It shall be, and is hereby declared
to be, unlawful for any person, being the owner, or having the care
or control of any livestock or other domesticated animal, to suffer
or permit the same to run at large within the corporate limits of
the City. It shall be the duty of every owner or person having the
care or control of any such animal to keep the same within a proper
enclosure.

A. When any livestock shall be found running
at large within the corporate limit of this City, it shall be the
duty of the Animal Control Officer to restrain the same in the City
Animal Shelter. The animal shall be safely kept therein until disposed
of as provided herein.
B. When any livestock shall be impounded as provided in Subsection
(A), the owner shall be notified thereof by a notice published in one (1) of the local newspapers for two (2) consecutive publications, by the Animal Control Officer. The notice shall be addressed to the owner of the animal impounded, if his/her identity can be ascertained. The notice shall contain a true description of the animal impounded, and shall notify the owner to claim and to take the animal from the animal shelter (describing the locations thereof), after paying all the costs incurred in the proceedings, or that the animal shall be sold under the judgement of the Municipal Judge of the City and the proceeds applied to payment of the costs, unless the owner appears within seven (7) days from the date of the publication of the last notice and show cause why the same shall not be done. The notice shall be signed by the Animal Control Officer.

The Municipal Judge shall certify
to the Chief of Police a copy of the judgement and order of sale entered
in pursuance of this Chapter, and upon receipt thereof, the Chief
of Police shall, after two (2) days notice by four (4) written notices
posted as required stating the time and place of sale and describing
the animal or animals or fowl to be sold, sell such animal or animals
or fowl for cash to the highest bidder. If the judgement directs the
sale of more than one (1) animal or fowl, the Chief of Police shall
sell them either singly or all together, as he/she may deem best for
the owner or owners thereof. In the event no cash bids are received,
the Chief of Police may terminate such animal or animals or fowl.
The proceeds of such sale shall be applied first to pay the costs
for keeping said animal or animals or fowl and of the proceedings,
the remainder of such proceeds shall be delivered to the City Treasurer
and held subject to the order of the City Council, for the former
owner or owners or custodian of the animal or animals or fowl sold.
The Chief of Police shall within ten (10) days thereafter return to
the Municipal Judge, the judgement and order of sale, showing thereon
all proceedings and costs thereof in the execution of the same.

A. There
shall be charged for each animal or fowl impounded, the following
fees which shall be paid into the City Treasury as rental for the
City Animal Pound:
1. For each horse, mule, ass, jennet, cow, head of cattle, hog, sheep,
or goat, twenty-five dollars ($25.00) for the first twenty-four (24)
hours or fraction thereof and ten dollars ($10.00) for each succeeding
twenty-four (24) hours or fraction thereof;
2. For each goose, duck, or chicken five dollars ($5.00) for the first
twenty-four (24) hours or fraction thereof and four dollars ($4.00)
for each succeeding twenty-four (24) hours or fraction thereof.

Except in those areas zoned for agricultural use and as permitted in Section
205.360, it shall be unlawful for any person to keep livestock in the City.

Any person in physical possession or control of any animal and any owner of any animal (as the term "owner" is defined in Section
205.010) shall remove and properly dispose of excreta and other solid waste deposited by the animal on any public or private property not designated to receive such wastes. The term "public property" shall include, but not be limited to, streets, sidewalks, parking lots, public parks, recreation areas and public facilities. The term "private property" shall include all property which is not public property except that it shall not include any property owned by or leased by the person in physical control of the animal or that person's family and shall not include any property owned by or leased by the owner of the animal or that person's family. The term "family" as used in this Section shall include only those persons related within the second degree by consanguinity or affinity. The provisions of this Section shall not apply to a guide dog accompanying any blind person.
