As used in this Part 8, the following terms have the meanings
indicated:
CONNECTION FEE
The fee for the cost of the facilities installed between
the sewer main and the property line of the property being connected,
if the sewer was constructed in a public street or between the sewer
main and the right-of-way line, or if the sewer was constructed in
an easement. These facilities arc commonly referred to as laterals.
All costs associated with the installation of these facilities are
not considered a part of the tapping fee calculation. Should the construction
of these facilities occur, the fee may be calculated using either:
(1) the actual costs of the particular installation; or (2) the average
cost of similar installations; or (3) the current/trended value of
the average cost. The Township may require this cost to be borne by
the property owner. Costs associated with the connection fee may include
materials, rental equipment, labor, inspection, engineering, legal,
and administration.
CUSTOMER FACILITY FEE
The fee for the cost of the facilities from the property
line to the proposed dwelling or building being connected to the Township's
sewer system, referred to as the building sewer. The property owner
is responsible for the installation and cost of the service line beyond
the property line. In the event that the building sewer is constructed
for a single property, the installation will be the responsibility
of the property owner or developer and the cost will be borne by the
same. The Township may be required to provide an inspection to ensure
that the facilities have been installed properly and in conformance
with its regulations. Any costs attendant to inspection will be passed
onto the property owner.
TAPPING FEE
A four-part system of assessing a property owner's cost to
tap into existing utility systems.
1.
CAPACITY PARTThose costs associated with the construction of all treatment facilities related to the system's capacity, such as, interceptors and pumping stations.
2.
DISTRIBUTION/COLLECTION PARTRecovers the costs for the construction for the installation of collection mains, which for purposes of this calculation are considered to be pipe sizes of 10 inches or less.
3.
SPECIAL PURPOSE PARTThis is only applicable to a particular group of customers. It is designed to recover the Township's cost for facilities that serve a special purpose or specific area. Fees are separately calculated for each applicable group and applied to new users as appropriate.
4.
REIMBURSEMENT PARTThis may be charged for new connections to facilities constructed by others for which a reimbursement is due to the person constructing the facilities. Generally, this reimbursement will be defined in a written reimbursement agreement between the Township and the person constructing the facilities. Typically, such agreements reimburse the cost of the excess capacity available for use by future connections.

1. The Township, pursuant to 53 Pa.C.S.A. and Cons. Stat. Ann. § 5607 (Act 57 of 2003), imposes certain enumerated fees, known as Tapping Fees, to property owners who desire to or are required to connect to the Township' s sanitary sewer system. These fees shall be based upon the duly adopted fee schedule set forth in §
18-803 hereinbelow and shall be payable at the time of application for connection or at a time to which the property owner and the Township agree. In the case of projects to serve existing development, fees shall be payable at a time to be determined by the Township.

with PA Act 57 of 2003, the Township imposes Tapping Fees upon property
owners who desire to or arc required to connect to the Township's
sanitary sewer system with said fees being calculated as follows:

fees may be amended from time to time in accordance with PA Act 57
of 2003 by resolution. [NOTE: Note: The Calculation of fees is established
through a comprehensive study undertaken by Upper Macungie Township
entitled "Upper Macungie Township Calculation of the Tapping Fee for
the Sewer System in Accordance with PA Act 57 of 2003, dated December,
2019," said study being on file at the Upper Macungie Township municipal
offices and incorporated herein by reference.]

The provisions of this Part
8 shall be severable, and if any provision, sentence, clause, section or any other part of this Part
8 is finally determined by a court of competent jurisdiction to be unconstitutional, illegal or invalid, then such unconstitutionality, illegality or invalidity shall not affect or impair the constitutionality, legality or validity of any of the remaining provisions, sentences, clauses, sections or parts of this Part
8. It is hereby declared as the legislative intent that this Part
8 would have been adopted had such unconstitutional, illegal or invalid parts not been included.

Any ordinance, resolution, motion, policy statement or parts
of any such ordinance, resolution, motion or policy statement heretofore
adopted which are contrary to or conflict with any provision of this
Part 8 are hereby repealed to the extent necessary to give this Part
8 full force and effect.

This Part 8 shall become official and effective five days after
its adoption and shall remain in full legal force and effect until
amended or repealed by subsequent ordinance.

Allocation purchased from the Township is available for a two-year
period. Applicants that have paid their Allocation Fee but were unable
to connect to the sanitary sewer system within this period may apply
for an extension. The extension is granted by the Western Lehigh Advisory
Committee under the terms of Section 2 of Amendment Number 4 to the
August 4, 1987, Wastewater Treatment Capacity Allocation Agreement.
Any applicant granted an extension will be required to pay the difference
in cost between the Allocation Fee in effect at the time of purchase
and the Allocation Fee in effect at the time of the granting of an
extension.
