Words used in this article and not defined in this section or
elsewhere in this article, shall have the meanings given in Webster's
Unabridged Dictionary, second edition, but for the purposes of this
article, the following words and phrases shall have the meanings respectively
ascribed to them by this section:
ACCESSORY BUILDING
A structure, the use of which is customarily incidental and
subordinate to that of the principal building on the same lot, such
as a detached garage, carport, barn, green house, woodshed, toolshed,
or kennel. An accessory building may also contain an accessory dwelling
unit as defined herein.

ACCESSORY USE
The use of a structure or lot, or portions thereof, which
use is customarily incidental and subordinate to the main use of the
structure or lot.
ASSISTED LIVING RESIDENCE
A facility which is licensed by the department of health,
in accordance with N.J.A.C. 8:36, to provide apartment-style housing
and congregate dining and to assure that assisted living services
are available when needed. "Assisted living services" means a coordinated
array of supportive personal and health services, available 24 hours
per day, to residents who have been assessed to need these services,
including residents who require formal long-term care.
ATTIC
The part of a building that is immediately below and wholly
or partly within the roof framing of a pitched roof. The spring point
of such pitched roof shall be no greater than five feet above the
finished floor level of the attic (Fig. 1).

AUTOMOBILE LAUNDRY
Any establishment for the washing of automobiles or other
motor vehicles, using a chain or other conveyor to move the vehicles
or using various automatic devices for the application of soap, water,
steam, air or other materials required in the cleaning process.
BASEMENT
Space in which the ceiling (defined as the bottom of the
structural members of the floor above) is less than four feet above
the average finished grade line along the outside walls of the building
and is more than five feet measured from the finished floor, except
at points of entry or access.

BICYCLE PARKING SPACE
An area within which one intact, full sized bicycle may conveniently
and securely be stored and removed, with one or both wheels resting
upon a stable surface such that the whole bicycle is stable in its
storage position, without requiring the use of a kickstand, and without
requiring the movement of other parked bicycles, vehicles or other
objects to access the space. Bicycle parking spaces may be classified
as either long-term or short-term. Long-term bicycle parking is intended
primarily to serve residents, employees, or other persons who require
storage of a bicycle for a substantial portion of the day, overnight,
or for multiple days. Short-term bicycle parking is intended primarily
to serve visitors and customers, such as retail patrons, expected
to use bicycle storage for a few hours.

BUILDING LINE
The horizontal projection in plan of all covered or roofed
areas of a structure whether permanent or temporary.
CAMP
A group of tents, huts or other shelters, usually located
near a lake or in the woods, forming a temporary residence, especially
in summer.
COMMERCIAL CHICKEN FARM
A place where chickens are assembled for growth, fattening
or egg production before sale or slaughter for commercial purposes.
COMMERCIAL DOG KENNEL
A business in which more than three dogs over six months
old are kept for sale, treatment, training, boarding or breeding.
CONTINUING CARE RETIREMENT COMMUNITY (CCRC)
A development of residential living units exclusively for
persons who are 62 years of age or older, or for couples, one of whom
is at least 62 years of age, which provides a continuum of accommodations
and care from independent living to nursing care units and which provides
"continuing care" as an integral part of the residential development.
Continuing care is the provision of lodging and nursing, medical or
other health related services at the CCRC or at another location to
an individual pursuant to an agreement effective for the life of the
individual or for a period greater than one year, and, in consideration
of the payment of an entrance fee with or without other periodic charges,
provided that the person receiving the care is not related to the
person who provides the care.
DORMITORY
A structure containing sleeping rooms of not less than 80
square feet each, and containing complete sanitary facilities, although
not necessarily within individual rooms, occupied only by students
of an educational institution, excluding spouses and children of such
students, and assigned supervisory staff.
DWELLING UNIT
A group of interrelated rooms in other than a dormitory which:
(a) are intended or designed for the use of one family, (b) are separated
from other space by lockable doors, (c) have access to the outdoors
without crossing through any part of another dwelling unit and (d)
have living and sleeping facilities, cooking facilities, fixed or
portable, and complete sanitary facilities.

DWELLING UNIT, ACCESSORY
A group of interrelated rooms that: (a) constitutes an entirely self-contained portion of a principal, one-family dwelling, or is located in an accessory building on the same lot as a principal, one-family dwelling; (b) contains complete housekeeping facilities for only one family; (c) has no cooking facilities, food preparation facilities, sanitary facilities, or enclosed space in common with any other part of the building in which it is located, except vestibules, entrances, porches, garages, or laundry, heating or air conditioning rooms or equipment; and (d) complies with the provisions of section
T10B-255(c)(3) of this Code.

FAMILY
A group of persons, all related to each other by blood or
marriage, who live and cook together in one dwelling unit as one household;
or a group of persons, not exceeding four in number, all of whom live
and cook together in one dwelling unit as one household, but some
or all of whom are not related to the others by blood or marriage.
Children who are members of families by reason of their relationship
by adoption or who are foster children placed with such families in
a dwelling by the state division of youth and family services or by
a duly incorporated child care agency or who are placed pursuant to
law in single family dwellings known as group homes shall be deemed
children related by blood for the purpose of this definition. As used
in this definition, "group home" means and includes any single family
dwelling used in the placement of children pursuant to law and recognized
as a group home by the state department of institutions and agencies,
in accordance with rules and regulations adopted by the commissioner
of institutions and agencies; provided, however, that no group home
shall contain more than 12 children.
FARMING
Agricultural activity or the keeping or raising of livestock,
poultry, or small animals upon a lot or plot in single ownership of
not less than three acres and not constituting a chicken farm or piggery.
FENCE
A vertical assemblage, generally along a single plane, including
corner and line posts, solid or partially open. A fence in excess
of six feet, six inches from grade is considered a "structure" for
the purposes of this chapter, except that if a fence relates to active
farming (referred to as "farm fences"), it shall be a structure only
if it exceeds eight feet from grade.
FLOOR AREA

The total area of all of the stories of all structures on
the lot, measured from the outside faces of the exterior walls or
from the exterior roof edges where the structure has no walls and
including the following, although not by way of limitation: interior
balconies and mezzanines, roofed and/or enclosed areas such as sheds,
barns, garages, and carports.
Attic space in a single family or two family residence with
a height of five feet or more measured from the finished floor to
the roof rafter shall be counted as floor area except for that area
that is up to one-third of the area of the floor directly below. Attic
areas in a single family or two family residence with a height of
less than five feet measured from finished floor to roof rafter shall
not be counted as floor area.
If an interior space in a one or two family structure has
a ceiling height of twelve feet or greater, the floor area of that
space shall be counted twice for the purpose of floor area calculation.
If an interior space in a one or two family structure has a sloped
ceiling, only that portion of the floor having a ceiling height of
twelve feet or greater shall be counted twice for the purpose of floor
area calculation.
For single- and two-family dwellings and accessory dwelling
units, the following shall be exempt from the calculation of floor
area (see Fig. 1):

Basements
|
Dwellings/ accessory dwelling units without a basement
only: storage space for mechanical equipment and/ or utilities, including
washers/dryers, not to exceed 100 square feet in the aggregate; and
storage space for bicycles and/ or miscellaneous items, not to exceed
forty-eight square feet in the aggregate, and provided further that
said storage space cannot be accessed from the interior of the dwelling.
Storage space in excess of these limits shall be counted as floor
area.

A/C condenser units, generators, transformers, above-ground
fuel tanks and other similar devices, not to exceed 100 square feet
in the aggregate. The area in excess of 100 square feet in the aggregate
shall be counted as floor area
|
(A) Non-enclosed one-story porches, porticos, stoops
and entrance platforms, up to 200 square feet. Any additional square
footage beyond the first 200 square feet shall be included in the
calculation
|
(B) That portion of any garage, porte-cochere, carport
or other accessory structure that is located behind the rearmost wall
of the dwelling (C), provided that said structure is no greater than
1 story and 15 feet in height to the peak of the roof, not to exceed
300 square feet

FLOOR AREA RATIO
The gross floor area of all buidlings on a lot divided by
the lot area.
GARAGE, COMMERCIAL
A building used for the off-street storage of motor vehicles,
the provisions of incidental gasoline service, the sale of accessories
and the repair of motor vehicles excluding body work, but not used
for the sale of motor vehicles.
GARAGE, MOTOR COURT
A garage located in between the front of a structure and
the street and which is accessible from a paved courtyard located
at the interior of the lot.
GARAGE, PRIVATE
An accessory building incidental to a house as defined herein,
which accessory building is intended for the off-street storages of
motor vehicles belonging to the inhabitants of such house, but in
which garage no business, service or occupation is conducted or rendered
for profit. The rental of storage space for more than two cars not
owned by persons residing in the house is considered a business for
profit.
GARDEN WALL
Any wall assembled, erected or attached to an object having
location on or in the ground, to provide a grade separation or landscape
planter. Steps shall not be considered a garden wall.
GASOLINE SERVICE STATION
An area of land, including any structure thereon, that is
used primarily for the retail sale and direct delivery to motor vehicles
of motor fuel and lubricants, as well as such incidental services
as the lubrication and hand washing of motor vehicles and the sale,
installation and minor repair of automobile accessories such as tires
and batteries, and which area is not used for the sale of motor vehicles.
GOLF COURSE/CLUB
A golf course is a tract improved with a full-size, professional
golf course with a minimum of 18 holes with the necessary and usual
accessory uses and structures. The course shall be owned and operated
by one or more entities (the "club") with the obligation to maintain
the golf course and related facilities. Together they are referred
to as a "golf course/club."
HALF STORY
An attic with a floor area no greater than 50% of the floor
below.

HEIGHT OF BUILDING
The greatest vertical distance between the average level
of finished grade or pre-construction grade, whichever is lower in
elevation, along all the exterior walls of a building and each of
the following:
(a)
The highest ridge of the roof, in the case of a pitched roof;
(b)
The highest parapet or cornice level, in the case of a flat
roof;
(c)
The highest point of any structure that rises wholly or partly
above the roof line and whose area together with the area of all other
such structures exceeds 10% of the ground floor area of the building
that supports it; excepting, however, structures that constitute or
house mechanical equipment for such building; provided, that all the
structures that rise wholly or partly above the roof line do not exceed
in the aggregate 20% of the ground floor area of such building.
The finished grades of depressed courts, to the extent that
they are below abutting ground level, shall be disregarded in height
computations.

HOME OCCUPATION
An occupation customarily carried on in a dwelling unit by
an occupant of the residence, which occupation is clearly an accessory
use incidental to the residential use. A "home occupation" shall not
include any occupation that gives external evidence of nonresidential
use, nor shall it include a barbershop, beauty parlor, commercial
caterer, commercial rental office, medical doctor or dentist, or studio
where dancing, music or other personal instruction is offered to more
than one pupil at one time or where concerts or recitals are held.
HOTEL
Any structure providing overnight accommodation, in other
than dwelling units, for hire to the travelling public.
HOUSE, ROOMING
A single-family or semi-detached house, occupied by one or more roomers in accordance with the provisions of section
T10B-273.
HOUSE, SEMI-DETACHED
One section of a structure that contains two sections, each
of which has free-standing walls on three sides and shares a party
wall with the other section on the fourth side, and each of which
contains only one dwelling unit or only one dwelling unit and a flat.
IMPERVIOUS SURFACE
A surface that has been compacted or covered with a layer
of material so that it is highly resistant to infiltration by water.
Impervious surfaces include roofs and asphalt, concrete, and stone
drives, sidewalks, porous asphalt or concrete, decks, pools and patios.
INSTITUTION OF HIGHER LEARNING
An educational institution of higher learning chartered by
the state, or a private educational institution approved by, and subject
to regulations prescribed by, the state, and giving instruction or
affording facilities for study in academic or technical subjects only
at or above the college level.
JUNK YARDS
The use of any space, whether inside or outside a building,
for the storage, keeping or abandonment of junk, including scrap metals
or other scrap materials, or for the dismantling, demolition or abandonment
of automobiles or other vehicles or machinery or parts thereof.
LABORATORY RESEARCH
A building or portion thereof equipped for technological
research, scientific experimentation, investigation, observation and/or
engineering development in the natural physical or social sciences
that often provides controlled conditions involving the testing of
drugs, chemicals, mechanical or scientific/technological components
and consumer products, may include the engineering and product development,
including but not limited to the following: innovative and maker space,
fabrication laboratories, rapid prototype spaces, collaborative areas
used for the discussion, review and/or research areas, laboratory
areas where the experimentation, development or testing is performed;
the offices, common work areas, accessory facilities and hallways
located within the laboratory research areas and used in connection
with such laboratory research areas; support and development areas
directly related to the laboratory research areas such as storage,
or holding areas for laboratory equipment, products, packaging and
supplies; focus and consumer testing group areas; pilot plants, and
utility corridors and utility rooms directly related to the laboratory
research areas.
LARGE PROJECT
Any development which results in an increase in impervious surface or disturbance, consistent with the “major development” definition in section
T10B-227.1, and is exempt from the site plan review and approval requirements under Article
X of this chapter. The amount of disturbance or impervious surface shall be measured on a cumulative basis since June 12, 2017.

LOT
A lot of record, lawfully created by deed or conveyance,
or by subdivision on a subdivision map.
LOT LINE, FRONT
The continuous line formed by the lot frontage. A corner
lot shall be deemed to have two front lot lines, one along each of
its lot frontages.
LOT LINE, SIDE
A continuous line which runs back from an intersection with
the lot front line, and which forms the boundary line between the
lot and the adjacent parcel of land.
LOT WIDTH
The distance between the side lines of a lot measured along
a straight line lying between the required front and rear building
setbacks and making equal angles with the side lines. For a corner
lot, the lot width is the distance between one of its front lot lines
and the side lot line opposite thereto, measured along a straight
line making equal angles with such front and side lot lines and lying
between the required front building setback from the other front lot
line and the required side building setback from the side lot line
opposite such other front lot line.
LOT, CORNER
A lot fronting on two streets at their intersection.
LOT, COVERAGE
The ratio of the total area of the plan projections of all
buildings and of all outdoor parking space on a lot to the gross area
of that lot, expressed as a percentage. For this purpose, a plan projection
is the projection to ground level of the largest horizontal cross
section of a building above ground level; except, that structures
or portions of structures whose roofs are accessible directly from
ground level for outdoor use by pedestrians shall not count as lot
coverage; provided, that the surfaces of such roofs shall not be more
than three feet above the highest surrounding grade elevation nor
more than 10 feet above the average surrounding grade; and provided,
further, that no part of such roof surface is used for vehicular parking.
Anything herein to the contrary notwithstanding, the plan projection
of an unroofed stadium shall be the area of the cross section of the
stadium structure midway between the highest level thereof and the
level of the playing field therein.
LOT, DEPTH
The shortest distance between the front and rear lot lines,
or, as to a corner lot, between the front lot line not used as a terminus
in measuring lot width and the side lot line opposite such front lot
line.
LOT, FRONTAGE
The continuous distance along which a lot abuts a street.
A corner lot shall be deemed to have two lot frontages, one along
each street.
LOT, IMPERVIOUS COVERAGE
The ratio, the numerator of which is the area of lot coverage
plus the area of all other impervious cover, and the denominator of
which is the gross area of the lot.
For single- and two-family dwellings, the following shall
be exempt from the calculation of impervious coverage (see Fig. 1):

LOT, ZONING
An area of land, with definite boundaries designated on a plat satisfactory to the development enforcement officer and filed with the township clerk, of size, dimensions and frontage adequate to satisfy this article with respect to buildings thereon and the provisions of article
IX with respect to streets and lot layout. The length or depth of a zoning lot shall not exceed three times its width at the building line and zoning lots may not overlap.
NUISANCE FACTORS
Any offensive, annoying, unpleasant or obnoxious thing or
practice, a cause or source of annoyance, especially continuing or
repeating invasion or disturbance of another's right, including the
actual or potential emanation of any physical characteristics of activity
or use across a property line, which emanation can be perceived by
or affects a human being or the generation of an excessive or concentrated
movement of people or things, such as:
(k)
Electronic or atomic radiation.
(m)
Noise of congregation of people, particularly at night.
NURSING HOME
A facility which is licensed by the department of health,
in accordance with N.J.A.C. 8:39, to provide health care under medical
supervision and continuous nursing care for 24 or more consecutive
hours to patients who do not require the degree of care and treatment
which a hospital provides and who, because of their physical or mental
condition, require continuous nursing home-level care.
OPEN AIR COMMERCIAL AMUSEMENTS
Any land, building, devices or activities for amusement and
profit perceptible from a public right of way, such as drive-in theatres,
golf driving ranges, miniature golf courses, archery, ferris wheels,
shooting galleries, open front restaurants or snack bars, swimming
pools and other features found in commercial areas.
PARKING LOT
An area which contains two or more off-street parking spaces.
PARKING SPACE, OFF-STREET
An area not less than nine feet by 19 feet, which is accessible
from a street but not located on a street, which is both suitable
and intended for the parking of a passenger motor vehicle and which
may include a garage or carport.
PIGGERY
A place where pigs are assembled for growth or fattening
before sale or slaughter.
PLACE OF WORSHIP
A place of worship is a building or structure where persons
regularly assemble for worship, which by design and construction are
primarily intended for the conducting of organized religious services
and accessory uses associated therewith.
PROJECT
See definition of "Large Project" and "Small Project"
QUARRYING
The removal from the earth of stone, sand, gravel, minerals,
topsoil or other natural material for the purpose of sale or any other
commercial purpose, other than such as may be incidental to excavating
or regarding in connection with or in anticipation of building development
or landscaping on the site.
RECREATIONAL VEHICLE
A vehicle other than an automobile, such as a travel trailer,
a boat and boat trailer, an aircraft or a light truck or bus containing
sleeping accommodations, which is intended and employed only for noncommercial
recreational use.
RESTAURANT
Any establishment, however designated, at which food is sold
for consumption on the premises, but normally to patrons seated within
an enclosed building. However, a snack bar at a public or community
playground, playfield, park or swimming pool, operated solely by the
agency or group operating the recreational facilities and for the
convenience of the patrons of the facilities, shall not be deemed
to be a restaurant.
RESTAURANT, DRIVE-IN
An establishment where patrons are served food, soft drinks,
ice cream and similar confections for consumption mainly outside the
confines of the principal building or in vehicles parked upon the
premises, regardless of whether or not, in addition thereto, seats
or other accommodations are provided for the patrons.
RIGHT-OF-WAY LINES
The boundary lines of land used or intended for use as streets
and from which setback and other requirements shall begin. Where existing
records are vague or show a lesser dimension, they shall be considered
to be not less than 50 feet apart, 25 feet from the centerline of
streets.
ROOM
A completely enclosed interior space containing no partitions
higher than four feet.
ROOMER
A person who occupies a rooming house in accordance with the provisions of section
T10B-273 and who is not related in direct line by blood or marriage to the owner of the house.
SETBACK, PARKING FRONT
The shortest distance between the perimeter line of the parking
area and the front lot line.
SETBACK, PARKING REAR
The shortest distance between the perimeter line of the parking
area and the rear lot line.
SETBACK, PARKING SIDE
The shortest distance between the perimeter line of the parking
area and the side lot line.
SIGN
A visible device for attracting attention or giving information
through the use of letters, symbols or any other means, such as flags
and pennants. Its area shall be considered as being the total area
containing all letters, symbols and other devices, or the area of
its background if distinguishable from a larger background such as
the wall of a building. In the case of multi-faceted signs, the area
shall include all the faces of the sign. Not included or restricted
are the flag, pennant or insignia of any nation, state, city or other
political unit, or of any educational institution, or temporary signs
of any political, educational, charitable, philanthropic, civic, religious
or like campaign, drive or event.
SMALL PROJECT
Any development which results in an increase in impervious surface of four (400) hundred or more square feet, does not meet the definition of a “major development” or “minor development” under section
T10B-227.1 and is exempt from the site plan review and approval requirements under Article
X of this chapter. The amount of disturbance or impervious surface shall be measured on a cumulative basis since June 12. 2017.

STORY
Any covered area whether finished or not, with a clear headroom
of five feet or more measured from the finished floor to the ceiling
(defined as the bottom of the structural members of the floor or roof
above). If the covered area also meets the definition of "basement,"
it shall not be considered a "story."

STREET
Any right-of-way defined in article
IX and any private right-of-way necessary to provide access to buildings. Not included in this definition are privately owned roads or driveways on campuses of educational institutions; provided, that such are not customarily used by the general public to traverse such campuses. Nonexhaustive examples of private roads that are so used by the general public and which, therefore, are included in this definition of street, are Springdale Road Extension, Faculty Road, Hartley Avenue, Western Way east of Broadmead and Broadmead.
STRUCTURE
Anything constructed, assembled or erected, the use of which
requires location on the ground or attachment to something having
location on or in the ground; this shall include fences and garden
walls more than six feet, six inches from grade, farm fences in excess
of eight feet from grade, tanks, towers, advertising devices, bins,
tents, lunch wagons, trailers, dining cars, recreation vehicles, or
similar structures on wheels or other supports used for business or
living purposes. This includes any structure equipped with a roof,
whether permanent or temporary, such as porches, awnings, canopies,
summer houses, arbors, balconies and similar elements. The word "structure"
shall not apply to service utilities entirely below the ground, nor
shall it apply to tents used in connection with reunions of alumni
of educational institutions for periods of two weeks or less, nor
shall it apply to tents or fences used for private social affairs
such as weddings and parties and in place for one week or less.
STRUCTURE, SINGLE-FAMILY
A freestanding structure containing one dwelling unit only,
or, if permitted in the district, one dwelling unit and one accessory
dwelling unit.
SWIMMING POOL
Any pool which is constructed, used or maintained to provide
recreational facilities for swimming, bathing or wading and which
is capable of containing water to a depth greater than 18 inches,
and all buildings, equipment and appurtenances thereto.
TAVERN
A business selling alcoholic beverages for consumption on
the premises.
TRAILER, HOUSE
Structures designed to be moved from place to place, which
are enclosed and used for sleeping or other human occupancy.
TRAILER, TRAVEL
Structures designed to be moved from place to place, which
may be partially enclosed with canvas or other material, and which
are used for sleeping and other human occupancy during the course
of activities commonly known as "camping" or "caravaning."
WADING POOL
Any pool which is constructed, used or maintained to provide
recreational facilities for wading, and which is capable of containing
water to a maximum depth not greater than 18 inches, and all buildings,
equipments and appurtenances thereto.

This article shall consist of the text thereof and the consolidated
zoning map entitled "Official Zoning Map of Princeton, Mercer County,
New Jersey," prepared by Deanna Stockton, P. E., Municipal Engineer,
dated November 28, 2022, consisting of two sheets. Said map, together
with all explanatory matters thereon, is hereby adopted and made a
part of this chapter and shall be kept up to date with the latest
amendments in the office of the Municipal Engineer and the office
of the Municipal Clerk for the use and benefit of the public.
