[Adopted 5-25-1961; amended in its entirety 10-8-2020 by L.L. No. 5-2020]
Any person, corporation or association shall be permitted to launch boats from the boat launch at the Village of Nyack Marina by either purchasing a twenty-four-hour launch permit, which permits launching for a twenty-four-hour period, or a seasonal launch permit which permits launching from the first day of April to the 31st day of December in a calendar year (weather conditions permitting).
A. 
The fee for a twenty-four-hour launch permit is $25, which fee may from time to time be changed by resolution of the Village Board of Trustees. Payment for this permit shall be made at the parking munimeter located at the boat launch ramp in the Village of Nyack Marina.
B. 
The fee for a seasonal launch permit is $200, which fee may from time to time be changed by resolution of the Village Board of Trustees. Seasonal launch permits are available at the office of the Nyack Parking Authority, 9 North Broadway, Nyack, NY 10960.
Due to the size of the Nyack Marina, and consistent with the goals and policies contained in the Village of Nyack Comprehensive Master Plan and LWRP, only the following vessels shall be permitted to berth and/or launch at the Village of Nyack Marina:
A. 
Sailboats and motorboats not exceeding 28 feet in length.
B. 
For launching purposes, sailboats and motorboats, not exceeding 28 feet in length, that can be launched from a boat or trailer affixed to a car or van.
Due to the size of the Nyack Marina, and consistent with the goals and policies contained in the Village of Nyack Comprehensive Master Plan and LWRP, the following crafts shall be prohibited from launching and/or berthing at the Village of Nyack Marina:
A. 
Sailboats and motorboats exceeding 28 feet in length.
B. 
Personal water craft, defined by the United States Coast Guard as a "Type A powerboat with an inboard motor which is less than 16 feet in length and designed to be operated by a person or persons sitting, kneeling, or standing on top of the craft rather than inside of a hull."
Notwithstanding the provisions set forth in § 250-5 above, any prohibited craft shall be entitled to berth at the Village of Nyack Marina in the event of an emergency, but not for a period of time in excess of 24 hours.
A. 
All provisions of the Navigation Law of this state, of the inland rules enacted by Congress and governing the navigation of the inland waters of the United States and of the pilot rules for the United States inland waters applicable to the channel systems, relative to the rules for vessels passing each other, as to lights on vessels and other matters consistent with the proper use of waters and waterways, shall be complied with by all vessels navigating said waters and waterways under the jurisdiction of the Village.
B. 
Any vessel which becomes a menace to navigation or unseaworthy or sinks, grounds or becomes otherwise disabled shall be removed by the owner or person in charge thereof on order of the Village Board. If said boat is not removed after order to remove it, it may be removed by or at the direction of the Village Board at the expense of the owner or person in charge of said vessel.
C. 
Every person operating a boat shall at all times operate the same in a careful and prudent manner and at such rate of speed as not to disturb the reasonable comfort or endanger the property of another or the life or limb of any person or so as to interfere with the free and proper use of the waters within the Village. Throwing up a dangerous wake when approaching or passing another boat shall be prohibited.
A. 
A Village of Nyack Parking Enforcement Aide, the Police Department of the Town of Orangetown, the Rockland County Sherriff's Patrol, the New York State Police, and the New York State Department of Environmental Conservation are hereby empowered to enforce the provisions of this article, and every person in charge of a vessel or seaplane navigating or using waterways under the jurisdiction of this Village shall at all times obey the lawful orders of the members of said enforcement officers or police departments. Such departments shall have the right to stop any vessel or seaplane navigating or using the waterways for the purpose of enforcing this article.
B. 
The Village Board of Nyack may also maintain an action or proceeding in the name of the Village in a court of competent jurisdiction to compel compliance or to restrain by injunction the violation of this article.
Any person, corporation or association who or which fails to obtain a permit required by this article, or violates any other provision of this article, shall be liable for a fine not to exceed $250 for each and every offense. Each day that a violation of this article continues shall be considered a separate offense.
