(a) 
The purpose of this article is to jointly enunciate the public policies of the governing bodies of the Towns of Abingdon and Damascus as to the operation of the Virginia Creeper Trail and the manner of use of such trail by the public.
(b) 
It is hereby agreed that ownership of such trail is held jointly by the Towns of Abingdon and Damascus and that such trail will be developed largely under the supervision of the Town of Abingdon and maintained by the Town of Abingdon, or by such other entity as may be jointly agreed upon by both parties.
(c) 
Enforcement of this article will be carried out by the police departments of the Town of Abingdon and the Town of Damascus, as well as by the county sheriff's department.

The Virginia Creeper Trail is hereby established for the use of the general public; provided, that the limitations and regulations established in this chapter are observed by all users.

(a) 
There shall be no motorized vehicles allowed upon the Virginia Creeper Trail, with the following exceptions:
(1) 
Vehicles belonging to the Town of Abingdon and the Town of Damascus and the county, their successors and assigns, as may be necessary for law enforcement, maintenance or other official and authorized use.
(2) 
Vehicles of persons owning lands adjacent to such trail who may have need to cross such trail from time to time. Such exemption shall be limited to periodic crossing and use of the trail only by such persons and not for travel upon such trail.
(3) 
Electrically powered wheelchairs operated by handicapped persons at their own risk.
(b) 
No firearms shall be discharged upon such trail.
(c) 
No alcoholic beverages shall be carried in an open container or consumed upon such trail.
(d) 
Camping on the trail shall be allowed only in areas of such trail as shall be designated by an appropriate sign or marker.

(a) 
Any person who violates any provision of this article shall be guilty of a Class 1 misdemeanor.
(b) 
Each day of violation or each failure to comply with a lawful order by any officer authorized under Section 54-51 shall constitute a separate and distinct offense.
