The following words, terms and phrases, when used in this Chapter,
shall have the meanings ascribed to them in this Section, except where
the context clearly indicates a different meaning:
Any person engaged in the business of electrical installation,
construction and repair work.
Any person appointed and qualified for the purpose of enforcing
the provisions of this Chapter.
All material, devices or appliances used or installed for
the purpose of conducting or safeguarding electrical current.
Any electrical wiring devices or material, conductors or
equipment.
Any act in connection with the installing, altering, repairing
or maintaining of an electrical system designed or capable of carrying
an electromotive force of thirty (30) volts or more, which act ordinarily
requires the use of tools.
The maintaining of the electrical system or systems in a
specific building. "Maintenance" does not include the installation
of an additional electrical load or new electrical construction in
a building.
Wiring that is not of a permanent nature and which is used
only in connection with supplying a temporary source of electricity
in connection with the construction of a new building or for emergency
use.

A.
Any
person who violates any of the provisions of this Chapter, or fails,
neglects, or refuses to comply with this Chapter, or who fails, neglects,
or refuses to comply with any order or request of the Electrical Inspector,
or his/her agent made pursuant to this Chapter shall be deemed guilty
of a misdemeanor.
B.
Action
taken by the Electrical Inspector to enforce the provisions of this
Chapter shall be done in the name of, and on behalf of the City. Any
suit brought against any inspector by reason thereof shall be defended
by the City Attorney until final termination of the proceedings contained
therein.
C.
The
Electrical Inspector or his/her agents may issue citations for violations
of this Chapter.
D.
When
requested to by the Electrical Inspector, members of the Police Department
shall assist the inspector in making arrests for violations of this
Chapter or in stopping work being performed in violation of this Chapter.

A.
The
City Superintendent of the City of Lockwood is ex officio Electrical
Inspector.
B.
The
Electrical Inspector shall regulate and determine the placing of electrical
light and power wires in and on buildings in the City in such manner
as to prevent fires, accidents or injury to persons or property, and
to cause all major electrical appliances to be so placed, constructed
and guarded, as not to cause fires or accidents, or endanger persons
or property. Whenever in the judgment of the Electrical Inspector
any electric wire or appliance shall be defective by reason of improper
or insufficient insulation, or for any other cause, the inspector
shall cause the immediate removal of the defect.
C.
The
Electrical Inspector, or other competent persons designated by him/her
as his/her agent, shall have the right and power to enter, at any
reasonable time, any premises in the discharge of his/her official
duties, or for the purpose of making tests for electrical apparatus
or appliances therein contained. For that purpose, he/she shall be
given prompt access to all premises on application to the person owning
or having charge or control of same.
D.
The
Electrical Inspector or his/her agent may cause the removal of electrical
wires or turn off current to wires if the wires or circuits to which
the wires are connected interfere with the work of the Fire Department.

Any applicant for an electrical permit whose applicant has been
rejected by the Electrical Inspector or any person who has been ordered
by the Electrical Inspector to incur an expense in the alteration,
repair, or construction of an electrical system may, within fifteen
(15) days thereafter, appeal from such order or rejection to the City
Administrator by giving to the inspector a notice in writing of the
appeal. After such notice as the City Administrator may direct, a
hearing shall be held and the City Administrator may affirm or modify
the action of the inspector. If the action of the inspector is modified
or annulled, a permit shall be issued accordingly.

A.
The
Electrical Inspector may make periodic reinspections of the installation
of all electrical work in the City. When such electrical work is found
to be dangerous or unsafe the Electrical Inspector shall prepare a
written report, in duplicate, stating the defects found to exist,
and establishing a time within which the person who owns uses or repairs
same shall make the necessary repairs or changes required to place
such electrical work in a safe condition. One (1) copy of the report
shall be given by the Electrical Inspector to such person, firm or
corporation owning, using or preparing the electrical work found to
be dangerous and unsafe.
B.
The
Electrical Inspector may order the discontinuance of any electrical
wiring or any electrical work found to be defective or improperly
installed until the installation of such electrical wiring or electrical
work has been made safe as directed by him/her.
C.
The
connection from the City's electrical distribution system to electrical
wiring shall be severed by the Electrical Inspector or his/her agents
if any unsafe condition or condition in violation of this Chapter
is not corrected within thirty (30) days after the person who owns,
uses or maintains same receives notice to do so.

A.
Unless
otherwise specified in this Chapter, electrical materials and appliances
listed in the copyrighted lists of inspected appliances and supplements
published and distributed by the Underwriter's Laboratory shall be
regarded as conforming to the requirements of this Chapter.
B.
The
name, trademark or other identification symbol of the manufacturer
or the person for whom the goods were made shall be placed on all
electrical fittings, equipment and materials, together with such other
markings giving voltage, current, wattage and other ratings as are
prescribed by this Chapter.
C.
It
shall be unlawful for any person to sell, offer for sale or expose
for sale, at retail or wholesale, or to dispose of by gift, or offer
to grant possession of, or to rent or lease any electrical material,
device, appliance or equipment which is not approved for retail sale,
installation and use in the City.
D.
The
requirements of this Chapter relating to the materials, major appliances
and apparatus apply to new electrical work, even if the apparatus
being installed is new or used. When an apparatus is moved from one
(1) location to another within the same building and for the same
owner, these requirements may be waived or modified providing such
apparatus has been examined by the Electrical Inspector and found
to be in good, safe condition. Except as otherwise provided herein,
used apparatus shall be remodeled to comply with the requirements
of this Chapter before being placed in use.

Temporary wiring shall not remain in new building projects past
the completion date of such project, and for all other purposes, as
in the case of emergencies, shall not remain in place longer than
sixty (60) days. In the event that such sixty-day limitation works
an unnecessary hardship on the contractor or owner of the building
or structure which contains the temporary wiring, the Electrical Inspector
may extend the period.

A.
The
electric meters must be arranged so it may be sealed. All fuses must
be in place when the Electrical Inspector makes his/her final inspection.
Only the Electrical Inspector or representatives authorized by the
Electrical Inspector in writing shall have the authority to break
the seal for removal or inspection. In case of emergency, qualified
emergency response personnel may break the seal. In such cases, the
City of Lockwood must be notified immediately.
B.
No
electrical meter is to be enclosed in any structure. If this occurs,
the meter must be made accessible or readily accessible as defined
by the National Electrical Code by the property owner by having the
meter reinstalled at a place deemed accessible by the Electrical Inspector.
The expense of the reinstallation of the meter and service must be
borne by the property owner.
C.
All
electrical service upgrades and all new construction installs must
provide an external disconnect.

All vacant buildings that have open or obsolete vacated electrical
services, or which are in need of repair or have unsafe wiring other
than services must be brought into compliance with this Chapter as
if the building was newly constructed by the property owner before
the electric equipment may be reconnected to the City's electrical
distribution system.
