A. 
Declaration of snow emergency.
(1) 
In order to allow for the movement of emergency vehicles and in order to effectively deal with the hazards and existence of excessive snow or ice on Borough Streets, the Mayor, or his/her designees, including the Street Committee Chair, Police Chief or Council President, in his/her discretion, may declare an emergency where six inches of snow or substantial ice has accumulated or under any other circumstances which warrant the undertaking of extreme caution, care and concern in combatting inclement weather.
(2) 
The Mayor or his/her designee shall disseminate to the general public through the appropriate media source(s) any and all necessary information as to the existence and circumstances of such emergency.
B. 
Snow emergency routes. In order to allow for the movement of emergency vehicles and in order to effectively deal with the hazards and existence of excessive snow/ice on Borough streets, the following shall be designated as snow emergency routes: Amidon, Chestnut, Coal, Elm, Fell, Holland, Hazard, Lehigh, Linden, Ludlow, Market, Pine, Poplar, Oak, Spruce, Walnut, Walter, White and Vernon Streets.
C. 
Vehicle travel restrictions. At any time during the existence of any emergency herein declared by the Mayor or his/her designee, it shall be unlawful for any person to operate a vehicle on the streets of the Borough unless classified as an approved vehicle as defined in Article II, Paragraph a) of this chapter.[1]

D. 
Parking restrictions. At any time during the existence of any emergency herein declared by the Mayor or his/her designee, and in order to facilitate the effective clearing of streets and parking areas, the following restrictions shall be in place:
(1) 
No parking on the south and east sides of any snow emergency routes (odd-numbered sides) until such time as the streets and south and east sides are cleared and the parking ban is lifted by the Mayor or his/her designee;
(2) 
Once the streets are opened and the south and east sides of the streets are cleared, in order to clear the north and west sides of any snow emergency routes (even-numbered sides), it shall be unlawful to park on the north and west sides until the parking ban is lifted by the Mayor or his/her designee;
(3) 
During any declaration of emergency, there shall be no parking in any alleys of the Borough until such time as they are cleared of and/or treated for snow/ice and the parking ban is lifted by the Mayor or his/her designee
A. 
Purpose. The following rules, regulations and procedures in this section are hereby enacted and implemented in order to effectively deal with snow and/or ice accumulation and the clearing and/or treatment of Borough streets in nonemergency situations.
B. 
Clearing streets.
(1) 
It shall be the responsibility of the Borough to treat and clear any streets in the Borough in the event an accumulation of snow in excess of three inches occurs or substantial ice builds up on the street surfaces. The opening of all snow emergency routes shall be of utmost priority to effectively maneuver vehicles for purposes of compliance with this chapter;
(2) 
In order to begin clearing Borough Streets, with the exception of the 200 block of West Holland Street, it shall be unlawful for any vehicle to be parked on the odd-numbered (south and east) sides of any Borough streets between the hours of 8:00 a.m. and 6:00 p.m. during any snow/ice storm where there has been an accumulation of three inches or more; those sides shall remained free of vehicles until such time as they have been cleared by the Borough; in the event an additional accumulation of three inches results, then the same procedures apply as set forth herein;
(3) 
It shall be unlawful for any vehicles to park on the even-numbered (north and west) sides of any Borough Street between the hours of 8:00 a.m. and 6:00 p.m. on the day following the clearing of the opposite (south and east) side of the street and until such time as those (even-numbered) sides are cleared;
(4) 
Except as otherwise provided herein, at no time after the accumulation of three inches of snow or during a snow/ice storm shall any vehicle be parked in any alley in the Borough until such time as the alley is treated and cleared by the Borough. In the event the snow accumulation reaches three inches or the ice begins to build up before 8:00 a.m., all vehicles must be removed by 8:00 a.m. and remain so removed until the alley is treated and cleared.
In order to eliminate the potential for safety hazards for vehicles travelling within the Borough, it shall be unlawful for any person to throw, shovel, push, plow or otherwise place any snow/ice onto any Borough street, except as authorized by the Chief of Police or his designee.
The Borough of Summit Hill adopts the snow emergency plan attached to this chapter as the official Snow Emergency Plan for the Borough.[1]

A. 
Fines. Any person who shall violate any provision of this section shall, upon conviction thereof, be subject to the applicable fees, costs and/or penalties as set by resolution of the Council of the Borough of Summit Hill, and which such fees, costs and/or penalties may be revised from time to time by resolution of the Council of the Borough of Summit Hill as it deems necessary and appropriate.
B. 
Penalties in lieu of payment of fines. In default of the payment of any such fine(s) and cost(s) in full within 30 days after conviction, and in lieu of payment thereof, such person shall be subject to a period of incarceration in the Carbon County Correctional Facility for a period of not less than 48 hours nor more than 10 days per violation.
C. 
Removal of vehicles in violation.
(1) 
It is within the sole discretion of the Chief of Police or his/her designee to ticket and/or tow any vehicle in violation of any parking restrictions set forth in this chapter;
(2) 
It shall be a prerequisite to the release of any vehicle from storage after being towed for being in violation of any section of Article IV that all towing/storage costs be paid in full by the record owner or driver.
