It shall hereafter be unlawful for any person, firm or corporation to accumulate or store on any premises within the corporate limits of the city more than ten (10) cubic yards of grass, loose cotton or paper, cotton burrs, shavings or any other bulky combustible matter, unless such matter be stored within a fireproof building constructed of brick, concrete, stone or other masonry construction, the roof of which shall be of a noncombustible material.

It shall hereafter be unlawful for any person, firm or corporation to burn or destroy any of the combustible matter mentioned in section 5.05.001 within the corporate limits of the city, except to burn the same in an approved incinerator, the specifications of which must meet the approval of the governing body of the city, which approval must be shown by a proper permit issued by the city; or, in the case of operators of cotton gins, as provided in section 5.05.003.

It shall hereafter be unlawful for any person, firm or corporation operating a cotton gin within the city limits to burn or destroy any cotton burrs, leaves, parts of cotton stalks, waste lint or other combustible matter mentioned in section 5.05.001 within the corporate limits of the city, except to burn the same in an incinerator of the following specifications: such incinerator shall be a cylinder-shaped structure standing upright on a substantial concrete foundation and not less than twenty feet (20') in diameter with its main walls not less than eighteen feet (18') in height, and such walls shall be constructed of heavy iron lined inside with either common or fireproof brick, laid flat, to a height of at least ten feet (10') above its concrete foundation, or the main walls of said incinerator may be constructed of fireproof brick, laid flat, to the height of at least ten feet (10') above its concrete foundation, and the remainder of such walls of heavy iron structure up to the required height of eighteen feet (18'). Any such incinerator shall be covered by a sparkproof and windproof conical-shaped iron cover securely attached to the top of its walls; and such incinerator shall be provided with a smokestack at least thirty inches (30") in diameter, which shall be connected to the body or reservoir of such incinerator near its top, and which said smokestack shall extend vertically at least twenty-five feet (25') from its point of connection with the body or reservoir of said incinerator, and be supported by a substantial and sufficient concrete foundation; and the earth shall be removed from the inside of such incinerator to a depth of at least three feet (3') below the grade level; and such incinerator shall be provided with two (2) clean-out doors near the bottom of such structure and placed diametrically opposite each other; and the smokestack of said incinerator shall be equipped with an efficient spark screen or arrester. Such incinerator shall be subject to inspection for approval or disapproval by the governing body of the city, or under its direction, and, when so approved, a proper permit shall be issued for its use.
