The purpose of this article is to promote the health, safety, prosperity, and general welfare of the Town of West Bend by the exercise of the powers granted to the Town Board under the provisions of § 60.22, Wis. Stats.
It shall be unlawful for any person, firm or corporation to collect refuse and/or recyclables in the Town of West Bend without having first entered into a "licensing agreement" with the Town Board of the Town of West Bend.
The licensing agreement shall be in such form and contain such requirements as determined from time to time by the Town Board. Licensing agreements shall be the same for all entities of which such an agreement is required.

Any licensing agreement under this article shall be reviewed annually by the Town Board. Licensing agreements shall run for the calendar year. Such agreements may be renewed only if the Town Board determines that the applicant has in all respects complied with the terms and conditions upon which such license agreement was issued, and that the continuation of such license agreement would be in the public's interest. The Town Board shall determine from time to time the fee to be paid by the applicant as a condition precedent to the approval of the annual licensing agreement.

Any person, firm, corporation, or municipality found to be in violation of this article shall pay a forfeiture of $100 for the first offense, $250 for the second offense, and $500 for the third offense, together with the costs and expenses of prosecution and the costs and expenses of collecting the damages, plus immediate revocation of their licensing agreement by the Town Board. Each day that a violation exists shall be deemed a separate violation.
The provisions of this article shall be deemed severable and it is expressly declared that the Town Board would have passed the other provisions of this article, irrespective of whether or not one or more provisions may be declared invalid and if any provision of this article or the application thereof to any person or circumstances is held invalid, the remainder of the article and the application of such provisions to other persons or circumstances shall not be effected thereby.
This article shall take effect from and after its passage and publication as provided by law.
