No person shall engage in the business of tree trimming, tree
removing, tree treating and spraying within the City without first
obtaining a license therefor.

The provisions of Chapter
605 of this Code, insofar as the same may be applicable and not in conflict, shall apply to and govern the issuance of any license under the provisions of this Article.

A. No
license shall be issued to any tree trimmer, remover, treater or sprayer
unless there shall have been filed with the City Clerk evidence of
insurance for the following amounts:
1. For injuries to person, to the extent of one hundred thousand dollars
($100,000.00).
2. For the injury or death of any person and subject to that limit for
each person, three hundred thousand dollars ($300,000.00), for each
accident; and,
3. For damage to property, one hundred thousand dollars ($100,000.00)
for each accident.

It is further provided, however, that in lieu of such policy
of insurance such person may file a bond to be signed by some solvent
company licensed to do business in this State, which bond shall be
in the form approved by the City Attorney and shall be conditioned
for the payment of property damage and personal injuries in the same
manner and to the same extent herein provided in the case of the filing
of an insurance policy.

A. The
following regulations are hereby adopted to regulate tree trimming
and tree removals by the City of Harrisonville and/or its contractors
within public right-of-way and above ground electric utility easements:
1. Tree(s) will be trimmed to a minimum clearance of fifteen (15) feet
from the centerline of the primary power lines and six (6) feet from
secondary power lines. Transmission line trimming shall be per Section
537.340, RSMo., depending on voltage level.
2. The City of Harrisonville shall offer the affected homeowner the
option of trimming trees outside of the right-of-way, but no trees
that may grow into the power lines may remain within the right-of-way.
3. In the case where a tree is to be removed, the affected property
owner shall be notified fourteen (14) days, or as soon as reasonably
possible, prior to removal.
4. Trees causing outages shall be immediately trimmed to a distance
such that the tree will not cause another interruption to power lines
within five (5) years. The person(s) tasked with trimming the trees
shall make such determination and use their judgment in trimming trees
to ensure another interruption does not occur within five (5) years.
5. Trees outside of the rights-of-way may be removed if the tree presents
a threat to City of Harrisonville power lines. Such trees are to be
considered "Danger Trees." Danger Trees are trees that are leaning,
dying or diseased, or are otherwise unsafe, that either contact the
power lines or come within ten (10) feet of contacting a power pole,
power line, or appurtenance.
6. The City of Harrisonville is not responsible for trimming power lines
to homes. However, the City will disconnect said power lines should
the homeowner or the homeowner's contractor wish to do trimming or
removals that would endanger the power lines. The City will perform
this service free of charge during normal business hours (7:00 A.M.
— 4:00 P.M., Monday through Friday).
7. Brush and debris from trimming and tree removal shall be cleaned
by the City or its contractor. This shall not include brush and/or
debris caused by storm events. The affected homeowner is responsible
for cleaning brush and/or debris caused by restoration efforts during
or after a storm that requires a tree trimmed or removed.
8. The City may, but is not required to, treat tree stumps that remain
after removal to prevent re-growth.
9. This Section shall be construed to comply with Section 537.340, RSMo.
