Separation of Recyclables. There is hereby established within the Township of Upper Macungie a curbside collection program for separate collection of designated recyclables from all residents of the Township whose municipal waste is collected by or on behalf of the Township. Said curbside collection program shall not apply to any apartment building or complex, other multifamily development or mobile home park containing five or more units whose municipal waste is not collected by or on behalf of the Township. All persons subject to the curbside collection program established pursuant to this Article shall separate all designated recyclables for curbside collection and place them at the curbside at the time, schedule, and manner prescribed in the recycling regulations.
2. 
Preparation of Designated Recyclables. All designated recyclables for curbside collection shall be prepared for curbside collection in accordance with the specifications established in the recycling regulations.
3. 
Recycling Regulations. The Board of Supervisors is hereby authorized to issue and from time to time adopt or revise recycling regulations by resolution to set forth specific requirements for the recycling program, including, without limitation, the designation of recyclables to be included in the curbside collection program, the schedule for curbside collection, time limits for placing recyclables at the curbside, specifications for preparation of designated recyclables for collection, and the effective date for start of the curbside collection program.
4. 
Recycling at Residences Other Than Residential Establishments. All persons residing in apartment buildings or complexes, other multifamily developments and mobile home parks containing five or more units shall separate all designated recyclables for curbside collection from their municipal waste. The owner of these buildings or developments shall be responsible to make arrangements for collection of these recyclables at least once every other week. Such owners shall inform the residents of the requirements of the recycling program and the time, manner, and location where recyclables shall be placed. Such owners shall be required to adhere to the reporting requirements set forth in § 20-109.2.
5. 
Exceptions. Nothing in this Article or the recycling regulations shall prohibit any resident from donating or selling any recyclable to any other person, whether operating for a profit or not for profit.

The designated recyclables for curbside collection are as follows:
A. 
Newspaper.
B. 
Aluminum, bimetal and tin cans.
C. 
Glass.
D. 
HDPE and PETE plastics.
E. 
Magazines and junk mail.
F. 
Cardboard.
G. 
Residential mixed paper.
H. 
Any other recyclables as designated, from time to time by the Board of Supervisors, pursuant to § 20-106.3.

Glass, HDPE plastic and PETE containers shall have caps and lids removed.
2. 
Glass, cans, HDPE plastic, and PETE containers shall be rinsed free of food residues. Glass, cans, HDPE, and PETE shall be placed at the curbside for collection in household storage containers.
3. 
All recyclables shall be co-mingled in the Container.
4. 
Limitations on Recycling Volumes. Occupants of each residential establishment shall be permitted to place one approved container having a maximum of 95+/- total gallons of capacity for curbside collection.
5. 
Containers shall be placed out for collection at the curbside not earlier than 7:00 p.m. and not later than 11:59 p.m. on the day prior to the scheduled collection and shall be removed from the curbside within 24 hours of collection.
6. 
No person shall damage, take, remove, deface or use for purposes other than approved recycling storage and collection any household storage container issued or approved by the Township as part of the recycling program. Should a replacement container(s) be needed or desired, additional containers may be purchased through the Township at a cost set by fee schedule. The Township will not be responsible for any lost, stolen, damaged or destroyed containers.

Commercial, municipal, and institutional establishments, as well as industrial establishments with lunch rooms or offices, and apartment buildings containing more than four units, shall separate high-grade office paper, aluminum, and tin cans, corrugated cardboard, newspapers, HDPE and PETE plastics, glass (clear, green and brown), and leaf waste from their municipal waste and store these materials until collection. These establishments are responsible to provide their own recycling containers and make their own arrangements for collection of recyclables. All licensed food and drink establishments and retail food stores of greater than 1,000 square feet are required to recycle all food and beverage cans and glass.
2. 
Establishments subject to the requirements of Subsection 1 of this § 20-109 shall report the tonnage of each material recycled during each calendar year. Such report shall be submitted on forms provided by the Township by February 1 following the close of each calendar year.
3. 
Pursuant to Act 101, § 1501(c)(iii) [53 P. S. § 4000.1501(c)(1)(iii)], persons occupying commercial, municipal, or institutional establishments shall be exempt from Subsection 1 of this § 20-109 by meeting both of the following:
A. 
Providing for the recycling of all the materials listed in this Section through some means other than herein provided.
B. 
Submitting an annual recycling report to the Township documenting the amount of municipal waste generated and the type and weight of each material that was recycled in the previous calendar year. Valid documentation shall include information from an end-use market, recycler, or waste hauler which describes the type and weight of each recyclable material that was collected and marketed. Documentation may be in the form of one of the following:
(1) 
Copies of weight receipts or statements which consolidate such information.
(2) 
A report from the provider of recycling collection services which identifies the amount of each material collected and marketed. The type and weight of recyclables generated by an individual establishment may be approximated based on a representative sample of its source-separated materials. Where recyclables from several establishments are collected in the same vehicle, an individual establishment's contribution to the load may be apportioned. Only the weight of materials marketed for recycling purposes can be credited to an establishment.
(3) 
A report from the provider of waste collection services that identifies the type and weight of each recyclable material collected and marketed. In cases where recyclables are co-mingled with the establishment's waste, the type and weight of recyclables generated by an individual establishment may be approximated based on a representative sample of its waste. Where materials from several establishments are collected in the same vehicle, an individual establishment's contribution to the load may be apportioned. Only the weight of materials marketed for recycling purposes can be credited to an establishment.
