Unless the context specifically and clearly indicates otherwise, the meaning of terms used in this Chapter 18 shall be as follows:
ALLENTOWN AGREEMENTS
Collectively, the Agreement, dated December 22, 1969, between the City, as party of the first part, and the County Authority, as party of the second part, and the Loan Agreement, dated December 22, 1969, by and among the City, as party of the first part, and Coplay-Whitehall Sewer Authority, South Whitehall Township Authority, and Salisbury Township Authority, all Pennsylvania municipality authorities, as parties of the second part, and the County, as party of the third part, including any amendments and/or supplements to either or both of said agreements at any time constituting a part of either or both of said agreements.
ALLENTOWN AUTHORITY
Allentown Authority, a Pennsylvania municipality authority.
APPROVAL AUTHORITY
The Regional Administrator of EPA, Region III.
AUTHORIZED AGENT
A Sewage Enforcement Officer, professional engineer, or code enforcement officer who is authorized to function as an agent of the Township to administer or enforce the provisions of this Part.
AUTHORIZED REPRESENTATIVE OF THE USER
A. 
If the user is a corporation:
(1) 
The president, secretary, treasurer or a vice president of the corporation in charge of a principal business function, or any other person who performs similar policymaking or decision-making functions for the corporation.
(2) 
The manager of one or more manufacturing, production, or operating facilities, provided that the manager is authorized to make management decisions that govern the operation of the regulated facility, including having the explicit or implicit duty of making major capital investment recommendations, and initiate and direct other comprehensive measures to assure long-term environmental compliance with environmental laws and regulations; can ensure that the necessary systems are established or actions taken to gather complete and accurate information for wastewater discharge permit requirements; and where authority to sign documents has been assigned or delegated to the manager in accordance with corporate procedures.
B. 
If the user is a partnership or sole proprietorship, a general partner or proprietor, respectively.
C. 
If the user is a federal, state or local government facility, a director or highest official appointed or designated to oversee the operation and performance of the activities of the government facility or its designee.
D. 
The individuals described in Subsections A through C, above, may designate another authorized representative if the authorization is in writing, the authorization specifies the individual or position responsible for the overall operation of the facility from which the discharge originates or having overall responsibility for environmental matters for the company, and the written authorization is submitted to the Township and the City.
BEST MANAGEMENT PRACTICES or BMPs
Schedules of activities, prohibitions of practices, maintenance procedures, and other management practices to implement the prohibitions listed in § 18-305, Subsections 2 and 3 [40 CFR 403.5(a)(1) and (b)]. BMPs include treatment requirements, operating procedures, management plans, and practices to control the discharge of pollutants.
BILLING UNIT
Includes, as applicable, each of the following: a "commercial establishment," a "dwelling unit," an "industrial establishment" and an "institutional establishment."
BIOCHEMICAL OXYGEN DEMAND
The quantity of oxygen, expressed in ppm or mg/1, utilized in the biochemical oxidation of organic matter under standard laboratory procedure for five days at 20° C. The standard laboratory procedure shall be that found in the latest edition of "Standard Methods for the Examination of Water and Wastewater" published by the American Public Health Association.
BOARD
The Board of Supervisors of Upper Macungie Township, Lehigh County, Pennsylvania.
BOD
An abbreviation for "Biochemical Oxygen Demand."
BUILDING SEWER
The sewer or sewers from the building drain to the connection point at the public sewer lateral. A Building Sewer shall also mean a Private Sewer Lateral.
BYPASS
The intentional diversion of waste streams from any portion of a user's treatment facility.
CATEGORICAL INDUSTRIAL USER
An industrial user subject to a categorical pretreatment standard or categorical standard.
CATEGORICAL PRETREATMENT STANDARD or CATEGORICAL STANDARD
Any regulation containing pollution discharge limits promulgated by EPA in accordance with § 307(b) and (c) of the Clean Water Act (33 U.S.C. § 1317) which apply to a specific category of users and which appear in 40 CFR, Chapter 1, Subchapter N, Parts 405 through 471.
CFR
Abbreviation for "Code of Federal Regulations."
CITY
The City of Allentown, Lehigh County, Pennsylvania, or the City Council of Allentown.
CLEAN WATER ACT
The Federal Water Pollution Control Act, also known as the Clean Water Act, as amended, 33 U.S.C. § 1251 et seq.
COD
Abbreviation for "Chemical Oxygen Demand." A measure of the oxygen required to oxidize all compounds, both organic and inorganic, in water.
COMMERCIAL ESTABLISHMENT
Any room, group of rooms, building or enclosure used or intended for use in the operation of one business enterprise for the sale and distribution of any product, commodity, article or service or used or intended for use for any social, amusement, religious, educational, charitable or public purpose and containing plumbing facilities for kitchens, toilet or washing facilities.
COMMUNITY SEWAGE SYSTEM
Any system, whether publicly or privately owned, for the collection of sewage from two or more lots and the treatment and/or disposal of the sewage on one or more lots or at any other site.
COMPLIANCE
Compliance with the provisions of the ordinance set forth herein, and any amendments thereto as well as Upper Macungie Township Ordinance 2007-6 and with § 18-305 of the Upper Macungie Township Code of Ordinances.
COMPOSITE SAMPLE
Samples collected at regular intervals, sometimes in proportion to the existing flow, and then combined to form a sample representative of flow over a period of time.
CONTROL AUTHORITY
The City of Allentown.
COUNTY
The County of Lehigh, Pennsylvania.
COUNTY AUTHORITY
Lehigh County Authority, a Pennsylvania municipality authority.
DAILY MAXIMUM
The arithmetic average of all effluent samples for a pollutant collected during a calendar day.
DAILY MAXIMUM LIMIT
The maximum allowable discharge limit of a pollutant during a calendar day. Where daily maximum limits are expressed in units of mass, the daily discharge is the total mass discharged over the course of the day. Where daily maximum limits are expressed in terms of concentration, the daily discharge is the arithmetic average measurement of the pollutant concentration derived from all measurements taken that day.
DEDUCT METER
A second water meter on a customer's property where the customer pays for the water usage through the meter, but not wastewater usage, as the water that passes through this meter does not go to the sanitary lateral for treatment at the treatment facility.

DEPARTMENT
The Department of Environmental Protection of the Commonwealth of Pennsylvania (DEP).
DIRECTOR OF PUBLIC WORKS
The person designated by the City to supervise the operation of the POTW and who is charged with certain duties and responsibilities by this Part. The term also means a duly authorized representative of the Director of Public Works.
DWELLING UNIT
Any room, group of rooms, building or other enclosure occupied or intended for occupancy as separate living quarters by a family or other group of persons living together or by a person living alone.
EMPLOYEES
Such employees or designated representative or officials of the UMT shall, from time to time, designate and utilize in making the inspection and/or tests hereafter described in carrying out the other duties as prescribed herein to be performed on behalf of UMT.
ENVIRONMENTAL PROTECTION AGENCY or EPA
The United States Environmental Protection Agency or, where appropriate, the Regional Water Protection Division Director or other duly authorized official of said agency.
EXISTING SOURCE
Any source of discharge that is not a new source.
FOG
Abbreviation for "Fats, Oils and Grease."
FOOD SERVICE FACILITY
A facility or establishment, other than a residential dwelling, regularly engaged in activities of preparing or serving or otherwise making food available for consumption which uses one or more of the following preparation techniques: cooking by frying (all methods); baking (all methods), grilling, sauteing, rotisserie cooking, broiling (all methods), boiling, blanching, roasting, toasting, or poaching. Also included as a technique and for purposes of this definition are infrared heating, searing, barbecuing, and any other food preparation activity which produces a non-drinkable food product in or on a receptacle that requires washing. These facilities include restaurants, cafeterias, hotels, motels, hospitals, nursing homes, schools, grocery stores, prisons, jails, churches, camps, caterers, concessions, manufacturing plants, or any other sewer customers which discharge, or are likely to discharge, grease into the system.
GARBAGE
Solid wastes resulting from preparation, cooking, and dispensing of food and from handling, storage, and sale of produce.
GPD
Abbreviation for "Gallons Per Day."
GRAB SAMPLE
A sample which is taken from a waste stream without regard to flow and over a period of time not to exceed 15 minutes.
GREASE
Material composed primarily of fats, oil, and grease from animal or vegetable sources. The terms "fats," "oil," and "grease" may be used interchangeably in this chapter under this single definition.
GREASE TRAP OR INTERCEPTOR
A device for separating and retaining waterborne grease and grease complexes prior to the wastewater exiting the trap and entering the system. These devices also serve to collect settleable solids, generated by and from food preparation and other activities which discharge grease, prior to water exiting the trap and entering the system.
HOLDING TANK
A watertight receptacle which receives and retains sewage and is designed and constructed to facilitate ultimate disposal of the sewage at another site. Holding tanks include but are not limited to the following:
A. 
Chemical toilet, which is a toilet using chemicals that discharge to a holding tank.
B. 
Retention tank, which is a holding tank where sewage is conveyed to it by a water-carrying system.
C. 
Vault pit privy, which is a holding tank designed to receive sewage where water under pressure is not available.
IMPROVED PROPERTY
Any property upon which there is erected a structure intended for continuous or periodic habitation, occupancy or use by human beings or animals and from which structure sanitary sewage and/or industrial wastes shall be or may be discharged.
INDIRECT DISCHARGE or DISCHARGE
The introduction of pollutants into the POTW from any nondomestic source regulated under § 307(b), (c) or (d) of the Clean Water Act.
INDIVIDUAL SEWAGE SYSTEM
Any system of piping, tanks or other facilities serving a single lot and collecting and disposing of sewage in whole or in part into the soil or into any waters of the Commonwealth.
INDUSTRIAL ESTABLISHMENT
Any room, group of rooms, building or other enclosure used or intended for use, in whole or in part, in the operation of one business enterprise for manufacturing, fabricating, processing, cleaning, laundering or assembling any product, commodity or article or from which any process waste, as distinct from sanitary sewage, shall be discharged.
INDUSTRIAL WASTE MANAGER
The Director of Public Works or a person designated by the Director of Public Works who is charged with certain duties and responsibilities by the ordinance.
INDUSTRIAL WASTES
Any solid, liquid or gaseous substance or waterborne wastes or form of energy rejected or escaping in the course of any industrial, manufacturing, trade or business process or in the course of the development, recovery or processing of natural resources, as distinct from sanitary sewage.
INSTANTANEOUS MAXIMUM ALLOWABLE DISCHARGE LIMIT
The maximum concentration of a pollutant allowed to be discharged at any time, determined from the analysis of any discrete or composited sample collected, independent of the industrial flow rate and the duration of the sampling event.
INSTITUTIONAL ESTABLISHMENT
Any room, group of rooms, building or other enclosure which does not constitute a commercial establishment, a dwelling unit, or an industrial establishment.
INTERCEPTOR SYSTEM
A system of interceptor sewers being acquired and constructed by County Authority and leased to the County for use and operation, to which interceptor system the sewer system is to be connected for the purpose of receiving sewage and wastes collected in the sewer system and transporting the same to the sewer system owned by the Allentown Authority and leased to the City for the purpose of further transportation, treatment and disposal pursuant to the Allentown Agreements.
INTERFERENCE
A discharge which, alone or in conjunction with a discharge or discharges from other sources, inhibits or disrupts the POTW, its treatment processes or operations or its biosolids processes, use or disposal and, therefore, is a cause of a violation of the City's NPDES permit or of the prevention of sewage biosolids use or disposal in compliance with any of the following statutory/regulatory provisions or permits issued thereunder or any more stringent state or local regulations: § 405 of the Clean Water Act; the Solid Waste Disposal Act, including Title II, commonly referred to as the "Resource Conservation and Recovery Act (RCRA)"; and state regulations contained in any state biosolids management plan prepared pursuant to Subtitle D of the Solid Waste Disposal Act; the Clean Air Act; the Toxic Substances Control Act; and the Marine Protection, Research and Sanctuaries Act.
LOCAL LIMIT
Specific discharge limits developed and enforced by the City upon industrial or commercial facilities to implement the general and specific discharge prohibitions listed in 40 CFR 403.5(a)(1) and (b).
MALFUNCTION
The condition which occurs when an on-lot sewage disposal system discharges sewage onto the surface of the ground, into groundwaters of this Commonwealth or into surface waters of this Commonwealth, backs up into a building connected to the system or in any manner causes a nuisance or hazard to the public health or pollution of ground- or surface water or contamination of public or private drinking water wells. A system shall be considered to be malfunctioning if any condition noted above occurs for any length of time during any period of the year.
MEDICAL WASTE
Isolation wastes, infection agents, human blood and blood products, pathological wastes, sharps, body parts, contaminated bedding, surgical wastes, potentially contaminated laboratory wastes and dialysis wastes.
mg/l
Milligrams per liter.
MONTHLY AVERAGE
The sum of all daily discharges measured during a calendar month divided by the number of daily discharges measured during that month.
MONTHLY AVERAGE LIMIT
The highest allowable average of daily discharges over a calendar month, calculated as the sum of all daily discharges measured during a calendar month divided by the number of daily discharges measured during that month.
MULTIPLE UNIT
Any improved property in which shall be located more than one billing unit.
MUNICIPALITY
Upper Macungie Township, Lehigh County, Pennsylvania.
NEW SOURCE
A. 
Any building, structure, facility or installation from which there is (or may be) a discharge of pollutants, the construction of which commenced after the publication of proposed pretreatment standards under § 307(c) of the Clean Water Act which will be applicable to such source if such standards are thereafter promulgated in accordance with that section, provided that:
(1) 
The building, structure, facility, or installation is constructed at a site at which no other source is located;
(2) 
The building, structure, facility, or installation totally replaces the process or production equipment that causes the discharge of pollutants at an existing source; or
(3) 
The production or wastewater-generating process of the building, structure, facility, or installation is substantially independent of an existing source at the same site. In determining whether these are substantially independent, factors such as the extent to which the new facility is integrated with the existing plant and the extent to which the new facility is engaged in the same general type of activity as the existing source should be considered.
B. 
Construction on a site at which an existing source is located results in a modification rather than a new source if the construction does not create a new building, structure, facility or installation meeting the criteria of A(2) or (3), above, but otherwise alters, replaces or adds to existing process or production equipment.
C. 
Construction of a new source, as defined under this section, has commenced if the owner or operator has:
(1) 
Begun, or caused to begin, as part of a continuous on-site construction program:
(a) 
Any placement, assembly or installation of facilities or equipment.
(b) 
Significant site preparation work, including clearing, excavation or removal of existing buildings, structure or facilities which is necessary for the placement, assembly or installation of new source facilities or equipment.
(2) 
Entered into a binding contractual obligation for the purchase of facilities or equipment which are intended to be used in its operation within a reasonable time. Options to purchase or contracts which can be terminated or modified without substantial loss, and contracts for feasibility, engineering, and design studies, do not constitute a contractual obligation under this subsection.
NONCONTACT COOLING WATER
Water used for cooling which does not come into direct contact with any raw material, intermediate product, waste product or finished product.
NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS)
A classification pursuant to the North American Industry Classification System Manual issued by the United States Office of Management and Budget.
NOTICE
Advising when inspections and tests of the system should be performed by UMT.
NPDES
Abbreviation for "National Pollutant Discharge Elimination System."
OFFICIAL SEWAGE FACILITIES PLAN
A comprehensive plan for the provision of an adequate sewage disposal system adopted by the Board and approved by the DEP, pursuant to the Pennsylvania Sewage Facilities Act.
OIL/WATER SEPARATOR
A device that is specifically designed and manufactured to separate oil from water and permits the oil to be collected and removed on a regular basis so as to prevent it from being discharged into the system.
ON-LOT SEWAGE DISPOSAL SYSTEM
Any system for disposal of domestic sewage involving pretreatment and subsequent disposal of the clarified sewage into a subsurface soil absorption area or retaining tank; this term includes both individual sewage systems and community sewage systems.
OWNER
Any person vested with ownership, legal or equitable, sole, or partial, of any property located in the Township.
PASSTHROUGH
A discharge which exits the POTW into waters of the United States in quantities or concentration which, alone or in conjunction with a discharge or discharges from other sources, is a cause of a violation of any requirement of the City's NPDES permit, including an increase in the magnitude or duration of a violation.
PERSON
Any individual, association, public or private corporation for profit or not for profit, partnership, co-partnership, firm, joint-stock company, society, trust, estate, department, board, bureau or agency of the Commonwealth, political subdivision, municipality, district, authority, or any other legal entity whatsoever which is recognized by law as the subject of rights and duties, or their legal representatives, agents or assigns. This definition includes all federal, state, and local governmental entities. Whenever used in any clause prescribing and imposing a penalty or imposing a fine or imprisonment, the term "person" shall include the members of an association, partnership or firm and the officers of any local or municipal, public or private corporation for profit or not for profit.
pH
The logarithm of the reciprocal of the weight of hydrogen ions, expressed in grams per liter of solution, and indicates the degree of acidity or alkalinity of a substance.
POLLUTANT
Dredged spoil, solid waste, incinerator residue, filter backwash, sewage, garbage, sewage biosolids, munitions, medical wastes, chemical wastes, biological materials, radioactive materials, heat, wrecked or discarded equipment, rock, sand, cellar dirt, municipal, agricultural and industrial wastes and certain characteristics of wastewater (including, but not limited to, pH, TSS, turbidity, color, BOD, COD, toxicity or odor).
PPM
Abbreviation for "Parts per million," by weight.
PRETREATMENT
The reduction of the amount of pollutants, the elimination of pollutants or other alteration of the nature of pollutant properties in wastewater prior to, or in lieu of, introducing such pollutants into the POTW. This reduction or alteration can be obtained by physical, chemical, or biological processes, by process changes or by other means, except by diluting the concentration of the pollutants unless allowed by an applicable pretreatment standard.
PRETREATMENT REQUIREMENTS
Any substantive or procedural requirement related to pretreatment imposed on a user, other than a pretreatment standard.
PRETREATMENT STANDARDS or STANDARDS
Prohibited discharge standards, categorical pretreatment standards and local limits.
PRIVATE LATERAL SEWER LINE
The sewer line owned, maintained, and controlled by the property owner, which sewer line commences at its connection to the system.
PROHIBITED DISCHARGE STANDARDS or PROHIBITED DISCHARGES
Absolute prohibitions against the discharge of certain standards. These prohibitions appear in § 18-305.
PROPERLY CHOPPED GARBAGE
Garbage that has been chopped to such a degree that all its particles will be carried freely under normal sewer flow conditions, with no particle greater than 1/2 inch in any dimension.
PUBLICLY OWNED TREATMENT WORKS (POTW)
A "treatment works," as defined in § 212 of the Clean Water Act (33 U.S.C. § 1292), which is owned by the City or any municipality which contributes wastewater to the City's system. This definition includes any devices or systems used in the collection, storage, treatment, recycling and reclamation of sewage or industrial wastes of a liquid nature and any conveyances which convey wastewater to a treatment plant.
PUMPER/HAULER
Any person, company, partnership or corporation which engages in cleaning community or individual sewage systems and transports the septage cleaned from these systems and who has registered with the Township and a current member in good standing of the Pennsylvania Septage Management Association.
RCRA
Abbreviation for the "Resource Conservation and Recovery Act."
REGULATED FACILITY
Each food service facility, and all other customers of the Township, which contribute discharges or accumulate grease which enters the system. The term "regulated facility" shall not include residential dwellings.
REHABILITATION
The work done to modify, alter, repair, enlarge or replace an existing on-lot sewage disposal system.
REPLACEMENT AREA
A portion of a lot or a developed property, sized to allow the installation of an on-lot sewage disposal system, which is reserved to allow that installation in the event of the malfunction of the presently installed on-lot sewage disposal system.
SANITARY SEWAGE
The normal water-carried household and toilet wastes from any improved property.
SEPTAGE
The sewage, residual scum and sludge pumped from on-lot disposal systems.
SEPTIC TANK WASTE
Any sewage from holding tanks, such as vessels, chemical toilets, campers, trailers, and septic tanks.
SEVERE PROPERTY DAMAGE
Substantial physical damage to property, damage to the treatment facilities which causes them to become inoperable, or substantial and permanent loss of natural resources which can reasonably be expected to occur in the absence of a bypass. "Severe property damage" does not mean economic loss caused by delays in production.
SEWAGE
Any substance that contains gray water (household showers, dish-washing operations, etc.) or any of the waste products or excrement or other discharge from the bodies of human beings or animals and any noxious or deleterious substances being harmful or inimical to the public health, or to animal or aquatic life, or to the use of water for domestic water supply or for recreation or which constitutes pollution under the Act of June 22, 1937 (P.L. 1987, No. 394), known as the "Clean Streams Law," as amended.
SEWAGE ENFORCEMENT OFFICER (SEO)
A person certified by DEP who is appointed by the Township. Such person is authorized to conduct investigations and inspections, review permit applications, issue or deny permits and do all other activities as may be provided for such person in the Sewage Facilities Act, the rules and regulations promulgated thereunder and this Part or any other ordinance adopted by the Township.
SEWAGE MANAGEMENT DISTRICT
Any area or areas of the Township designated in the Official Sewage Facilities Plan adopted the Board as an area for which a Sewage Management Program and Ordinance is to be implemented.
SEWAGE MANAGEMENT PROGRAM
A comprehensive set of legal and administrative requirements encompassing the requirements of this Part, the Sewage Facilities Act, the Clean Streams Law, the regulations promulgated thereunder and such other requirements adopted by the Board to effectively enforce and administer this Part.
SEWAGE PERMIT
A document issued for the local agency by the SEO when proper application, fee, test results, field investigations, a suitable system design and other requested information by the Township have all been provided to the SEO in accordance with Pa.Code Title 25, Chapter 72, and the Administration of Sewage Facilities Permitting Program.
SEWAGE TREATMENT PLANT
The plant and facilities owned by Allentown Authority and leased to the City for operation and use for the purpose, inter alia, of treatment and disposition of sanitary sewage and certain industrial wastes which may be collected in the sewer system and ultimately delivered to said plant and facilities, including all additions thereto.
SEWER
Any pipe, main or conduit constituting a part of the sewer system and used or usable for collection and transportation of sanitary sewage and industrial wastes.
SEWER CLEANOUT
A capped pipe that provides access to a lateral sewer line. The capped pipe is typically used for accessing the lateral sewer line to clean out blockages.
SEWER LATERAL, PRIVATE
See definition of "Building Sewer" hereinabove.
SEWER LATERAL, PUBLIC
The sewer line starting at the connection point to the Township's sanitary sewer conveyance system to a point located at the right-of-way line of the property.
SEWER SYSTEM
All facilities within the Township, as of any particular time, for collecting, transporting, pumping, treating, or disposing of wastewater which is ultimately conveyed for treatment to the City's wastewater treatment plant.
SEWER SYSTEM
All facilities, as of any particular time, for collecting, transporting, pumping and disposing of sanitary sewage and industrial wastes, situate in or adjacent to the Township, owned by the Authority and leased to this Township for operation and use.
SIGNIFICANT INDUSTRIAL USER (SIU)
Except as provided in Subsections C and D of this definition, a significant industrial user is:
A. 
An industrial user subject to categorical pretreatment standards.
B. 
An industrial user that:
(1) 
Discharges an average of 25,000 gallons per day or more of process wastewater to the POTW (excluding sanitary, noncontact cooling water and boiler blowdown wastewater).
(2) 
Contributes a process waste stream which makes up 5% or more of the average dry weather hydraulic or organic capacity of the POTW treatment plant.
(3) 
Is designated as such by the City or the Township on the basis that it has reasonable potential for adversely affecting the POTW's operation or for violating any pretreatment standard or requirement.
C. 
The City may determine that an industrial user subject to categorical pretreatment standards is a nonsignificant categorical industrial user rather than a significant industrial user on a finding that the industrial user never discharges more than 100 gallons per day (gpd) of total categorical wastewater (excluding sanitary, noncontact cooling and boiler blowdown wastewater, unless specifically included in the pretreatment standard) and the following conditions are met:
(1) 
The industrial user, prior to City's finding, has consistently complied with all applicable categorical pretreatment standards and requirements;
(2) 
The industrial user annually submits the certification statement required in § 18-443, Subsection 2B [see 40 CFR 403.12(q)], together with any additional information necessary to support the certification statement; and
(3) 
The industrial user never discharges any untreated concentrated wastewater.
D. 
Upon a finding that a user meeting the criteria in Subsection B has no reasonable potential for adversely affecting the POTW's operation or for violating any pretreatment standard or requirement, the Township and the City may at any time, on its own initiative or in response to a petition received from a user, and in accordance with procedures in 40 CFR 403.8(f)(6), determine that such user should not be considered a significant industrial user.
SLUG LOAD or SLUG DISCHARGE
Any discharge at a flow rate or concentration which could cause a violation of the prohibited discharge standards in § 18-405. A slug discharge is any discharge of a nonroutine, episodic nature, including but not limited to an accidental spill or a noncustomary batch discharge, which has a reasonable potential to cause interference or passthrough, or in any other way violate the POTW's regulations, local limits or permit conditions.
STANDARD INDUSTRIAL CLASSIFICATION (SIC) CODE
A classification pursuant to the Standard Industrial Classification Manual issued by the United States Office of Management and Budget.
STORMWATER
Any flow occurring during or following any form of natural precipitation and resulting from such precipitation, including snowmelt.
SUBDIVISION
The division or subdivision of a lot, tract, or parcel of land into two or more lots, tracts, parcels, or other divisions of land, including changes in existing lot lines. The enumerating of lots shall include as a lot that portion of the original tract or tracts remaining after other lots have been subdivided therefrom. For the purpose of this Part, this term shall also mean a land development.
SUMP PUMP
Any pump connected to the sanitary sewer system which is being used to pump groundwater/stormwater into the sanitary sewer system.
SUSPENDED SOLIDS
Solids neither dissolved nor floating on the surface of the liquid, as determined by appropriate procedures found in the latest edition of "Standard Methods for the Examination of Water and Wastewater" published by the American Public Health Association.
SYSTEM
All of the facilities for collecting, pumping, and disposing of sanitary sewage which is owned by the UMT within the sanitary sewer service area of the UMT.
TKN
Abbreviation for "Total Kjeldahl Nitrogen."
TOTAL KJELDAHL NITROGEN or TKN
The sum of free-ammonia and of organic nitrogen compounds which are converted to ammonium sulfate (NH4)2S04 under conditions specified by Standard Methods 20th Edition, Method 4500 or EPA Method 351.
TOTAL SOLIDS
All solids as determined by appropriate procedures found in the latest edition of "Standard Methods for the Examination of Water and Wastewater" published by the American Public Health Association.
TOTAL SUSPENDED SOLIDS or SUSPENDED SOLIDS
The total suspended matter that floats on the surface of, or is suspended in, water, wastewater, or other liquids and which is removable by laboratory filtering.
TOWNSHIP
The Township of Upper Macungie, Lehigh County, Pennsylvania, a municipality of the Commonwealth of Pennsylvania, acting by and through its Board of Supervisors or, in appropriate cases, acting by and through its authorized representatives.
TOXIC SUBSTANCE
Any poisonous substance, including copper, cyanide, chromium, beryllium, cadmium, lead, nickel, tin and zinc ions, and any phenolic bodies or radioactive isotopes.
TSS
Abbreviation for "Total Suspended Solids."
U.S.C.
Abbreviation for "United States Code."
UMT
Abbreviation for "Upper Macungie Township."
USER
The owner, lessee, or occupant of the property on which the buildings and/or appurtenances that are connected to the system are located.
USER or INDUSTRIAL USER
A source of indirect discharge.
WASTEWATER
Liquid and water-carried industrial wastes and sewage from residential dwellings, commercial buildings, industrial and manufacturing facilities, and institutions, whether treated or untreated, which are contributed to the POTW.
WASTEWATER TREATMENT PLANT or TREATMENT PLANT
That portion of the POTW which is designed to provide treatment of municipal sewage and industrial waste.
WATER SYSTEM
The facilities owned by any person and used for the supply of water to the public in the Township.

Any term not defined herein shall have that meaning found in the Sewage Facilities Act; the Municipalities Planning Code and regulations promulgated thereto, unless the context clearly indicates otherwise.
