Except as provided in this chapter, sidewalks shall always be
kept open and free of obstructions to public travel.
It shall be unlawful for any person to place a pile of stone,
lumber, brick, mortar beds, boxes, barrels, merchandise, household
goods, furniture or any other items on a sidewalk within a radius
of 48 inches from any fire hydrant or plug within the Borough of Millvale.
It shall be unlawful for any person to discharge or cause to
be discharged any stormwater, roof runoff, sump pump discharge or
other waters onto any sidewalk where such discharge is determined
to be a hazard by the Borough of Millvale appointed designee. Upon
such determination by the Borough designee, written notice shall be
served upon the person to take such steps as are necessary to abate
the hazard.
No person shall place, exhibit or display upon any sidewalk
in the Borough of Millvale any goods, wares or merchandise, or any
fixture, table, machine or other device for the display or sale of
goods, wares or merchandise. The following are exempt from this section:
A. Goods, wares or merchandise may be placed, exhibited or displayed
on the inside line of the sidewalk if they do not extend more than
24 inches into the sidewalk and the sidewalk is sufficiently wide
so that a free and unencumbered walkway at least five feet in width
remains available for the use of pedestrians;
B. Goods, wares or merchandise may be temporarily placed on the sidewalk
for such limited time as may be necessary pending the loading or unloading,
removing or storing away of the same; or
C. Goods, wares or merchandise may be placed, exhibited or displayed on a sidewalk if authorized by the Borough through a special events permit granted under Chapter
259 of the Borough Code.
