The title of this chapter is "the Town of West Bend Comprehensive
Plan Ordinance." The purpose of this chapter is for the Town of West
Bend to lawfully adopt a comprehensive plan as required under § 66.1001(4)(c),
Wis. Stats.
The Town Board of the Town of West Bend has authority under
its village powers under § 60.22, Wis. Stats., its power
to appoint a Town plan commission under §§ 60.62 (4)
and 62.23(1), Wis. Stats., and under § 66.1001(4), Wis.
Stats., to adopt this chapter. The Comprehensive Plan of the Town
of West Bend must be in compliance with § 66.1001(4)(c),
Wis. Stats., in order for the Town Board to adopt this chapter.
The Town Board of the Town of West Bend, by this chapter, adopted
on proper notice with a quorum and roll call vote by a majority of
the Town Board present and voting, provides the authority for the
Town of West Bend to adopt its Comprehensive Plan under § 66.1001(4),
Wis. Stats., and provides the authority for the Town Board to order
its publication.
The Town Board of the Town of West Bend has adopted written
procedures designed to foster public participation in every stage
of the preparation of a Comprehensive Plan as required by § 66.1001(4)(a),
Wis. Stats.
The Plan Commission of the Town of West Bend, by a majority
vote of the entire Commission, recorded in its official minutes, recommending
to the Town Board the adoption of the Town of West Bend Comprehensive
Plan, which contains all of the elements specified in § 66.1001(2),
Wis. Stats.
The Town of West Bend has held a public hearing on this chapter
on September 22, 2005, with notice in compliance with the requirements
of § 66.1001(4)(d), Wis. Stats.
The Town Board of the Town of West Bend by the enactment of
this chapter formally adopts the document entitled "Town of West Bend
Comprehensive Plan 2025 Ordinance" under pursuant to § 66.1001(4)(c),
Wis. Stats.
If any provision of this chapter of its application to any person
or circumstance is held invalid, the invalidity does not affect other
provisions or applications of this chapter that can be given effect
without the invalid provision of application, and to this end, the
provisions of this chapter are severable.
