As defined herein, a "person with disabilities" or "citizen
with disabilities" shall mean a resident of the Township who has a
disability as such would be defined in the Americans with Disabilities
Act, or as defined in any state or federal law dealing with the subject
of disability. At all times, the definition of a person or citizen
with a disability shall be interpreted in the broadest fashion possible,
so as to provide the widest representation to disabled citizens of
Middletown Township.
The Board of Supervisors previously established the Middletown
Township Disabled Persons Advisory Board by Resolution No. 00-12R,
as amended by Resolution No. 01-06R. The Disabled Persons Advisory
Board of Middletown Township (the "Advisory Board") is hereby also
established via this article.
The Advisory Board shall consist of seven members. It is highly
encouraged, but not required, that three members be disabled residents,
as such term is further defined herein, and that the members of the
Board be representative of the persons that the Pennsylvania Human
Relations Act, 43 P.S. § 951, et. seq., and the United States
Americans with Disabilities Act, 42 U.S.C.A. § 12101, et.
seq., were designed to protect. The members of the Board shall be
appointed by the Board of Supervisors. All members shall serve for
staggered terms of two years. No such member shall hold office in
any political party. Members shall serve without salary but may be
paid expenses incurred in the performance of their duties.
The Advisory Board created herein shall assist in public education
with respect to the Americans with Disabilities Act, and all other
state, local, and federal statutes, regulations, or requirements which
may be appropriate for Township consideration and action; educate
the community as to the needs of those with disabilities; recommend
to the Township Manager and Board of Supervisors of Middletown Township
such action as would be necessary to comply with the mandates of law,
and such further action as would be beneficial to the general health,
safety, and welfare of those with disabilities and all citizens of
the Township; and provide a forum for presentation of the problems
and concerns of citizens with disabilities and all citizens of Middletown
Township on issues relating to the disabilities.
