This article of the city code is hereby designated and shall be known and referred to as the “Wrecker” article of the code or as the wrecker ordinance.

(a) 
The following terms and phrases, as used in this article, unless the context clearly shows otherwise, shall have the following meanings:
Applicant.
The person that applies for a certificate hereunder.
Certificate.
A permit, in the form of a certification of a registration certificate, authorizing the operation of a wrecker service for the purpose of making police pulls within the city.
Certificate holder.
Any person holding a valid registration certificate under this article.
Chief.
The chief of public safety of the city.
Consent tow.
The removal of a vehicle from a public street or place, at the request of the owner, operator or person otherwise in charge of the vehicle, to a place of repair or storage.
Disabled vehicle.
A vehicle which has been rendered unsafe to be driven as the result of some occurrence other than a wreck, including, but not limited to, mechanical failures or breakdowns, fire, or vandalism, or a vehicle which is in a safe driving condition, but the owner is not present or able or permitted to drive so as to reasonably necessitate that the vehicle be removed by a wrecker.
Illegally or unauthorizedly parked vehicle.
A vehicle parked in violation of any state law or city ordinance or without the effective consent of the owner of the premises where the vehicle is parked.
Junked vehicle.
Shall have the same meaning provided a junked vehicle in section 8.05.002 of the Code of Ordinances, City of Dalworthington Gardens, Texas.
Nonconsent tow.
The removal of a vehicle from a public street or place, without the consent of the owner, operator or person otherwise in charge of the vehicle, to a place of storage.
Police pull.
A nonconsent tow ordered by an officer of any law enforcement agency having jurisdiction within the city.
Tow truck.
A tow truck, as defined in V.T.C.A., Occupations Code sec. 2308.002.
Wrecked vehicle.
A vehicle that has been damaged as the result of overturning or colliding with another vehicle or object so as to reasonably necessitate that the vehicle be removed by a wrecker.
Wrecker.
A tow truck, as defined in V.T.C.A., Occupations Code, sec. 2308.002.
Wrecker service.
A towing company, as defined in V.T.C.A., Occupations Code sec. 2308.002.
(b) 
The definitions contained in V.T.C.A., Occupations Code, sec. 2308.002, the Vehicle Storage Facility Act, V.T.C.A., Occupations Code, ch. 2303, and V.T.C.A., Transportation Code., are hereby adopted as to such terms as are used herein and are defined in such statutes.
