The purpose of this article is to set restrictions for the parking
of commercial vehicles and large vehicles on certain public streets
within the Township.
The following words, when used in this article, shall have the
meanings ascribed to them in this section, except in those instances
where the context clearly states otherwise:
BOARD
The Board of Supervisors of West Manchester Township.
CODE OFFICIAL
The code official for purposes of this article shall be the
Zoning Officer of West Manchester Township or his or her officially
designated representative, or the Police Chief of West Manchester
Township or his or her officially designated representative.
COMMERCIAL VEHICLE
Any motor vehicle containing more than two axles or any vehicle
which is used or designed to be used for business or commercial purposes.
LARGE VEHICLE
Any vehicle, including a trailer, which is 96 inches or wider, or which is 120 inches high or higher; except, however, that a large vehicle as defined in this section shall not include a recreational vehicle as defined in Chapter
97 of the Code of the Township of West Manchester.
PERSON
Every natural person, association, partnership, limited liability
company, corporation, or entity of any kind.
POLICE CHIEF
The duly appointed Police Chief of West Manchester Township.
PUBLIC STREET
Includes any street, road, lane, court, alley or public square
which has been accepted and/or adopted by West Manchester Township
as a public road.
TOWNSHIP
West Manchester Township, York County, Pennsylvania.
ZONING OFFICER
The duly appointed Zoning Officer of West Manchester Township.
No commercial vehicle or large vehicle shall be left or parked
upon any public street of West Manchester Township within the Rural
Residential (R) Zone or within Residential Zones R1 through R6; provided,
however, that nothing in this section shall prohibit vehicles of the
West Manchester Township Police Department, West Manchester Township
Fire Department, or commercial vehicles of any public utility company
engaged in the performance of public utility work, or vehicles making
local deliveries or rendering services to occupants of buildings upon
such public streets, from parking commercial vehicles or large vehicles
on public streets.
Any resident may apply to the Township Code Official for a permit
to allow the overnight parking of a residential moving truck, including
rental trucks, even if such truck meets the definition of a commercial
vehicle or a large vehicle as defined in this article. A permit may,
at the discretion of the code official, be issued to permit on-street
parking of a moving truck for up to 48 hours. There shall be no fee
for such permit.
This article shall be enforced by a code official or by the
West Manchester Township Police Department.
Any person who shall violate any provision of this article shall
be guilty of a summary criminal offense and, upon conviction thereof,
be sentenced to pay a fine of not more than $1,000 and in default
of payment, be sentenced to imprisonment for a term not to exceed
30 days. Each day that a violation continues shall constitute a separate
offense.
