A. 
Creation of committees; defining responsibility and membership. The Legislature hereby establishes the following main committees of the Legislature:
(1) 
Housing Committee, whose responsibility shall include all matters concerning housing and people who are homeless. The Committee shall consist of the following members:
(a) 
Two legislative members nominated by the Chairperson;
(b) 
Supervisor of Tribal Utilities, Land Management Director, and Housing Director; and
(c) 
Two community tribal members as appointed by the Menominee Tribal Legislature for a term of two years. The appointments will be staggered, and one community member will be appointed every year.
(2) 
Governmental Affairs Committee, whose responsibility shall include all matters concerning the governmental organization of the Tribe. The Committee shall consist of the following members:
(a) 
Two legislative members nominated by the Chairperson;
(b) 
The Tribal Administrator, Human Resources Director, Financial Manager, and Information Technology Director; and
(c) 
Two community tribal members as appointed by the Menominee Tribal Legislature for a term of two years. The appointments will be staggered, and one community member will be appointed every year.
(3) 
Community Development Committee, whose responsibility shall include the development of the Tribe's infrastructure and the local economy. The Committee shall have, among other responsibilities, responsibility to review and approve requests for use of tribally owned outdoor venues, and assess or waive fees related to the use of those venues. The Committee shall consist of the following members:
(a) 
Two legislative members nominated by the Chairperson;
(b) 
Community Development Director, Housing Director, Transportation Director, Director of Historic Preservation, Director of Environmental Services, Land Management Director; and
(c) 
Two community tribal members as appointed by the Menominee Tribal Legislature for a term of two years. The appointments will be staggered, and one community member will be appointed every year.
(4) 
Law Enforcement and Resource Protection Committee, whose responsibility shall include all matters concerning law enforcement and resource protection. The Committee shall have, among other responsibilities, the responsibility to set Reservation-wide trick-or-treat hours. The Committee shall consist of the following members:
(a) 
Two legislative members nominated by the Chairperson;
(b) 
Prosecutor, Probation Director, Conservation Director, Environmental Services Director, and Jail Administrator; and
(c) 
Two community tribal members as appointed by the Menominee Tribal Legislature for a term of two years. The appointments will be staggered, and one community member will be appointed every year.
(5) 
Health and Family Services Committee, whose responsibility shall include all matters concerning health and family services programming. The Committee shall consist of the following members:
(a) 
Two legislative members nominated by the Chairperson;
(b) 
The Director of Family Services, Maehnowesekiyah Wellness Center Coordinator, Clinic Administrator, Aging and Long-Term Care Director; and
(c) 
Two community tribal members as appointed by the Menominee Tribal Legislature for a term of two years. The appointments will be staggered, and one community member will be appointed every year.
(6) 
Labor, Education and Training Committee, whose responsibility shall include all matters concerning labor, education and training programming. The Committee shall consist of the following members:
(a) 
Two legislative members nominated by the Chairperson;
(b) 
The Director of Early Childhood Services, Tribal School Administrator/Principal, Education Director, Community Resource Center Director, and Youth Services Director; and
(c) 
Two community tribal members as appointed by the Menominee Tribal Legislature for a term of two years. The appointments will be staggered, and one community member will be appointed every year.
(7) 
Budget and Finance Committee, whose responsibility shall include the monitoring and development of the tribal budget. The Committee shall consist of the following members:
(a) 
Three legislative members nominated by the Chairperson;
(b) 
The Financial Manager, Tribal Administrator, Director of Lending and Tribal Tax; and
(c) 
Two community tribal members as appointed by the Menominee Tribal Legislature for a term of two years. The appointments will be staggered, and one community member will be appointed every year.
(8) 
Agriculture and Forestry Committee, whose responsibility shall include all matters concerning forest and agricultural management and development. The Committee shall consist of the following members:
(a) 
Two legislative members nominated by the Chairperson;
(b) 
The Conservation Director, Environmental Services Director, Director of Historic Preservation, the Director of Agriculture and Food Systems, an MTE Board of Director member or staff member as appointed by the MTE Board of Directors; and
(c) 
Two community tribal members as appointed by the Menominee Tribal Legislature for a term of two years. The appointments will be staggered, and one community member will be appointed every year.
B. 
Duties of committee.
(1) 
A committee of the Legislature may:
(a) 
Investigate and research any issue assigned to it by the Tribal Chairperson or the Legislature;
(b) 
Review and approve, without the need for legislative concurrence, general policies implemented by programs or departments within said committee's subject area, provided those policies have also been reviewed and approved for contract and tribal policy compliance by the Tribe's Administrative Committee.
(c) 
Research and investigate potential funding sources for tribal programs or departments;
(d) 
Report any findings to the Tribal Chairperson;
(e) 
Set dates, without the need for legislative concurrence, for community-wide events sponsored by departments who report to the committee;
(f) 
Recommend to the Administrative Committee the granting of administrative leave, for employees or select groups of employees, to participate in community events;
(g) 
Perform any function granted to it pursuant to a tribal ordinance or policy; and
(h) 
Organize subcommittees for special tasks, subject to approval by the Tribal Legislature. Payments for subcommittee meetings shall be made in conformance with all committee payment policies at the committee payment rate, provided that scheduled meetings were approved by the Tribal Chairperson.
(2) 
The committee and its members shall perform these functions in accordance with all applicable tribal and federal law.
C. 
Bylaws. Committees of the Legislature shall be governed by the bylaws which will identify how often the committee will meet on an annual basis.
D. 
Limitation on powers. Pursuant to Bylaw I, Section 2 of the Menominee Tribal Constitution and Bylaws, legislative committees shall only have the power to advise the Legislature. Legislative committees shall not interfere with the day-to-day management of any tribal program or department within their subject area. Legislative committees, except as provided in Subsection F below, do not have the authority to direct any employee of the Menominee Indian Tribe in regard to the performance of his or her duties.
E. 
Relationship with Tribal programs or departments. The Legislature may assign departments or programs to present matters to a certain committee first prior to bringing the matter before the entire Legislature or to report regularly to an assigned committee at such intervals prescribed by the committee chairperson. Such department or program assignments shall be reflected in the committee flowchart established pursuant to § 98-10 of this chapter. Employees of tribal programs and departments shall cooperate with all such requests unless the Tribal Chairperson determines the request to be unreasonably burdensome.
F. 
Limitation on committee membership. An employee whose position requires him/her to serve on a committee and the person is not enrolled in the Menominee Tribe may not serve on a main committee. In the event that an employee identified as a member of the committee is not enrolled with the Menominee Tribe, the Chairperson may nominate an alternate employee who is enrolled in the Tribe, or may leave the seat vacant.
Pursuant to Article IV, Section 6 of the Constitution and Bylaws of the Tribe, the Legislature is authorized to establish community committees in order to determine the needs and concerns of the community to which it is assigned. Each community committee established hereunder shall be composed of three members of the Legislature. On-reservation community committees (Subsections A through E below) shall hold not fewer than four meetings per year. Off-reservation community committees (Subsections F and G below) shall hold two meetings per year. All community committee meetings shall be posted in accordance with Chapter 177, Posting Procedures, of this Code. The official minutes of all community committees shall be forwarded to the Legislature for action and/or consideration by the Legislature. The following community committees are hereby established:
A. 
Keshena Community Committee;
B. 
Neopit Community Committee;
C. 
South Branch Community Committee;
D. 
Zoar Community Committee;
E. 
Nanaweyah Ominihekan (Middle Village) Committee;
F. 
Chicago Community Committee; and
G. 
Milwaukee Community Committee.
The Tribal Legislature may establish annually or as they deem necessary joint committees that are made up of members from the Legislature and another entity's governing body, where there are matters of joint interest. These joint committees will provide for a means of communication between the Tribe and other entities. They are established to provide research, investigating and advisory assistance to the Legislature when dealing with matters of joint interest.

B. 
Menominee Tribal Legislature/Menominee Indian School District; and
C. 
Menominee Tribal Legislature/Menominee Tribal Enterprises.
