(a) Prohibited except on commercial zoned property.
It shall
be unlawful for the owner of any property within the city to cause
to be installed therein and thereon any underground storage tanks
for the storage of gasoline and/or diesel fuel, and any underground
storage tanks which may have been heretofore installed may not be
used for such purpose; provided, however, this prohibition shall not
be applicable to property which has heretofore been or may hereafter
be zoned as commercial property by the city.
(b) Deliveries to underground tanks.
It shall be unlawful
for any person or firm or corporation to deliver gasoline and/or diesel
fuel in bulk quantities to any property within the city except to
such property which is zoned as commercial property and on which there
have been installed underground storage facilities for the storage
of such gasoline and/or diesel fuel.
(c) Penalty.
Any person, firm or corporation who shall violate
any of the provisions of this section, or fail to comply with any
of the requirements hereof, shall be guilty of a misdemeanor and shall
be liable to a fine of not more than two hundred dollars ($200.00),
and each day such violation shall be permitted to exist shall constitute
a separate offense.

Fire department.
The department of a local or municipal authority in charge
of preventing and fighting fires.
Fireworks.
A composition or device designed for entertainment to produce
a visible or audible effect by combustion, explosion, deflagration,
or detonation, including but not be limited to the following: firecrackers,
roman candles, sparklers, torpedoes, bombs, skyrockets, buzz bombs,
atomic wings, aerial flash salutes, and trail blazers.
Non-residential.
Property not located in an “R” zoning district,
or any residential component of a planned unit development.

Any person who shall violate any of the provisions of this article,
upon conviction, shall be liable to a fine of not more than five hundred
dollars ($500.00), and each such violation shall constitute a separate
offense.

It shall be unlawful for any person (including corporations,
partnerships, associations, firms, and companies, as well as individuals)
to in any manner shoot, discharge, explode, ignite, display or sell
any fireworks within the city, except as provided in sections 8.02.004-8.02.005
hereof.

(a) Generally.
Non-residential public fireworks displays
may be authorized upon written application to the city secretary stating
the name and address of the applicant, the name of the licensed pyrotechnic
operator or fireworks display permit holder, the time and place of
the proposed exhibition, and a description of the kind, character
and quantity of the fireworks approved by the Federal Consumer Safety
Products Commission intended to be displayed. The city secretary may
issue an appropriate permit when the application submitted to the
appropriate fire department has been approved by the chief, or his
or her designee.
(b) Application.
(1) The permit authorizing such display shall be conditioned on approval
by the appropriate fire department.
(2) The written application to the city secretary must be accompanied
by the approved fire department permit.
(3) Application must be made no later than 10 days prior to the scheduled
event.
(4) Application for the display shall be communicated to the business
owner where the display is occurring, the city’s police department
and the city’s director of communications.

Any fireworks display authorized under this article shall be
limited to an aerial display. Except as determined by the city council,
no fireworks display shall be allowed after 10:00 p.m. unless the
same is specifically authorized by permit for the celebration of July
4th (Independence Day) or New Year during the night of December 31
through January 1.
