The sanitary sewer system owned, controlled and administered by the Village of Naples Board of Trustees consists of lateral and trunk sewers along with force main pumping stations laid in streets and rights-of-way and a sewage treatment plant, the locations of which are shown upon plans and drawings filed in the office of the Village Clerk, and all other appurtenances which are used in whole or in part in connection with the collection, treatment and disposal of sewage and all extensions, additions and improvements which may be made to such system. Its purpose is to provide for the collection and treatment of domestic waste and such industrial waste as are permitted by this Part 2 in order to protect the health, safety and general welfare of the residents of the Village of Naples. The purpose of this Part 2 is to protect the sewage system and treatment facilities by controlling the quantity, quality and manner of discharge of sewage into the sanitary sewer system and to establish sewer rents by which the costs of construction of the system and continued collection and treatment may be equitably borne by residents of the Village, owners of property, sanitary sewer districts, sewage disposal benefit areas and independent contractors to whom the system is available.
A. 
Unless the context specifically indicates otherwise, the meanings of terms used in this Part 2 shall be as follows:
BOD (denotes "biochemical oxygen demand")
The quantity of oxygen in the biochemical oxidation of organic matter under standard laboratory procedure in five days at 20° C., expressed in milligrams per liter.
BUILDING DRAIN
That part of the lowest horizontal piping of a drainage system carrying sewage which receives discharge from waste and other drainage pipes inside the walls of the building and conveys it to the building sewer and terminates five feet outside the inner face of the building wall.
BUILDING SEWER OR LATERAL
The extension from the building drain to the public sewer or other place of disposal.
CHIEF OPERATOR
The Chief Operator of the Village of Naples public sanitary sewer system under the supervision of the Commissioner of Public Works and the Village Board of Trustees.
COMMERCIAL AND INDUSTRIAL WASTES
Any and all other liquid, gaseous, solid or other waste substance or a combination thereof resulting from any process of industry, manufacturing, trade or business or from the development or recovery of any natural resources not hereinafter classified as unacceptable or restricted by § 278-29 of this Part 2.
DOMESTIC WASTES
Waterborne human or animal excreta or body wastes and normal culinary, laundry and washing wastes originating in residences or places of business.
GARBAGE
Solid waste from the preparation, cooking and dispensing of food and from handling, storage and sale of produce or other food resources.
OFFICIAL NOTICE
Any communication whether written or verbal and originating from the Clerk/Treasurer of the Village of Naples, the Commissioner of Public Works, the Chief Operator of the public sewer system, or any of his/her agents.
OWNER
Any person in title or having any interest in real property in any sewage disposal benefit area of the Village of Naples or districts and their extensions now existing or subsequently created by the Town Board of the Town of Naples, New York, or any other such district now existing or subsequently created.
PERSON
Any individual, firm, company, association, society, corporation or group.
pH
The logarithm of the reciprocal of the weight of hydrogen ions in grams per liter of solution.
PROPERLY SHREDDED GARBAGE
The waste from the preparation, cooking and dispensing of food that has been shredded to such a degree that all particles will be carried freely under the flow conditions normally prevailing in public sewers, with no particle greater than 1/4 inch in any dimension.
PUBLIC SEWER
A sewer which is controlled by the Public Works Department under the supervision of the Chief Operator of the Village of Naples public sanitary sewer system, the Commissioner of Public Works, and the Village Board of Trustees of the Village of Naples, New York.
SANITARY SEWER
A pipe or conduit which carries sewage and to which stormwater, surface water, groundwaters, or any other effluent not hereinafter described and not specifically detailed and are not intentionally admitted to the public sanitary sewer system.
SEWAGE
The water-carried human or animal wastes from residences, commercial buildings, institutions and industrial establishments as described in this Part 2 except for those requiring further review by the Village Board of Trustees.
SEWAGE SYSTEM
All facilities which are used or useful, in whole or in part, for collecting, pumping, treating and disposing of sewage, industrial wastes and other wastes.
SEWAGE TREATMENT PLANT
Any arrangement of devices, equipment, appurtenances and structures used for treating sewage.
SEWER
A pipe or conduit for carrying sewage.
SEWER COMMISSION
The Board of Trustees of the Village of Naples.
SEWER DISTRICT
Any of the sanitary sewer districts and their extensions now existing or subsequently created by the Town Board of the Town of Naples, New York, and formally recognized by the Board of Trustees of the Village of Naples, New York.
SUSPENDED SOLIDS
Solids that either float on the surface of or are in suspension in water, sewage or other liquids and which are removable by laboratory filtering and subject to influent and effluent levels as established by any current or subsequent state pollutant discharge elimination permit (SPDES) issued by the NYS DEC.
TOXIC OR POISONOUS SUBSTANCE
Any substance, whether gaseous, liquid or solid, which, when discharged to a public sewer in sufficient quantities, will be detrimental to the sewer system, interfere with any biological sewage treatment process, interfere with any current of subsequently issued SPDES permit, constitute a hazard to human beings or animals, inhibit aquatic life or create a hazard to recreation in the receiving waters of the effluent from a sewage treatment plant.
