This Chapter establishes the procedures and standards for the
development, layout and design of subdivisions of land within the
corporate limits of the City and for a distance of five (5) miles
surrounding such corporate limits. As prescribed in this chapter,
they are intended to:
(A) In an
expeditious manner, guide and assist developers in correct procedures
to be followed and to inform developers of the standards which the
City shall require.
(B) Protect
the public interests by controlling the location, design, class, and
type of streets, sidewalks, utilities, drainage, and other essential
services required.
(C) Provide,
for the public welfare, the essential areas required for residential
purposes.

For the purpose of this Chapter
31, the following terms used herein are defined as follows:
Alleys.
Minor ways which are used primarily for vehicular service
access to the back or the side of properties otherwise abutting on
a street.
Chapter.
This Chapter
31 of the Garland Code of Ordinances.
Drainage project.
Either Drainage Improvement District or Drainage Participation
Project.
Lot.
An undivided tract or parcel of land under one ownership
having access to a street, either occupied or to be occupied by a
building or building group together with accessory buildings, which
parcel of land is designated as a separate and distinct tract and
is identified by a tract or lot number or symbol in a duly approved
subdivision plat filed of record.
May.
A requirement or action is discretionary in nature.
Opinion of probable cost (OPC).
The cost estimate, determined by the City, to complete an
individual Drainage Project. The OPC includes costs for surveying,
geotechnical evaluation, design, construction, and all other costs
necessary to complete the Project.
Paving.
The improved base and surface constructed for the use of
vehicular and pedestrian traffic.
Shall.
A requirement or action is mandatory in nature.
Standards.
The official maps, master plans, ordinances and specifications
of the City and shall include the specific exhibits adopted hereby
and made a part of this chapter.
Street.
A way for vehicular traffic, whether designed as a street,
highway, thoroughfare, parkway, throughway, road, avenue, boulevard,
lane, place or however otherwise designated.
Subdivision.
The division of a parcel of land into two (2) or more parcels
for the purpose of transfer of ownership or building development,
provided that a division of land for agricultural purposes into lots
or parcels of five (5) acres or more and not involving a new street
or alley shall not be deemed a “subdivision.” The term
“subdivision” includes resubdivision and when appropriate
to the context, shall relate to the process of subdividing or to the
land subdivided.”

No final approval on a building for occupancy, as required by the Building, Plumbing, Electrical, Mechanical Codes and other provisions of this Code and the Garland Development Code, shall be issued on a newly subdivided parcel of land until all the applicable requirements of this Chapter
31 and of the Garland Development Code have been complied with, including the installation of and acceptance by the City of all waterworks, sewerage and paving improvements for the area designated in the approved plans and specifications submitted in accord with this Chapter and the Garland Development Code.

It being the intent of the City of Garland to consolidate ordinances regarding or related to property development in the City into a comprehensive set of development ordinances apart from the City Code, to the extent that any portion of this Chapter
31 conflicts with the most recent iteration of the GDC, the provision contained in the GDC shall control.
