A. 
The legal and/or equitable owner(s) of a property abutting a sidewalk and/or curb shall keep such abutting sidewalk and curb, together with any portion of such owner's property paved and used as a sidewalk or public walk, in good order and repair and free and clear of obstructions to ensure safe and convenient passage. If any sidewalks or curbs are out of repair, or otherwise could constitute a tripping hazard, such sidewalk or curb shall be repaired or reconstructed in accordance with the specifications of the applicable Borough Subdivision and Land Development Ordinance provisions in effect at such time. If any repairs or reconstruction to current code standards are required for less than 50% of the total frontage of the property on any one street, then such repairs or reconstruction shall be made to replace said portion(s) of the sidewalk or curb. If, however, more than 50% of replacement or repair is required, the entire frontage of the sidewalk or curb shall be replaced in accordance with the specifications of the applicable Borough Subdivision and Land Development Ordinance provisions in effect at such time. The Borough Code Enforcement Officer is authorized to provide a written waiver of such requirements, in full or in part, if the Borough Code Enforcement Officer determines that any reconstruction is detrimental to the health, safety, or welfare of the Borough because of individual aspects of the property including, but not limited to, the location of trees or the specifications, heights, or slopes of adjacent curbs or sidewalks.
B. 
In addition to any other condition deemed out of repair or a tripping hazard by the Borough Code Enforcement Officer, sidewalks with one or more of the following conditions are expressly deemed to present an obstruction to safe and convenient passage:
(1) 
A difference in elevation of more than 1/4 inch between blocks or as the result of a crack within a block; or
(2) 
A crack within a block that is 1/2 inch or more in width; or
(3) 
A block where the concrete finish is spalling, flaking or crumbling causing a slipping or tripping condition, as determined by the Borough Code Enforcement Officer.
A. 
If the legal and/or equitable owner(s) of a property neglects to perform any repairs or replacements required, the Borough Code Enforcement Officer shall serve a written notice of violation upon such owner notifying the owner of the violation and setting forth how the property may come into compliance. Such notice may be served to the owner by delivering the notice to an adult tenant or occupier of the property, posting the notice on or at the property, or mailing the notice to the property owner's current registered address within the Montgomery County Board of Assessment property records.
B. 
The notice of violation shall provide the owner with at least 30 days from the date of mailing/delivery/posting of the notice to commence the repairs or replacement, shall advise the owner of their right to appeal the violation as set forth in this chapter, and shall advise the owner of the potential penalties set forth in this chapter.
If no required repairs or replacements are commenced after 30 days of the above notice's mailing/delivery/posting, no appeal has been filed, and no extensions have been provided in writing by the Borough Code Enforcement Officer, the Borough may perform the required repairs or replacement of the sidewalk and/or curbs with such costs chargeable to the property owner at the then-current rates prevailing for labor and materials plus an additional 10%, together with all charges and expenses. The Borough may file a municipal lien against the property in violation if such costs and expenses are not thereafter paid within 30 days, with any additional costs or expenses to file such lien also payable by the property owner, and/or the Borough may pursue civil proceedings to collect the same. The repairs or replacement by the Borough shall in no manner relieve the legal and/or equitable owner(s) of a property from the imposition of penalties as herein provided, shall not relieve such owners from any liabilities resulting from the curb or sidewalk, and shall not relieve the owners from thereafter complying with any applicable Borough code requirements.
