route
28).
2.
Except parking pursuant to Subsection b of this subsection, no person shall park any vehicle in Municipal Lot Number 4W unless they are doing business with the Borough of Roselle Park, are an employee of the Borough of Roselle Park, or are otherwise authorized by the Borough of Roselle Park to park at that location. Likewise, no member of the general public shall park any vehicle in an area designed specifically for use by Borough employees.
3.
Overnight parking in Municipal Parking Lot Number 4W shall be prohibited
except for employees of the Borough of Roselle Park.
h.
Municipal Parking Lot Number 5.
1.
The location of Municipal Parking Lot Number 5 shall be understood
as the designated off-street municipal property on the south side
of West Webster Avenue directly adjacent to the Roselle Park Department
of Public Works facility located at 180 West Webster Avenue in a westerly
direction.
2.
Parking shall be permitted in delineated parking spots of Municipal
Parking Lot Number 5 as follows:
(a)
By employees of the Borough of Roselle Park; and
(b)
By residents of the Borough of Roselle Park only during times of an emergency as defined by § 7-10 of the Municipal Code wherein snow has fallen and such accumulation covers the street. Residential parking in Municipal Lot Number 5 during any other time shall constitute a violation of this subsection.
i.
Municipal Parking Lot Number 6.
1.
The location of Municipal Parking Lot Number 6 shall be understood
as the off-street parking area behind and adjacent to the Roselle
Park Veterans Memorial Library located at 404 Chestnut Street (County
Road 627).
2.
No person shall park any vehicle in Municipal Lot Number 6 unless they are conducting library business or otherwise visiting the library except pursuant to Subsection b of this subsection. Likewise, no member of the general public shall park any vehicle in an area designed specifically for use by library employees.

the following private property that is open to the public and to which
the public is invited, the movement of traffic shall be controlled

signage and markings shall be in accordance with the current "Manual

By P.L. 2007, Chapter 348 (the "Act"), the Legislature of the
State of New Jersey has determined that the installation of a traffic
control signal monitoring system by municipalities complementing local
law enforcement could serve as an effective tool in encouraging drivers
to observe and obey traffic control devices at intersections, thereby
increasing traffic flow and pedestrian safety.
The Borough of Roselle Park is desirous of installing traffic
control signal monitoring systems at various intersections within
the Borough of Roselle Park.
The Borough has determined that adoption of this section is
in the best interests of the health, safety and welfare of the Borough
and its residents.

a.
The Borough of Roselle Park hereby determines to install and utilize
a traffic control signal monitoring system ("System") at various intersections
within the Borough of Roselle Park as approved by the Commissioner
of Transportation pursuant to the Act.
b.
The system to be installed shall be approved by the Governing Body
by resolution.
c.
The Borough shall have the authority to enter into a contract, following
a lawful procurement process, for the installation of the system.
Any contract that shall contain provisions contrary to the Act shall
not be deemed invalid but rather reformed to conform to the act.
d.
The signs notifying drivers that a system is being utilized shall
be approved by the Municipal Engineer, and shall be placed on each
street converging into the affected intersection as required by the
Act.
e.
The Municipal Engineer shall inspect and certify the system at least
once every six (6) months from the date of its installation.

The Police Department of the Borough of Roselle Park shall review
the recorded images produced by the system, to determine whether sufficient
evidence exists demonstrating that a traffic control signal violation
has occurred and shall issue a Summons when appropriate in accordance
with the rules of the Court.

a.
Except as otherwise provided in this section, the recorded images
produced by the system shall be available for the exclusive use of
the Police Department for the purpose of discharging his or her duties
under P.L. 2007, Ch. 384.
b.
Any recorded image or information produced in connection with the
system shall not be deemed a public record under N.J.S.A. 47:1A-1
et seq., or common law. The recorded images shall not be: (i) discoverable
as a public record by any person, entity, or governmental agency,
except upon a subpoena issued by a grand jury or a court order in
a criminal matter, or (ii) offered as evidence in any civil or administrative
proceeding not directly related to a traffic control signal violation.
c.
Any recorded image or information collected in connection with a
traffic control signal violation shall not be retained after sixty
(60) business days following the collection any fine or penalty.
d.
If a summons is not issued within forty (40) business days following
the traffic control signal violation, all recorded images and any
information collected with respect to the traffic control signal violation
shall be removed by the Police Department within two (2) business
days.
e.
The Borough of Roselle Park shall certify compliance of this section
by filing a report with the Commissioner of Transportation in accordance
with the Act.

The liability of the owner and operator of a motor vehicle for
a traffic control signal violation summons pursuant to the system
shall be joint subject to provisions of the Act.

Any person liable for a traffic control signal violation, pursuant
to the section and the Act, utilizing the System shall be subject

It shall be unlawful to obstruct any properly signed and posted
fire lane or fire zone on private property within the Borough of Roselle
Park.

As used in this section:
Shall mean as defined or referred to in Ordinance No. 1351.
Shall mean any road, driveway or parking area which is not
open to the general public for the purposes of vehicular traffic.
Quasi-public areas which are accessible to the public but not publicly
maintained, such as roadways, parking lots, driveways, etc. in connection
with restaurants, shopping areas, apartments, professional buildings,
etc., shall be included within the definition of "private property."

Unless another penalty is provided by statute, any person violating any provision of this section shall be subject to a fine of one hundred ($100) dollars or imprisonment for a term not exceeding fifteen (15) days, or both. Anything blocking a fire lane or fire zone as described in Subsection 7-42.1 shall be subject to also being towed or removed at the owner's expense.

The provisions of this section and violations listed herein shall be separate from and in addition to the provisions of any other part of the Borough Code, including but not limited to § 22-1 commonly known as the "Fire Prevention Code."

The Fire Department and/or the Police Department of the Borough
of Roselle Park shall be charged with the responsibility for enforcement
of the provisions of this section.

The purpose of this section is to supplement Chapter 7, "Traffic," and provide the creation of Combat Wounded/Purple Heart Parking for qualified military personnel.

a.
No person shall park a vehicle in a parking space/stall designated
and established for Combat Wounded/Purple Heart, unless they meet
the requirements of Paragraph c of this subsection. A Combat Wounded/Purple
Heart Parking space means an area of a public roadway or public parking
lot designated for use by any Combat Wounded/Purple Heart awarded
person as provided for and which is so marked by proper signage and
roadway marking.
b.
A combat wounded veteran is any person who served for any length
of time in any military service branch, who experienced any level
of hostility for any duration resulting from offensive, defensive,
or friendly fire military action involving a real or perceived enemy
in any foreign theater and suffers injury or disability from same.
A Purple Heart Medal Designee is any member of the United States Military
who has been awarded the Purple Heart Medal.
c.
No person shall park a vehicle in any of the designated parking spaces/stalls
for parking designated for use by Combat Wounded/Purple Heart Designees
in locations referred to in the Code of the Borough of Roselle Park,
unless such person is a Combat Wounded/Purple Heart Designee. Any
vehicle parked in a parking stall reserved for Combat Wounded/Purple
Heart drivers pursuant to this section, which does not display the
official State license plate, or special identification sticker or
placard from the Borough of Roselle Park, is presumed to have parked
in such a stall unlawfully, and subject to the fines and penalties
set forth in this section.
d.
Any person applying for the aforementioned decal shall present such
documents as required by the Borough Clerk to establish that the individual
is a Combat Wounded Veteran and/or has been awarded the Purple Heart.
In addition any applicant must have been honorably discharged from
the United States military. The Borough Clerk's Office shall have
up to seven (7) days to review and determine if the applicant qualifies
as a Combat Wounded Veteran/Purple Heart Designee.

Any person parking in the restricted parking space without a
special vehicle identification decal as indicated in Subsection 7-43.2c
shall be liable for a fine up to $250 for the first and subsequent
offense and up to ninety (90) days community service on such terms
and in such form the Roselle Park Municipal Court shall deem appropriate,
or any combination thereof.
The seven municipal parking spaces located in front of La Catena
shall be designated as business only parking between the hours of
10:00 a.m. and 10:00 p.m. everyday.
La Catena shall pay the Borough of Roselle Park an administrative
fee of $100 per year, per parking space, for each year that La Catena
remains in business, and this section remains in effect. Such payment
shall be made in full no later than January 31 of each calendar year.
Full payment for calendar year 2021 shall be made to the Borough by
La Catena no later than 30 calendar days after the effective date
of the foregoing Ordinance.

For the purposes of this Section, the following terms shall
have the meanings indicated:
Every type of motor-driven vehicle used for commercial purposes
on the highways, such as the transportation of goods, wares, and merchandise.
Shall mean work performed or to be performed upon any Commercial
Motor Vehicle or Motor Vehicle that requires monopolization of space
for maintenance operations including, but not limited to: to motors,
ignition systems, transmissions, drive or electrical systems, the
conduct of body or fender work, or the replacement of fluids or oils
for an extended time greater than one hour.
Shall mean work performed or to be performed upon any Commercial
Motor Vehicle or Motor Vehicle that requires monopolization of space
for maintenance operations including, but not limited to: to motors,
ignition systems, transmissions, drive or electrical systems, the
conduct of body or fender work, or the replacement of fluids or oils
for a time less than one hour.
Any vehicle which is self-propelled, including but not limited
to automobiles, trucks, motorcycles, motorized scooters, and motorized
bicycles.

The performance of any Heavy Repairs, as defined by this Section,
on public streets in the Borough of Roselle Park are prohibited. The
performance of Light Repairs shall be permitted. The performance of
Light Repairs on a roadway or highway within the Borough of Roselle
Park allowed by this section shall not conflict with N.J.S.A. 39:4-136.
The prohibition of Heavy Repairs on public streets shall not apply
during declared weather-related states of emergency, or as may otherwise
be determined by the Roselle Park Police Department, or any other
jurisdictional law enforcement agency, in the furtherance of public
health, safety, and welfare.

The routine washing or cleaning of any Commercial Vehicle or
Motor Vehicle upon any public street, shall be expressly permitted
by this Section and shall not constitute Heavy Repairs or Light Repairs.

It shall be the duty of the Police Department to enforce this
Section. An initial violation of this Section shall, upon conviction
thereof, be punishable by a fine not to exceed two-hundred fifty dollars
($250.00), or a period of community service not exceeding ninety (90)
days, or both. Violations of this Section issued subsequent to a first
offence shall, upon conviction thereof, be punishable by a fine not
to exceed five-hundred dollars ($500.00), or a period of community
service not exceeding ninety (90) days, or both.
