No consumer fireworks may be discharged on any Borough property; this includes streets, sidewalks and parks.
2. 
No consumer fireworks may be discharged on private property without the express written consent of the property owner.
3. 
No consumer fireworks may be discharged within 150 feet of any structure; this includes houses, sheds, and garages.
4. 
No consumer fireworks may be discharged by anyone under the age of 18.
5. 
No consumer fireworks may be discharged by any person who is under the influence of alcohol, a controlled substance, or another drug.
6. 
No consumer fireworks may be discharged between the hours of 10:00 p.m. and 9:00 a.m.

Any person who shall violate any provision of this Part 3 shall, for each and every such violation, upon conviction thereof, be sentenced to pay a fine of not more than $500 and costs of prosecution. Each day on which any such violation shall take place shall constitute a separate violation.

This Part 3 shall become effective on the earlier of:
1. 
The date when the Mayor approves it;
2. 
The date when Council enacts it over the Mayor's veto; or
3. 
If the Mayor does not return it at or before the next scheduled meeting of Council occurring at least 10 days after its approval by Council, the date of that next scheduled meeting of Council.
