No person or organization shall hold any fair or festival, any
tent show, outdoor trade show, or any circus, carnival or similar
outdoor amusement without first obtaining a license from the Township
Council.

Application to the Township Council for a license under this
chapter shall be made on a form to be furnished by the Township containing
such information as the Township Council shall direct, including but
not limited to the date of the event, hours of operation, provisions
for traffic control, site protection, provision of parking space,
sewage disposal, solid waste disposal, food service, water, and dust
and noise control. If the applicant is not the owner of the property
where the event is being scheduled, the property owner's written consent
shall accompany the application. The application shall also include
a copy of the notice which must be furnished to all property owners
within 200 feet of the site advising them of the event along with
a list of owners the notice was presented to. Notice to property owners
within 200 feet must be given, and application to the Township Council
shall be made at least 45 days in advance of the event to allow sufficient
review time. No more than one license per year shall be issued to
any individual, organization, or association.

A license fee as provided in Chapter
152, Fees, shall be charged for each license issued pursuant to this chapter, which fee shall be paid on the issuance of the license, provided that the Township Council, in its discretion, may issue a license without charge to any organization, corporation or association formed and operated for charitable, benevolent, religious, civic, eleemosynary, library, community, or hospital purposes.
Upon the payment of the required license fee, the deposit of
the indemnification required by this chapter and approval of the application
by the Township Council, the Township shall issue a license to the
applicant. Such license shall state the purpose for which it is issued
and the person and organization to which it is issued. This license
does not relieve the licensee from any and all applicable local, state,
or federal regulations.
Licenses issued pursuant to this chapter shall state the date
of expiration of such license, which shall not be more than seven
days after the date of issuance.
Upon issuance of a license under this chapter, all licensees, including those exempt from the license fee, shall deposit with the Township Clerk a cash bond as provided in Chapter
152, Fees, conditioned upon the prompt cleanup and removal of all equipment, trash and debris from the premises where the special events and exhibits operated pursuant to such license. If such cleanup and removal are not satisfactorily accomplished within a reasonable time after the closing of such event or exhibit, so much of such bond as may be necessary to effect such cleanup and removal may be used by or at the discretion of the Township Council and the balance returned, if any, to the licensee. In the event that cleanup is satisfactory to the Township, such bond shall be returned to the licensee upon expiration of the license.

A license to hold an outdoor event grants no permission to post or install signs announcing, advertising, or directing persons to the event except as provided by and in accordance with Article
XIII, Signs, of Chapter
360, Zoning, of the Township Code.

No person or organization obtaining a license under this chapter
shall permit the use of any live animal or creature, fish, reptile,
or bird as a prize, inducement, or giveaway at any fair or festival,
any tent show, outdoor trade show, or any circus, carnival or similar
outdoor amusement. This shall not apply to any domestic animal given
away or sold in connection with legitimate adoption events by licensed
animal shelters and/or licensed animal rescue organizations.
