A. 
Short title. This article shall be known and may be cited as the "Parking of Trailers and Oversized Vehicles Ordinance."
B. 
Definitions. Within this article, the following definitions shall apply:
BOAT TRAILER
A vehicle that is designed and constructed to transport a boat used for recreational purposes.
CAMPING TRAILER
A vehicle that:
(1) 
Is mounted on wheels; and
(2) 
Has collapsible partial sidewalls that fold for towing by another vehicle to unfold to provide temporary living quarters for recreational, camping, or travel use.
MOBILE HOME
A motor vehicle, semitrailer, or trailer that is designed, constructed or equipped as a permanent or temporary living or sleeping space and for use as a conveyance on streets or highways, but does not qualify as a camping trailer or travel trailer as defined herein.
OVERSIZED VEHICLE
A vehicle that is either over 21 feet two inches in length or is over six feet eight inches in width, or both.
SEMITRAILER
A vehicle that:
(1) 
Has no motive power;
(2) 
Is designed to carry people or property and to be towed by a motor vehicle; and
(3) 
Is constructed so that some of its weight or load rests on or is carried by another vehicle.
SHIPPING CONTAINER
A container that is resealable and lockable that is used with standard equipment for intermodal shipments; often found on ships, trains, and trucks for the transport of goods, and to include storage pods.
STREET
The entire width between the boundary lines of any way or thoroughfare of which any part is used by the public for vehicular travel, whether or not the way or thoroughfare has been dedicated to the public and accepted by any proper authority.
TRAILER
A vehicle that:
(1) 
Has no motive power;
(2) 
Is designed to carry people or property and to be towed by a motor vehicle; and
(3) 
Is constructed so that no part of its weight rests on the towing vehicle.
TRAVEL TRAILER
A vehicle that:
(1) 
Is mounted on wheels;
(2) 
Is of such a size and weight as not to require any special highway movement permit when towed by a motor vehicle; and
(3) 
Is designed and constructed primarily to provide temporary living quarters for recreational, camping or travel use.
VEHICLE
Any device in, on or by which any individual or property is or might be transported or towed on a street or highway.
C. 
Prohibited acts. A person shall not cause or knowingly permit a boat trailer, camping trailer, oversized vehicle, mobile home, semitrailer, trailer, shipping container, or travel trailer, owned by him or under his control to be parked and remain parked on any street within the corporate boundaries of the Town for a period of 24 consecutive hours or more.
D. 
Shipping container standards. A person may cause or knowingly permit a shipping container, owned by him or her or under his or her control, to be parked and remain parked on any street within the corporate boundaries of the Town for a period of one week provided that the person obtains a temporary permit from the Town Office for such placement and the use of the shipping container is ancillary to a project with a valid building permit or the result of moving. Temporary permits to allow the placement of shipping containers on any street within the corporate boundaries of the Town shall expire after 30 days from the date of issuance. A temporary permit may be extended up to an additional 30 days by the Code Enforcement Officer.
E. 
Violations and penalties. A person who shall violate this article shall be deemed to have committed a municipal infraction, and the penalty for the first violation shall be $100 for the first offense and $200 for the second offense. Each twenty-four-hour period shall constitute a separate offense. In addition to the fines and penalties set forth herein, the Town may avail itself of any and all civil and equitable remedies, including injunctive relief, for the purposes of stopping any threatened or continuing violation of this article.
