A. 
Terms defined. The following words and terms shall have the following meanings unless the context clearly indicates otherwise:
BOROUGH
The Borough of Swoyersville, in the County of Luzerne and Commonwealth of Pennsylvania.
COAL REFUSE
Any waste coal, rock, shale, slurry, culm, gob, boney, slate, clay and related materials which are either brought above ground or otherwise removed from a coal mine or strip mining operation in the process of mining or stripping of coal or which are separated from coal during the cleaning or preparing operations.
PERSON
Any natural person, partnership, association or corporation. Whenever used in any clause prescribing and imposing a penalty or imposing a fine or imprisonment, the term shall include the members of an association and the officers of a corporation.
PROPERTY
Both real and personal property.
WASTE
Any waste materials resulting from the manufacture of any article or product, or from the preparation, cleaning and processing of any coal or other minerals.
B. 
Usage. When not inconsistent with the context, words used in the present tense shall include the future; words used in the plural number shall include the singular number; and words used in the singular number shall include the plural number. The word "shall" is always mandatory and not merely directory.
No person shall bring or transport into the Borough from any other place outside of the Borough and deposit, dump or store any waste or coal refuse on any public or private property in the Borough.
Any person who brings or transports into the Borough from any place outside of the Borough any article or product to be manufactured or any coal or other minerals for the purpose of cleaning, preparing and processing, or who shall in the Borough manufacture any article or product already in the Borough, or clean, prepare and process coal and other minerals already in the Borough, shall not deposit, dump or store any waste on any property in the Borough for a period in excess of 48 hours.
Any person who shall violate any provision of this article shall, upon conviction in a summary proceeding, be sentenced to pay a fine not exceeding $300 and costs of prosecution, and in default of the payment of such fine and costs may be imprisoned in the Luzerne County Prison for not more than 30 days. A separate offense shall be deemed committed on each day during or on which a violation occurs or continues.
