Bulky items.
Stoves, refrigerators, water tanks, washing machines, furniture and other similar waste materials. This term shall include loose brush greater than four (4") inches in diameter that cannot be bundled in four (4') foot lengths and weighs more than 50 lbs. Items of loose brush shall not exceed five feet (5') in length and 50 lbs.
Bundle.
Trees, shrubs and brush trimmings or newspapers and magazines securely tied together forming an easily handled package not exceeding four (4') feet in length, six (6") in diameter, or fifty (50) pounds in weight. The total amount of “bundled” material set out for collection shall not exceed two cubic yards (6' x 3' x 3') during each collection period.
Construction debris.
Waste building materials resulting from construction, remodeling, repair, demolition or landscaping operations.
Customer.
An occupant of a residential unit or commercial establishment who generates refuse.
Dead animals.
Animals or portions thereof equal to or greater than ten (10) pounds in weight that have expired from any cause, except those slaughtered or killed for human use.
Garbage or trash.
Any and all dead animals of less than ten (10) pounds in weight, except those slaughtered for human consumption, every accumulation of waste (animal, vegetable and/or other matter) that results from the preparation, consumption, dealing in, handling, packing, canning, storage, transportation, decay or decomposition of meats, fish, fowl, birds, fruits, grains or other animal or vegetable matter (including, but not by way of limitations, used tin cans and other food containers; and all putrescible or easily decomposable waste animal or vegetable matter, which is likely to attract flies or rodents); except (in all cases) any matter included in the definition of bulky items, construction debris, dead animals, hazardous waste, rubbish or stable matter.
Hazardous waste.
Any chemical, compound, mixture, substance or article which is designated by the United States Environmental Protection Agency or appropriate agency of the state to be “hazardous” as that term is defined by or pursuant to police or state law.
Recyclable material.
Post-consumer products that are not placed in a landfill or incinerated, but are diverted from the waste stream for reuse or reprocessing as another product. Except as otherwise provided, recyclable material shall be included as a part of the term garbage for all provisions of this article related to the collection, pickup and disposal of garbage.
Residential unit.
A single-family, duplex, triplex or fourplex dwelling within the corporate limits of the city. A residential unit shall be deemed occupied when city water or sewer or waste removal services are provided to it by reason of human habitation of the premises.
Rubbish.
All waste wood, wood products, tree trimmings, grass cuttings, dead plants, weeds, leaves, dead trees or branches thereof, chips, shavings, sawdust, printed matter, paper, pasteboard, rags, straw, used and discarded mattresses, used and discarded clothing, used and discarded shoes and boots, combustible waste pulp and other products such as are used for packaging or wrapping crockery and glass, cinders, floor sweeping, glass, mineral or metallic substances, and any and all other waste materials not included in the definition of bulky items, construction debris, dead animals, garbage, hazardous waste or stable matter.
Stable matter.
All manure and other waste matter normally accumulated in or around a stable, or any animal, livestock, poultry enclosure, and resulting from the keeping of animals, poultry, or livestock.

All residences in the city shall use garbage pickup facilities as provided by the city. The use of such facilities shall be mandatory and bills for such services shall be added to the monthly water bill of the city.

The city shall provide or make available garbage pickup service so that garbage will be picked up once weekly at each residential location in the city. The weekly residential pickup day shall be Wednesday; provided that the city council may change the day from time to time by resolution and written notice to residential customers.

The charge to be made for garbage pickup service shall be as fixed by the franchise agreement.

Any bill not paid in full within fifteen (15) days of the due date shall be deemed past due, and a delinquent payment charge shall be assessed. When water, wastewater services and garbage services or a combination of any of the three services are included in a bill, payment in full for all services must be made or otherwise the entire bill will be considered delinquent. Any services for which charges continue to be delinquent for twenty (20) days from the due date are subject to termination by the city.

Garbage, including all permitted containers and bags, shall be placed either at the front of the premises adjacent to the public street or at the rear of the premises adjacent to a public alley for pickup service at such location. Garbage may be placed out for pickup no earlier than 7:00 p.m. on the day before the scheduled day of pickup and shall be removed no later than 10:00 p.m. on the day of the scheduled pickup.

(a) 
All garbage and trash placed on the exterior of a premises shall be kept in a garbage container. Garbage containers shall meet the following minimum requirements:
(1) 
The container shall be equipped with suitable lifting handles or handle on the outside, and a securely fitting cover or lid equipped with a handle;
(2) 
The container must not have any inside structures, such as inside bands and reinforcing angles or anything within the container to prevent the free discharge of the contents; and
(3) 
The container shall not be deteriorated or damaged to the extent that:
(A) 
The container has jagged or sharp edges capable of causing injury to garbage collectors or other persons whose duty it is to handle the containers; or
(B) 
The container’s cover does not fit securely so as to protect the interior from the elements and/or small animals, including birds and rodents.
(b) 
Refuse containers shall be watertight, constructed of a solid and durable grade of metal, fiberglass or plastic, and not exceed thirty-five (35) gallons in capacity. The combined weight of the refuse container and its contents shall not exceed fifty (50) pounds.
(c) 
Polycart containers shall be rubber-wheeled, watertight, constructed of a solid and durable grade of metal, fiberglass or plastic and not exceed ninety-five (95) gallons in capacity. The combined weight of the polycart container and its contents shall not exceed one hundred and seventy-five (175) pounds.
(d) 
Recycling containers shall be watertight, constructed of a durable grade plastic with a minimum capacity of 18 gallons. The container shall be designed for the purpose of curbside collection of recycling materials.
(e) 
Containers that do not meet the minimum applicable requirements in this section may be condemned and, after written notice to the owner of the container and property owner, confiscated by the city.

Where garbage or trash is not placed in a garbage container as described in this article or in a watertight garbage bag when permitted, such garbage or trash will not be picked up by the garbage collector except upon the making of special arrangements with the garbage collector for such service; provided, the garbage collector, in his/her sole discretion, is authorized to pick up garbage or trash placed out for pickup that is not kept in a garbage container described by this article.

This article does not cover hazardous, toxic or radioactive wastes or substances as currently or in future defined as such by applicable police, state or local laws or regulations. The city will not be responsible for hauling human or animal waste, hazardous waste, auto parts, rocks, concrete, sand, gravel, dirt, or construction debris, unless specifically contracted for with the generator of such refuse.

For residential customers, service shall be between 7:00 a.m. and 8:00 p.m. on the scheduled pickup day. Service on Sundays or holidays shall not be provided. There will be at least one pickup per week of a holiday. Holidays for the purpose of this article shall be New Year’s Day, Memorial Day, Independence Day, Labor Day, Thanksgiving Day and Christmas Day; provided that the city may designate additional holidays by resolution from time to time and with notice to city customers.

(a) 
Except as otherwise provided in this section, any person, firm or corporation violating any term or provision of this article shall be deemed guilty of a misdemeanor and, upon conviction, shall be subject to a fine not to exceed the sum of two hundred dollars ($200.00) for each offense.
(b) 
The maximum fine for an offense under section 13.06.006 shall not exceed the following:
(1) 
Twenty-five dollars ($25.00) for a first offense;
(2) 
Fifty dollars ($50.00) for a second offense; and
(3) 
Seventy-five dollars ($75.00) for a third and subsequent offense.
