If no required repairs or replacements are commenced after 30
days of the above notice's mailing/delivery/posting, no appeal has
been filed, and no extensions have been provided in writing by the
Borough Code Enforcement Officer, the Borough may perform the required
repairs or replacement of the sidewalk and/or curbs with such costs
chargeable to the property owner at the then-current rates prevailing
for labor and materials plus an additional 10%, together with all
charges and expenses. The Borough may file a municipal lien against
the property in violation if such costs and expenses are not thereafter
paid within 30 days, with any additional costs or expenses to file
such lien also payable by the property owner, and/or the Borough may
pursue civil proceedings to collect the same. The repairs or replacement
by the Borough shall in no manner relieve the legal and/or equitable
owner(s) of a property from the imposition of penalties as herein
provided, shall not relieve such owners from any liabilities resulting
from the curb or sidewalk, and shall not relieve the owners from thereafter
complying with any applicable Borough code requirements.
