If Council resolves that sidewalks or curbs shall be constructed along any right of way within the Borough of Millvale, owners of property abutting said right of way shall be required to grade, construct, and pave such sidewalk or curb pursuant to the standards set forth by the Borough.
Owners of property abutting any right of way upon which a sidewalk or curb has been constructed shall keep the same in good repair and in safe and usable condition. Repairs shall comply with the standards set forth by the Borough.
A. 
A permit shall be required prior to constructing or repairing any sidewalk or curb in a residential zone (R1 or R2) in the Borough.
B. 
A permit shall be required prior to cutting a sidewalk's curb to facilitate the creation of a driveway.
C. 
If an applicant seeks to remove any tree in the Borough for the construction or repair of a sidewalk or driveway, approval by the Millvale Borough Tree Committee is required prior to the issuance of a permit under this subsection. The Tree Committee may require the planting of new trees as a condition of its approval.
D. 
Permit applications shall be on a form provided by the Borough. Permit fees shall be set by resolution of the Borough Council. A penalty of $10 shall be added to the permit fee if any individual begins construction or repair of a sidewalk, curb, or driveway without first obtaining the required permit.
Upon the neglect of any property owner to comply with any of the requirements of this article, the Borough Secretary shall cause a written notice to be served upon the owner, directing compliance with all the terms of this article within 30 days from the date of said service. Notice shall be served on the owner by certified mail, return receipt requested.
Upon the neglect of any property owner to comply with any of the provisions of this article, the Borough may, after due notice, cause the grading, paving, repairing, construction, reconstruction or maintenance to be done at the cost of such owner, and may collect the costs thereof and 15% additional, together with all charges and expenses, from such owner, and may file a municipal claim in accordance with the law providing for the filing and collection of municipal claims.
A. 
A Borough of Millvale police officer or Borough Council appointed designate shall issue a notice of violation to any person who violates or permits a violation of this article. The person will be ordered to pay a fine of $30 to the Borough of Millvale and resolve the violation. Each day that a violation of this article continues shall constitute a separate offense and separate fine.
B. 
Failure to pay a fine issued under Subsection A of this section within seven days of the date of the notice shall result in an issuance of a citation to the owner and, upon conviction in a summary proceeding brought before a Magisterial District Judge under the Pennsylvania Rules of Criminal Procedure, shall be punishable by a fine of not more than $1,000, plus court costs and reasonable attorneys' fees incurred by the Borough in the enforcement proceedings. Such fine and costs may be in addition to any other remediation expenses and additional amounts authorized by this chapter.
