The office of the Burgess or a Commissioner shall become vacant upon his/her death, resignation, removal from office in any manner authorized by law or forfeiture of his/her office.
The Burgess or a Commissioner shall forfeit his/her office if he/she:
A. 
Lacks at any time during his/her term of office any qualification for the office prescribed by this Charter or by law.
B. 
Violates any express prohibition of this Charter.
C. 
Is convicted of a crime involving moral turpitude.
D. 
Fails to attend three (3) consecutive regular meetings of the Commissioners without being excused by the Commissioners.
A vacancy in the office of the Burgess or of a Commissioner shall be filled for the remainder of the unexpired term, if any, at the next regular election following not less than sixty (60) days upon the occurrence of the vacancy, but the Commissioners, by a majority vote of all of its remaining members, shall appoint a qualified person to fill the vacancy until the person elected to serve the remainder of the unexpired term takes office. If the Commissioners fail to do so within thirty (30) days following the occurrence of the vacancy, the election authorities shall call a special election to fill the vacancy, to be held not sooner than ninety (90) days and not later than one hundred twenty (120) days following the occurrence of the vacancy and to be otherwise governed by the provisions of Article VII, Elections.
