The Thornbury Township Board of Health be and is hereby established
by and in accordance with official Township Resolution No. 11 of 2021
(attached hereto and incorporated herein).

Except as set forth to the contrary in the Second Class Township
Code or the laws of the Commonwealth, the Board of Health shall have
the authority to and shall enforce the health and sanitation laws
of the Commonwealth and any regulations adopted thereunder and the
health and sanitation laws and regulations of the Township, as adopted
and amended from time to time by the Board of Supervisors. As and
where permitted by applicable law, the Board of Health may utilize
qualified employees or consultants of the Township to perform the
duties and exercise the authority delegated to it under the laws of
the Commonwealth.

Upon the showing of Township credentials, the Board of Health,
Health Officer and/or Health Inspectors may enter, at any time, any
premises within the Township where there is reasonably suspected to
exist any health hazard or violation of health or sanitation laws
or regulations or which are of a type that may give rise to a health
hazard.

When the Board of Health, Health Officer or Health Inspectors
determine that a health or sanitation hazard or violation exists,
a written order shall be directed to the owner or occupant of the
premises involved, ordering an abatement of the hazard or violation
and the taking of corrective action as deemed necessary under the
circumstances. The Order shall contain:
1. A specific
time in which the abatement and corrective action shall be accomplished.
2. Notice
that if the order is not complied with within the time provided, the
entry may be made into/onto the premises with orders issued for the
immediate termination of the activities creating the violation, the
potential violation and all acts of commerce conducted in, on or at
the premises in question.
3. Notice
that the law or regulation being violated may be enforced in same
manner and fashion as other ordinances of the Township.

Notwithstanding anything in this Ordinance to the contrary:
1. The Board
of Supervisors in conjunction with the Board of Health, may cooperate
and contract with any other municipal corporation in the administration
and enforcement health and sanitation laws.
2. The Board
of Supervisors, the Board of Health and/or the Health Officer may,
in exercising the duties and authority under this Ordinance, may request
assistance from the Department of Environmental Protection, the Department
of Agriculture or the Department of Health, if such assistance is
deemed necessary for the health and safety of the Township and its
residents.

Any person, firm, or corporation who shall violate the provisions
of this Article, shall, upon being found liable therefore in a summary
enforcement proceeding commenced by the Township before the magisterial
district justice, pay a fine of up to $1,000 for each violation. A
separate offense shall arise for each day or portion thereof in which
the violation of this Ordinance is found to exist and for each section
of the Ordinance which is found to be violated. Violators shall also
be found responsible for court costs and reasonable attorney’s
fees of the Township, as permitted by law.
