As used in this article, the following terms shall have the meanings indicated:
BULK REFUSE CONTAINER
Any container used for the collection and/or disposal of solid waste which is designed or intended to be transported from the premises where it is used by mechanical means with its contents to the dump site, or to be emptied by mechanical means upon the premises where it is used into a waste transport vehicle. Without limitation, it includes dumpster-type containers which are commonly used in multifamily residential, commercial, industrial and public locations.
TRAFFIC WAY
The entire width between the property lines of any road, street, way, alley, bridge or other similar structure not privately owned or controlled, when any part thereof is open to the public for vehicular traffic, which is the responsibility of the Borough or other similar public entity to maintain over which the Borough has legislative jurisdiction under police powers.
A. 
The Borough Secretary of other official designated by the Borough shall issue a temporary use permit for the placement of a bulk refuse container on a traffic way to the owner of a property on which improvements are being developed or constructed or both in accordance with a valid building permit upon demonstration that the temporary use will not unreasonably interfere with vehicular or pedestrian traffic and that no practical alternatives exist to the placement of the bulk refuse container in the traffic way.
B. 
Any bulk refuse containers must have safety reflectors on each side and be properly illuminated to protect the safety of all persons living and traveling through the Borough of Summit Hill.
C. 
Each permit shall be for specific type and size of bulk refuse container at a specific location and it may be issued for a period not to exceed 30 days subject to renewal. A permit shall not be issued unless the applicant pays the fees as set by the Council from time to time by resolution.
It is unlawful for any person to intentionally, knowingly or recklessly handle, scavenge from, disturb or remove any contents of any bin, bag or other container that is in place for collection of garbage or recyclable materials at the designated location for pickup by the Borough or any other entity for collection service.
The Borough of Summit Hill reserves the right to request the removal of a bulk refuse container if:
A. 
Construction materials impede or block a pedestrian walkway and/or public traffic way.
B. 
Street cleaning is scheduled.
C. 
Project site (around bulk refuse container area) is not cleaned daily.
D. 
Bulk refuse container is full of construction debris and not emptied in a timely fashion as deemed acceptable by the Code Officer.
E. 
A weather warning is in effect.
A. 
Any person who fails to comply with the provisions of this article or a request for removal made by the Borough of Summit Hill shall, upon conviction thereof, be sentenced to pay a fine not exceeding $600, and costs, and, in default of payment thereof, shall be subject to imprisonment for a term not to exceed 30 days. Each day that violation of this article continues shall constitute a separate offense.
B. 
In addition to the foregoing, upon the revocation of a permit, the Borough may remove any bulk refuse container in violation of the article, and the costs of said removal shall be the responsibility of the property owner.
This article shall be effective upon passage, and approved in a manner prescribed by law.
