This Part shall be known and may be cited as the "Open Container
Ordinance."

The purpose of this Part is to promote the general health, safety
and welfare of the inhabitants of Sugarloaf Township by regulating
the use and manner of use of alcoholic beverages in public areas and
by regulating the disposal of beverage containers in public areas.

Except as provided in § 6-104 of this Part, no person shall have, possess, carry or transport any liquor, wine, beer or other alcoholic beverage in any open can, bottle or other open container in or upon any public sidewalk, street, land, highway, building, parking lot, park or recreational area within Sugarloaf Township nor, except as provided in § 6-104 of this Part, shall any person drink or otherwise consume any liquor, wine, beer or other alcoholic beverage in or upon any of the aforesaid public areas of Sugarloaf Township.

1.
Any bona fide organization which has first obtained the required
Pennsylvania Liquor Control Board permit or temporary license and
which desires to have, serve, distribute or allow consumption of alcoholic
beverage in public areas of Sugarloaf Township must apply to the Board
of Supervisors of Sugarloaf Township or its duly authorized representative
and obtain a permit no later than two weeks prior to the date or dates
on which said beverages will be used.

A permit shall be issued only upon the following conditions:
A.
The organization, by its duly authorized officer, must agree, in
writing, to assume full responsibility for supervising the conduct
of the group or individuals benefitting from the permit and to clean
up and restore the premises after use of their original condition.
B.
The organization must further agree, in writing, that adequate precautions
shall be taken to ensure that only those lawfully entitled to consume
or serve alcoholic beverages will be allowed to do so at the permitted
event or gathering.
C.
No alcoholic beverages shall be distributed or consumed other than
on the specific premises described in the permit and only during the
time shown on the permit.
3.
No person shall be issued to any organization which was previously
issued a permit and failed to comply with the conditions set forth
herein, unless specifically authorized by the Board of Supervisors.

No person shall discard alcoholic or other beverage containers
upon any public sidewalk, street, land, parking lot, highway, building,
park or recreational area or other public property within Sugarloaf
Township, except in a place and in the manner approved by the Township.

Any person, firm or corporation who shall violate any provision
of this Part, upon conviction thereof in an action brought before
a Magisterial District Judge in the manner provided for the enforcement
of summary offenses under the Pennsylvania Rules of Criminal Procedure,
shall be sentenced to pay a fine of not more than $1,000, plus costs,
and, in default of payment of said fine and costs, to a term of imprisonment
not to exceed 90 days. Each day that a violation of this Part continues
or each section of this Part which shall be found to have been violated
shall constitute a separate offense.
