[HISTORY: Adopted by the Mayor and Council of the Borough of Swoyersville 4-6-1970 by Ord. No. 8-1970. Amendments noted where applicable.]
This chapter shall be known as the "Swoyersville Plumbing Code."

A certain document, three copies of which are on file in the office of the Secretary of the Borough of Swoyersville, being marked and designated as the "BOCA Basic Plumbing Code, Second Edition, 1970," as published by the Building Officials and Code Administrators International, be and is hereby adopted as the Plumbing Code of the Borough of Swoyersville, Luzerne County, Pennsylvania, for the control of buildings and structures as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of the BOCA Basic Plumbing Code, Second Edition, 1970, are hereby referred to, adopted and made a part hereof as if fully set out in this chapter, with the additions, insertions and changes, if any, prescribed in § 66-3 of this chapter.
The following sections are hereby revised as follows:
A. 
Section P-102.0, Effective Date (page 1, first line): insert the date of adoption as being "April 6,1970."
B. 
Section P-201.1, Definitions of Terms (page 5), administrative authority: delete said definition and insert the following: "The designated Building Official referred to in the Swoyersville Building Code."
C. 
Section P-201.1, Definitions of Terms (page 10): add the words, "Plumber. Anyone actively engaged in plumbing for at least three years."
D. 
Section P-308.2 (page 17, third line): insert the number of feet as being "50."
E. 
Section 313.3 (page 18, second and third lines): insert on the second line and the beginning of line three the depth as being "three feet and zero inches," and in the middle of line three insert the depth as being "three feet and zero inches."
A. 
Fees for permits for plumbing work shall be as follows:

(1) 
Where the estimated cost of the work to be done does not exceed $500, the fee shall be $5.
(2) 
Where the estimated cost of the work to be done is more than $500 but does not exceed $1,000, the fee shall be $10.
(3) 
Where the estimated cost of the work to be done exceeds $1,000, the fee shall be $10 for the first $1,000, plus $5 for each additional $500.
B. 
If in the course of the work being done any changes are made in the plans and/or specifications, amended plans and/or specifications shall be submitted for the approval of the administrative authority. If the approval is granted, then a supplementary permit shall be issued. The administrative authority shall determine whether or not an additional permit fee shall be charged to comply with the aforesaid schedule of fees.
In the fulfillment of his duties, the administrative authority, upon proper identification, shall have authority to enter any building, structure or premises during any reasonable time.
The administrative authority shall be given notice at least 24 hours prior to the commencement of the work by the individual, firm or corporation to whom the permit was issued that the work is to commence.
Any person aggrieved by a decision of the administrative authority may take an appeal to the Board of Appeals heretofore established under the provisions of the Building Code of the Borough of Swoyersville.

Any person who shall violate any of the provisions of this chapter or the BOCA Basic Plumbing Code, Second Edition, 1970, or fails to comply therewith, or who shall fail to comply with any order made thereunder, or who shall do or cause to be done plumbing work in violation of any statement of specifications or plans submitted and approved and from which no appeal has been taken, or who shall fail to comply with such an order as affirmed or modified by the administrative authority within the time affixed therein shall, for each and every violation, be guilty of a summary offense and, upon conviction thereof, be subject to a fine not exceeding $300 and costs of prosecution or imprisonment in the Luzerne County Prison for not more than 30 days.
